Dear City Council, I've commuted by bike for fifteen years, but I never feared for my life until I startedcommuting through Palo Alto. I work on Stanford campus, and my commute takes me down Willow, Bryant, University and Palm Drive. If you commute by bike you already know thehazards on this route. Willow has a bike lane, but bikes still have to negotiate a queue of right- turning cars to get into it, and it's often full of debris. Bryant is supposedly Palo Alto's BikeBoulevard, but about once a week a car blows through a stop sign and almost runs me over (this morning it was a Cybertruck). On University Ave, there are no bike lanes but there aresigns telling me I can't bike on the sidewalk, and traffic is often backed up for entire blocks, so bikes are forced to weave through cars. There are frequent traffic jams due to cars pulling intoor out of parking spaces, or due to cars stopping in the middle of the street to let passengers in or out. The worst part is the Caltrain underpass, with no bike lanes, poor lighting, and a steadystream of fast-moving cars. I wear a high-visibility helmet and when it's dark out I have very bright lights. With all of this, I do not feel like drivers are seeing me or respecting my presence. I've had cars honk at mewhile I'm stopped at a green light waiting for an opening to turn left (this is especially scary because it's exactly how another Stanford bike commuter recently died). I've had cars honkright next to me because they're annoyed that the car in front of them isn't turning right into a stream of traffic. I've had cars cut me off by turning right through the bike lane. And I've hadmany cars pull out into me when they should be stopping at a stop sign. Where bike lanes do exist (and they're never physically separated from the road, which they would need to be inorder to really improve safety) they are routinely obstructed by roots, potholes, garbage bins, road work signs, parked or idling cars, and piles of leaves and other debris. Finally, there arethe traffic lights, most of which don't recognize a bicycle as traffic, so if there happens not to be a car behind you, you have to wait until one shows up. I'm lucky enough to also have the option of commuting to work by bus, but biking is muchfaster. However, it's starting to feel like a selfish indulgence, the sort of thing you do as a death-defying twentysomething but have to swear off when you have children. It's Bike ToWork Day soon and Stanford is sending out emails encouraging staff to commute by bike, and I want to write back asking, How? Exactly what route do you recommend? As I negotiate theCaltrain underpass I wonder: Is this really what you have in mind? Biking through Palo Alto shouldn't be like this. Come to think of it, walking through Palo Alto shouldn't be like this.Why is every block of University Ave dominated by on-street parking and a constant stream of cars? Making our streets safe for bikes requires significant change, and I'm disappointed that PaloAlto wasted the opportunity to keep University Ave partially closed to cars after COVID lockdown, the way it did for Cal Ave and the way Menlo Park did for Santa Cruz. I don'tknow when we can expect real change--or how many people will have to die before it happens. In the meantime, I would like to see more signs on Bryant warning cars that crosstraffic doesn't stop. I'd like to see better accommodation for bicycles in the Caltrain underpass. I'd like drivers to be educated about their responsibilities towards bicyclists (I just checked theCalifornia DMV website, and the only question on the practice theory test that mentions bicycles at all is one pointing out that bicyclists aren't pedestrians). Finally, I'd love to hearfrom the City Council about what bike commuters like me can do to help bring about change. Honorable Council Members, The letter below asks for stronger bike and pedestrian protections/infrastructure and is signedby more than twenty of my colleagues, some with personal stories about their choices about active commutes in our area. I am resending as the Bike and Pedestrian Transportation PlanUpdate comes before you this evening. As a city, we have many goals tied to the walkability and bikeability of our city. I am supportive of thoughtful efforts to integrate those efforts, decide on the metrics we need to getthere, and implement solutions and improvements. This includes better tracking of active transit trips and collisions, so that we can understand both total incidents as well as incidentrates, given our goals of both increasing active transit trips and decreasing (and ideally to zero) traffic fatalities and critical injuries. Many of the undersigned bike to work and go from or through Palo Alto to get there. We are encouraged by and supportive of Palo Alto’s goal of being a pedestrian and bike friendly community. We encourage you to adopt the specific goal of reducing traffic fatalities and critical injuries. Many of us are familiar with the challenges of biking along roads with faster-moving traffic as both entrances to SLAC are along such ones (Alpine Road and Sand Hill Road). We advocate for safer infrastructure to protect pedestrians and bikers along roads like those in Palo Alto, such as Sand Hill, Foothill Expressway, Embarcadero Road, Page Mill, and El Camino. Those roads serve as the most direct ways to get across the area and we note that many other large employers like SLAC are along those roads, leaving workers who bike to those employers little/no choice but to bike along those roads. Particularly along roads like this, we have noticed: Difficulty with left turns where bikes must cross two lanes of traffic. We advocate for bike boxes at intersections Cars, trucks, debris, buses stopping or parking in bike lanes, forcing bikes into the main lanes We advocate for protected bike lanes and improved maintenance With the Plan Update, we broadly encourage the City to prioritize the safety of those using the public roads and infrastructure over faster access to destinations. I drafted a similar letter to Menlo Park and San Mateo County (given where SLAC’s entrances are) in the late fall, making the same two specific points above. I am devastated to see those same points as possible contributors to the recent cyclist fatalities.” Meriame Berboucha, SLAC employee for 5+ years I was hit by a car in the area. It was a hit-and-run and I’m still paying for my medical bills now which I cannot afford because I’m a student. Since then I’ve had debt collectors phone me and I still have many scars from the accident. It’s also led me to be very scared to take my bike or electric scooter to work and now I don’t do it anymore. Ryan McClanahan, employee at SLAC (2.5 years) “I routinely bike to work from Palo Alto to SLAC. I use Sandhill because there are wide designated bike lanes. However, I see daily mis-use of the bike lanes by motorists, from pulling into the lane too early for a right turn, to parking in the bike lane and forcing me and other cyclists into the street or sidewalk. Protecting the bike lanes with concrete bollards, or a full curb, would be a huge boon to bicycle commuters on Sandhill, and would assist with car traffic as more people would commute by bicycle because they feel safe doing so. The break away flex posts are not enough, because drivers can still drive through these and hit a cyclist” Paul Jones, SLAC employee and Palo Alto resident “I have stopped cycling to work due to road safety concerns, specifically the lack of protection for cyclists crossing Sand Hill Road and Alpine Road.” Brendan O’Shea: I bike to and from work along Foothill Expressway and enter and exit SLAC through the Alpine Road gate. I’ve been a SLAC employee for 9+ years and a biker for the last two. Bike infrastructure is key to meeting the world’s carbon emission goals. One reason people do not bike is they do not feel safe. Prioritizing biker safety is an admirable goal in and of itself, but the effects of robust and safe bike infrastructure help everyone, not just the people riding bikes. Stefan Moeller, SLAC employee I used to bike from Palo Alto Caltrain station to SLAC for many years and have had several close calls with cars. I eventually stopped riding my bike to work mainly due to safety concerns. Sarah Gaiser, student at SLAC I bike to SLAC multiple times per week, usually along Sand Hill Road. Recently, the bike lane has been blocked by debris or cars which left me feeling vulnerable having to bike in the car lanes. Philip Mansfield, employee at SLAC for four years I periodically will try to bike to work along Sand Hill Road as my main form of commuting. I usually manage for a few months before having a frightening encounter with a car and swearing off it for half a year. David Agyeman-Budu, employee at SLAC (4.5 years) I bike to SLAC using Sand Hill Road for most of my commute and the state of the bike lanes has steadily not been as safe as it has been before. There is vegetation that is on the path which is not routinely cleaned. Parts of the path have ongoing construction work, which is a nuisance especially at nighttime. Hello, I am Eugene Plimpton a homeowner at 1387 Camellia Dr living with my wife and 2 children. We are one of the closest homes to the airport and are impacted by the noise. I am writing to say “No” to any PAO expansion, including extending the runway and buildingadditional hangars and storage. Palo Alto residents and neighboring communities are already highly impacted by aircraft from PAO and other airports. I urge the City to focus its PAOefforts on sustainability and reducing today’s environmental impacts. Expanding an airport in the middle of a nature preserve does not make sense. Expanding PAO is also not aligned withthe City Council priorities on Climate Change & Natural Environment - Protection & Adaptation and on Community Health,Safety, Wellness and Belonging. Hi Palo Alto city council, I've lived in Palo Alto for many years and more recently have been a homeowner in East PaloAlto for the last 5 years. I support the airport expansion and building more hangars. KPAO is a wonderful addition to the infrastructure of the peninsula and serves many purposes including med flights (angel flights), learning to fly, civil aviation patrol, and generaltransportation. It's also a wonderful way to introduce kids (I have 3) to concepts in engineering and science, which I do during our walks in the baylands by the airport. Airports are a rare piece of infrastructure these days that are seeing pressure from financiallymotivated groups (developers) to shut them down and re-use the land for more apartment buildings. I would be proud if the city of palo alto could stand up to this short sighted trendand instead continue to invest in a piece of infrastructure that will become more valuable over time for the residents of this community. Please take this as my full support to extend the runway and build more hangers. Be cautious of opening attachments and clicking on links. ________________________________ Dear Mayor Stone, Vice Mayor Lauing and council members, Yesterday’s lead article in the Palo Alto Daily Post describes the tragic deaths of two dogs whose leashes were caught by cyclists and dragged on the Baylands trail. Two cyclists rode into leashes and killed these pets according to ranger Lisa Myers. She added, “The conflicts we have seen, a lot of them have been due to speeding and inattentiveness by bicyclists. We have had a number of older individuals who have been hit by bicyclists." I urge you the council to act and correct this use that has increased in the Lucy Evans Nature Preserve. Lucy Evans fought long and hard with the city to get the preserve established. She was a teacher who lived next door to my grandmother here in town. I knew her as a child. Her dedication to our community in preserving the Baylands was visionary. It was never established to prioritize a commuter corridor for cyclists. I am a long time visitor to the Lucy Evans Nature Preserve and have been stunned at the use of the trail by cyclists where there are many more using it as a commuter corridor. A month ago my neighbor and I were walking north on the trail alongside the wetlands parallel to the airport. We had to jump out of our way several times because approaching cyclists were upon us. They rode way too fast and saw the pedestrians as impediments. Imagine you are walking on a sidewalk in Palo Alto minding your own business and suddenly and often bikes come upon you. You have to dodge the reckless cyclists in order to save your life. My friend and I were shocked at the volume of cyclists on the trail and we have concluded that the Lucy Evans Nature Preserve is no longer serving the community who enjoy walking on trails. We feel our SAFETY is threatened and the preserve is being co-opted by a certain demographic. Please listen to constituents and emphasize keeping this special nature preserve intact for residents to enjoy. You know well the important place this nature preserve holds for our community. It is a respite from the traffic and other pressures of living in SV. It is a mental health boost. It is where educators teach about bird migrations, flora and fauna. There are photographers, painters, birdwatchers, families, couples, kids and others who enjoy greatly the trails. We in Palo Alto are fortunate to live near this special nature preserve. Sheila Brady, a wildlife photographer told the Daily Post reporter that she has had to yank her camera tripod out of the way of speeding cyclists. Brady said, “I don’t think a nature preserve is the appropriate place to be on point all the time — that somebody any minute is going to yell at you, ‘ON YOUR RIGHT!’ and you have to leap out of the way." As stated in the article hiring more rangers is unrealistic. What could be done to remedy this urgent problem is for the city to provide a separate trail solely for cyclists. The width of the trail is unsafe for cyclists and pedestrians with or without dogs. The Lucy Evans Nature Preserve’s trail cannot accommodate both bicyclists and pedestrians on the same trail. Again, the trails need to be unshared to ensure safety. A new separate path away from the existing pedestrian trail for cyclists appears to be the only way to avoid collisions. Perhaps it is the only way to avoid litigation as well. I had been meaning to write you about my experience at the Baylands but now with the deaths of these two dogs I am compelled to do so. The trails in the wetlands and thesurrounding ecosystem are a precious part of my family's quality of life here in Palo Alto. Also,we have for more than a decade wished there was less airplane noise and traffic overhead, not more. Moreover,removing, paving over, destroying wetlands is (a) not only a crime against the wetland ecosystem and the widediversity of species, who would be negatively impacted in ways we cannot begin to understand or estimate, (b) butalso a reckless approach to land management that damages water quality, creates flood conditions, raises the floodzone, and at the same time also depletes ground water stores and causes drought. Finally, I am among those in ourcity who believe community and not corporate power is what raises the value and prestige of Palo Alto as acommunity. The Airport is a terrific institution as it is, but expanding it will negatively impact our communityculture by catering to the interests of private jets and corporate power, accelerating the concentration of entitlementrather than creating an egalitarian space for shared quality of life. Dear Palo Alto City Council, I am writing to hopefully contribute to your understanding of and obtaining your ongoing support for Palo Alto Airport (PAO). I base an airplane in a hangar (old and dilapidated though it is) at PAO. I use the airplane for my medical practice – it allows me to efficiently see orthopedic patients in several small northern California cities. This would be impossible absent the airplane and convenient access thereto. I work healthcare investments, and the airplane makes it possible for me to efficiently attend board meetings for our fund’s portfolio companies in S. California. Additionally, the airport serves as a training facility for aspiring pilots who go one to become airline or military pilots. I am aware of a few pilots that went on to become NASA astronauts. PAO serves the community in ways that may not be obvious to critics who incorrectly assume the airport is there only to serve a few wealthy Palo Alto residents that happen to have airplanes, or that do not want airports anywhere. I hope that you and your fellow council members recognize the value of PAO, its proximity and usefully to local members of the aviation, academic, business and medical communities, and that you will continue to support modernization of the airport. The city acquisition of the airport has been a very positive move and the subsequent improvement of the tarmac has been muchappreciated by those of us based there. I do coastal surveys both on the peninsula and in mendocino and sonoma counties so being able to fly back and forth is a great advantage over 4hour drives. While extending the runway doesn't affect me (I can operate on much shorter runways than we currently have), integrating the runway into the proposed levee changesmakes a lot of sense for future protection. I am leery of more PC-12 noise. Their sound footprint has more energy at a higher frequency and disturbs people more than other similar sized planes. It would be a pity if the point oflengthening the runway primarily for them angers more neighbors. If we do lengthen it would be good to ensure that they tend to approach and depart over water. A roadway such as Middlefield Rd may have facilities which offer a low LTS but at intersections such as Middlefield & San Antonio, those facilities disappear where turn lanes are placed, resulting in a much higher LTS. Please ask staff and consultants to discuss LTS at intersections as well as along roadways. Also, consider whether Embarcadero Rd should have a high LTS score; posted speed limits may not be observed but may be used to compute the LTS scores presented in the staff report. Please ask about the methodology used. pg 9-of-35 includes references to Adobe Creek crossings The emphasis upon the lack of crossing between the Los Altos-Palo Alto Bike Path and the Foothill Expressway suggests a lack of nuanced understanding of the issue. To be sure, cross-jurisdiction connections are important and have been under emphasized in the past. Mentioning that particular segment of Adobe Creek suggests overuse of geospatial tools to generate the report. Honorable City Council and City Manager Shikada, I am looking at the plans for 800 San Antonio. My recollection is Mr. Lait had said a special setback would be incorporated in projects on San Antonio Road to provide room for future bike/ped facilities. I see a reference to the setback in the plans, but I also see a walking space, trees and plantings shown in areas where one might put bike facilities. Exactly how will this setback be used for bikes/peds/transit facilities? San Antonio Road currently provides sharrows which are completely unsafe facilities on a multi-lane arterial posted 35MPH. These buildings have bike parking, but no way to safely ride a bike into town to school or to anywhere else—even for very skilled and fearless bicyclists. I would appreciate the favor of a reply. With the number of large housing and hotel projects in the pipeline and already approved for this area, I am worried that too little has been done to plan for transportation and other needs, and soon it may be too late. Good planning is not reactive and piecemeal. The recent report by college students was very nice, but it was a learning exercise for a nice group of kids who had very shallow knowledge of the area. It was not a substitute for a comprehensive professional planning process. What is the PLAN for bike and pedestrian and transit facilities on San Antonio Road? What is the community services facility plan for Cubberley? As a south Palo Alto resident, I am concerned about transformative changes that are being made rapidly to this part of town with little meaningful planning or engagement of citizens. Dear City Council I grew up under the flight path of aircraft arriving and departing PAO. I was fascinated by theplanes flying overhead and loved it when my dad took me and my brother and sister to the airport for open house day or to go up into the tower. As a teenager, my parents (non-pilots) had me get my pilots license before my drivers licensebetween they felt it would make me be a better, more responsible driver. As an instrument rated pilot I donated my time and flew mercy flights out of Palo Alto, serving patients coming to Stanford for treatment. As a parent I took my small children to the instructors bench to watch the airplanes land. My nephew and niece both took introductory flights at PAO and my nephew is now a privatepilot, pursuing an aviation career. Now I still fly out of PAO even though I live in Menlo Park (but I still look up when a small plane flys over my house!). PAO has served three generations of my family, and helped me serve the community. I encourage you to support the modernization and enhancement of the airport. PAO is a localgem of a resource that has served multiple generations of families and should be improved for the coming generations and for the benefit of the community. As someone who lives on the peninsula and has worked in Palo Alto since 2013, I am writingbecause I heard there have been complaints about the airport. Until a year ago I barely knew there was an airport in Palo Alto. A colleague of mine who is a pilot and a volunteer made a critical medical flight that saved a life. I started to pay moreattention. Now I know that the Palo Alto airport not only saves lives by providing a base for critical medical flights, but it is also a training airport for our desperately-needed future pilots! Didyou know non-profits bring high school kids out to introduce them to flying, to try to build our nation's pilot pipeline? I didn't! It is not just a playground, or a shortcut to silicon valley, forrich people with planes (although for sure it is undeniably also that), but really critical infrastructure for the future of Palo Alto and all of Santa Clara county and even our country. I love going out to walk on the Bay trails and watch the planes now. The airport is super-busy.It also is pretty old and run down. The terminal looks like it could be parked on the side of El Camino in front of Stanford. I support the expansion and modernization of the airport for all of us! I know there are noiseissues for residents, but this is the Bay Area. We all have noise issues, and the airport pre- dates pretty much anyone who is complaining, unless they are 100 years old. These are peoplewho chose to live in a noisy place near an airport. I mean, no one is shutting down Page Mill Road because the traffic is loud. Full disclosure, my pilot friend retired from HP and is now a flight instructor. And though Iam mid-50's, like some of the kids I started taking lessons from him a few months ago and am now a very old student pilot. At Palo Alto, and thanks to Palo Alto. I am too old to join ourcommercial pilot ranks, but like my friend I hope to someday be able to volunteer to provide emergency flight services to desperate people, and maybe introduce some more kids whoactually can become real commercial pilots and air traffic controllers someday. The Palo Alto airport is amazing and needs our support! If you have not flown out of that airport yet, you should. The route is quite long this year, running 14 miles from the Santa Clara Caltrain Station to Palo Alto, but there are stops in Sunnyvale and Mountain View where you could easily jointhe ride, if you are looking for a shorter route. There will be brief speeches from local officials at the two stops.The ride is a chance to survey the current state of ECR for cycling, and see how it might be modified to better accommodate cyclists. With such a large group,we are quite visible and can safely use the right lane with the typically light Saturday midday auto traffic going around us on the other two lanes. Considerations by theCity leadership to expand Palo Alto Airport, located in some of the most environmentally sensitive acreage within city limits, clearly puts at risk any credibility that the stated prioritiesare actual priorities. To be consistent with the adoption of said priorities, the City needs to drop the idea of expanding the airstrip at PAO which will take away extremely valuable marshhabitat and buffer zones for rising sea level. The City needs to mandate that all aircraft use environmentally friendly unleaded fuel. Saving 5-8 minutes on short transit trips that connect to Caltrain and regional buses is consequential and well worth the complications involved with getting such a project done. 1) Any project should be two-way. It is a marginal additional impact to the park space andwould provide something close to twice the benefit. 2) Improved bike access should be part of this project. The bike connection through the busarea is already quite poor and the new road at Quarry would create another conflict with buses - and bikes would be going in both directions which does create some additional risk. Here is the current path recommended by Google Maps for someone biking to the station froma more northern location in the park or coming from Quarry Road. Bicyclists typically use an even less direct route and if you haven't experienced this yourself, we recommend you try itone weekday morning to see for yourself how substandard the route it. Improvement in bike and pedestrian access to Caltrain and the underpass leading to and from downtown Palo Alto would mitigate the loss of parkland. We recommend that the city worktogether with Stanford and Caltrain to implement a direct and protected path as part of the undedication of parkland, as shown in green. For instance, if an institution advocates that Israel become a single, bi-national state in the area between the Mediterranean and Jordan, could have this support cut or reduced. The law places severe and unjustifiable restrictions on freedom of expression, and is aimed expressly at Palestinians. The law entrenches Jewish supremacy in important public spaces by withdrawing state funding from institutions that challenge the definition of the state as a “Jewish state”. Main provisions: 3(B) If the Minister of Finance sees that an entity has made an expenditure that, in essence, constitutes one of those specified below (in this section – an unsupported expenditure), he is entitled, with the authorization of the minister responsible for the budget item under which this entity is budgeted or supported, after hearing the entity, to reduce the sums earmarked to be transferred from the state budget to this entity under any law: (1) Denying the existence of the State of Israel as a Jewish and democratic state; (2) Incitement to racism, violence or terrorism; (3) Support for an armed struggle or act of terror by an enemy state or a terrorist organization against the State of Israel; (4) Commemorating Independence Day or the day of the establishment of the state as a day of mourning; (5) An act of vandalism or physical desecration that dishonors the state’s flag or symbol. Context: Nakba Day commemorates the dispossession and displacement of more than 750,000 Palestinians in 1948 in the Nakba (“catastrophe” in Arabic). It is an integral element of the Palestinian collective history and identity. On 15 May each year, Palestinians and solidarity activists participate in marches, vigils, lectures, and other events in Israel, the occupied Palestinian territories, and around the world both to recognize and preserve Palestinian history and culture, and to demonstrate the continued resilience of Palestinians. The “Arab Vision documents”, drafted by prominent Palestinian leaders in Israel, make clear that for Palestinians, the Nakba is not just the tragedy of refugees, the loss of a homeland, and the founding of Israel on the remnants of a nation, and nor is it just the destruction of hundreds of Arab villages and the transformation of the cultural landscape, but it is also the experience of oppression and discrimination, that continues to this day, against those who remained in their homeland, including many who were internally displaced during and after 1948, and are now Palestinian citizens of Israel. In 2011, MK Alex Miller of the Yisrael Beiteinu party initiated the Nakba Law, which originally proposed to criminalize participation in Nakba Day events and acts of mourning of Israel’s Independence Day with up to three years’ imprisonment. The law passed in March 2011 by a vote of 37 to 25 without an imprisonment penalty. Prior to its enactment, numerous Israeli academics and public figures criticized and publicly opposed the bill, along with local non-governmental organizations, which noted that the legislation, “serve[s] primarily to stigmatize and to silence the human rights concerns of thePalestinian Arab minority”.[1] Why is it discriminatory? The law violates the rights of Palestinian citizens of Israel to freedom of expression in several spheres, including the political, academic, intellectual, cultural, artistic, and academic spheres, and specifically the rights to education and freedom of expression and occupation, and discriminates based on nationality. The purpose of the Nakba Law is to prevent Palestinians from exercising their democratic right to commemorate a seminal event related to their collective history. Given the centrality of Nakba to the Palestinian people, the law infringes upon their individual and collective dignity in marking and upholding their cultural heritage and history. Not only does the law explicitly privilege Israeli Jewish history, but it also penalizes Palestinians for acknowledging their own displacement and dispossession. The law seeks to prevent the development of a cultural discourse around the Nakba and to inhibit intellectual challenges to the constitutional definition of the State of Israel. Because of the Nakba Law’s broad and vague formulation, particularly regarding the conditions for revoking funding, such as “desecrating state symbols”, the law has a significant chilling effect on the operations of entities receiving state funds. Many institutions engage in self-censorship to avoid risking financial sanctions. The law acts as a deterrent to activities that may fall within its compass and result in budgetary sanctions. Potential recipients of services of such affected organizations will therefore also be negatively affected by the chilling effect of the law. The provisions of the law violate the right to education. Palestinian educational institutions and schools that fall under the definition of an entity whose funding can be revoked under the law will be prevented from incorporating discussions on Palestinian history and identity, with the Nakba as a central event. This exacerbates the pre-existing discrimination in the state curriculum between Palestinian and Jewish schools, as recognized by Human Rights Watch, which noted that "the overarching aims of education remain based on the transmission of Jewish values and culture, and Zionist thought. This type of education may be appropriate for Jewish children, but it is inappropriate for children belonging to the Palestinian Arab minority within Israel." It also violates the rights of Palestinian parents who wish for their children to learn about Palestinian history and collective identity, by denying them the freedom to choose an educational institution that aligns with their views and educational approach. Additionally, it infringes upon the right to freedom of expression of those who engage in critical examination of the character of Israel as a Jewish state within the framework of their work. This law stifles legitimate opposition and protest against the State of Israel as a Jewish and democratic state. The law therefore undermines the legitimacy and status of Palestinian citizens, their collective memory, and their national identity. The law seeks to shape the values,views, and even the behavior of Palestinians through the use of budget allocations that are conditioned upon the nature of an activity and its political and moral content. Legal challenges to law: ● Petition HCJ 3429/11, Alumni Association of the Arab Orthodox School in Haifa et al. v. Minister of Finance and Knesset: English (excerpts); Hebrew. Adalah submitted a joint petition with ACRI, representing parents of Jewish and Palestinian children and analumni association, arguing that the ‘Nakba Law’ is unconstitutional. ○ In January 2012 the Supreme Court issued its decision, see English; Hebrew. The Court declined to rule on the constitutionality of thelaw and instead rejected the petition in a 3-0 decision, on the basis of ripeness, finding that the case was premature for decision, without addressing the merits of the arguments. International criticism: ● Human Rights Watch (30 March 2011) noted that “[t]he predictable result of the law's severe penalties and the vagueness of the acts and institutions that could be penalized is that it will broadly chill freedom of expression by preventing various institutions from commemorating the Nakba at all…” ● In a report, the Special Rapporteur on the Promotion and Protection of the Right to Freedom of Opinion and Expression, 11 June 2012) stated: “The Special Rapporteur is deeply concerned that this law is inherently discriminatory towards Palestinian citizens of Israel, who refer to Israeli Independence Day as the “Nakba”, meaning catastrophe or tragedy, to commemorate those who died and were displaced following the Israeli Declaration of Independence in 1948. The law severely undermines their right to freely express their opinion, preserve their history and culture, and to their right to commemorate the Nakba, which is an integral part of their history … The Special Rapporteur also expresses his regret that, on 5 January 2012, the High Court, in response to a petition challenging the constitutionality of the law, avoided ruling on the matter until a concrete case arises. Given that the mere existence of the law itself encourages self-censorship and that the law itself is incompatible with theinternational obligations of Israel to fully guarantee the right to freedom of opinion and expression of all individuals, the Special Rapporteur strongly urges that the law be annulled.“ (emphasis added) ● Committee on the Elimination of Discrimination against Women, in its 2017 concluding observations noted that: “The Committee is concerned that, following the adoption of the so-called boycott and Nakbah laws in 2011, human rights defenders, including Israeli and Palestinian women, have been subjected to severe restrictions on their activities, including through limitations on their financing.” ● In its 2023 report, the Independent International Commission of Inquiry on the Occupied Palestinian Territory, including East Jerusalem, and Israel noted that “Israeli authorities have passed laws to reduce and restrict civil society activities. This project will likely be the first of many changes on this block of Sutter Ave and the south side of Sutter Ave shares rear property lines with Ellsworth Place homes. Additionally, there is already a shortage of public parking on Sutter Ave and the trash removal plan will exacerbate this problem. IMPLEMENT BETTER SCREENING ALONG THE REAR PROPERTY LINE: According to the most recent landscape plan we can find online, the rear side of 739 Sutter will not have sufficient shrubbery screening to block views between the three-story proposed townhomes and the backyards of the San Carlos Court single story homes. Having appropriate screening along the back fence of 739 Sutter is an EASY FIX, which will also bring peace of mind to the existing homes. This can be done by: 1. Properly implementing Palo Alto Municipal Code: 18.24.050(b)(2)(A), which says Landscape Screening: A landscape screen that includes a row of trees with a minimum one tree per 25 linear feet and continuous shrubbery planting. This screening plant material shall be a minimum 72 inches (six feet) in height when planted. Required trees shall be minimum 24" box size. 2. Removing the benches along the back fence and replacing them with the required screening plant material that is 72 inches (six feet) when planted, per city code referenced in 1) above. 3. Choosing a shrub more suitable to our plant hardiness zone of 9B. The current shrub choice thrives in zone 8 but will not grow past the 6 foot height in our zone 9B area, which is the height of the back fence. Why does EVERY home need a compost bin when there is no land for them to maintain? Their HOA will take care of the trees and shrubs, so they only need to collect their food waste and this could be a sharable receptacle. 2. Limiting the number of cans allowed on the street for trash pick-up day by writing this into their conditions of approval. Palo Alto isalready highly impacted by aircraft from PAO and major airports.
