CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION
Significant exposure to litigation pursuant to SUbdivIsion (b) of Section 54956 9 of
the Government code - one case

Council after discussion WIth counsel authonzed the Town Manager to execute
an amended subdivIsion Improvement agreement with East-West Partners for
construction of the Prosser Dam/89 Roundabout with the follOWIng provIsions
1 The bond amount to be Increased to cover 125% of eslimated construction
cost
2 Construction must commence on July 6, 2009 and be completed by October
1, 2009 or the bond WIll be called by the Town Manager
