HomeMy Public PortalAbout1976-07-27 MeetingZ5b July 27, 1976 The Council of Bal Harbour Village met Tuesday, July 27, 1976 at 9:30 A.M. in the Village Hall. Present: Messrs. Beatty, Mo vis, Printup and Taplin Absent: MO. Logan Also present were Fred W. Maley, Village Manager; Mary T. Wetterer, Village Clerk; and Alan Gold, Village Attorney. On motion of Mr. Davis, seconded by Mr. Taplin and voted, the minutes of the previous meetings of June 29, 1976 and July 13, 1976 were approved as submitted. Alan Gold reviewed the status of the City of Miami Beach waiter suit and said that -Judge Klein had ruled the Dade County ordinance unlawful as it was improperly passed as an emergency ordinance. The County passed another ordinance but the court ruled that it does not have a retroactive effect., Miami Beach will hold a hearing in September regarding retroactive rates. Mayor School of North Bay Village is to meet with Miami Beach on August 4th and it was suggested that we could send someone to the meeting. On the Notth Miami Beachyaase, we have filed a claim stating that the water rates are unlawful as applied to us and North Miami Beach must file a response. Mr. Maley said he had gone to Mr. Anderson's office and had examined the time sheets and documents on the water rate case and feels that the amount billed is fair. It was moved by Mr. Davis, seconded by Mr. Ta;lin and voted that $10,000 be paid now and $10,000 from the new budget. A request for use of the Americana g=rage space for convention purposes through December 2, 1976 was considered. ,On motion of Mr. Beatty, Seconded by Mr. Davis, and voted the request was granted. Statements for the first nine months' operations were discussed. On motion of Mr. Taplin, seconded by Mt. Tavis, and voted the statementdswere filed for audit. P Mr. Maley discussed the possibility of obtaining a franchise with Peoples Gas System. The Council suggested that Mr. Gold review the contract and report at the next meeting. The Council discussed various items in the proposed 1976=77 budgets and on motion of Mr. Davis, seconded by Mr. Taplin and voted, the following ordinances were wised on first reading by title: ORDINANCE No. 185 adopting the General Fund Budget: ORDINANCE No. 186 adopting the Water Department Budget: 25`1 ORDINANCE No. 187 adopting the Sewer Department Budget; and ORDINANCE No. 188 adopting the Department of Tourism Budget. Mr. Maley reported that Great Lakes Dredge and Dock Company has filed a damage suit in Federal Court and we are filing a Response today asking that the suit be dismissed on the basis that it is defective. There being nofurther business on motion of Mr. Taplin, seconded by Mr. Beatty, the meeting was adjourned at 10:55 A.M.
