PROFESSIONAL SERVICES AGREEMENT
BETWEEN
THE VILLAGE OF KEY BISCAYNE
AND
CENTER FOR PUBLIC SAFETY MANAGEMENT, LLC
THIS AGREEMENT (this "Agreement") is made effective as of the day of
2022 (the "Effective Date"), by and between the VILLAGE OF
KEY BISCAYNE, FLORIDA, a Florida municipal corporation, (the "Village"), and CENTER
FOR PUBLIC SAFETY MANAGEMENT, LLC, a District of Columbia limited liability
company (hereinafter, the "Consultant").
WHEREAS, the Village desires certain consulting services for a workforce assessment of
the Village Fire Rescue Department; and
WHEREAS, the Consultant will perform services on behalf of the Village, all as further
set forth in the Proposal dated June 17, 2022, and attached hereto as Exhibit "A" (the "Services");
and
WHEREAS, the Consultant and Village, through mutual negotiation, have agreed upon a
fee for the Services; and
WHEREAS, the Village desires to engage the Consultant to perform the Services and
provide the deliverables as specified below.
NOW, THEREFORE, in consideration of the mutual covenants and conditions contained
herein, the Consultant and the Village agree as follows:
1. Scone of Services.
1.1. Consultant shall provide the Services set forth in the Proposal attached hereto as Exhibit
"A" and incorporated herein by reference (the "Services").
1.2. Consultant shall furnish all reports, documents, and information obtained pursuant to this
Agreement, and recommendations during the term of this Agreement (hereinafter
"Deliverables") to the Village.
2.
Term/Commencement Date.
2.1. The term of this Agreement shall be from the Effective Date through six (6) months
thereafter, unless earlier terminated in accordance with Paragraph 8. Additionally, the
Village Manager may renew this Agreement for one (1) additional six (6) month period
on the same terms as set forth herein upon written notice to the Consultant.

2.2. Consultant agrees that time is of the essence and Consultant shall complete the Services
within the term of this Agreement, unless extended by the Village Manager.
3.
Compensation and Payment.
3.1. Compensation for Services provided by Consultant shall be in accordance with the Proposal
attached hereto as Exhibit "A." Consultant shall be compensated a flat rate, lump sum fee
in the amount of $49,925.00.
3.2. Consultant shall deliver an invoice to Village no more often than once per month detailing
Services completed and the amount due to Consultant under this Agreement. Fees shall be
paid in arrears each month, pursuant to Consultant's invoice, which shall be based upon the
percentage of work completed for each task invoiced. The Village shall pay the Consultant
in accordance with the Florida Prompt Payment Act after approval and acceptance of the
Services by the Village Manager.
3.3. Contractor's invoices must contain the following information for prompt payment:
3.3.1. Name and address of the Consultant;
3.3.2. Purchase Order number;
3.3.3. Contract number;
3.3.4. Date of invoice;
3.3.5. Invoice number (invoice numbers cannot be repeated. Repeated invoice numbers
will be rejected);
3.3.6. Name and type of Services;
3.3.7. Timeframe covered by the invoice; and
3.3.8. Total value of invoice.
Failure to include the above information will result in the delay of payment or rejection of
the invoice. All invoices must be submitted electronically to payables(aa,keybiscayne.fl.gov.
4. Subconsu'tants.
4.1. The Consultant shall be responsible for all payments to any subconsultants and shall
maintain responsibility for all work related to the Services.
4.2. Consultant may only utilize the services of a particular subconsultant with the prior written
approval of the Village Manager, which approval may be granted or withheld in the
Village Manager's sole and absolute discretion.

5. Village's Responsibilities.
5.1. Village shall make available any maps, plans, existing studies, reports, staff and
representatives, and other data pertinent to the Services and in possession of the Village,
and provide criteria requested by Consultant to assist Consultant in performing the
Services.
5.2. Upon Consultant's request, Village shall reasonably cooperate in arranging access to
public information that may be required for Consultant to perform the Services.
6. Consultant's Responsibilities; Representations and Warranties.
6.1. The Consultant shall exercise the same degree of care, skill and diligence in the
performance of the Services as is ordinarily provided by a consultant under similar
circumstances. If at any time during the term of this Agreement or within two (2) years
from the completion of this Agreement, it is determined that the Consultant's Deliverables
or Services are incorrect, not properly rendered, defective, or fail to conform to Village
requests, the Consultant shall at Consultant's sole expense, immediately correct its
Deliverables or Services.
6.2. The Consultant hereby warrants and represents that at all times during the term of this
Agreement it shall maintain in good standing all required licenses, certifications and permits
required under Federal, State and local laws applicable to and necessary to perform the
Services for Village as an independent contractor of the Village. Consultant further warrants
and represents that it has the required knowledge, expertise, and experience to perform the
Services and carry out its obligations under this Agreement in a professional and first class
manner.
6.3. The Consultant represents that is an entity validly existing and in good standing under the
laws of Florida. The execution, delivery and performance of this Agreement by
Consultant have been duly authorized, and this Agreement is binding on Consultant and
enforceable against Consultant in accordance with its terms. No consent of any other
person or entity to such execution, delivery and performance is required.
7. Conflict of Interest.
7.1. To avoid any conflict of interest or any appearance thereof, Consultant shall not, for the
term of this Agreement, provide any consulting services to any private sector entities
(developers, corporations, real estate investors, etc.), with any current, or foreseeable,
adversarial issues in the Village.
8. Termination.
8.1. The Village Manager, without cause, may terminate this Agreement upon five (5) calendar
days' written notice to the Consultant, or immediately with cause.
8.2. Upon receipt of the Village's written notice of termination, Consultant shall immediately
stop work on the project unless directed otherwise by the Village Manager.

8.3. In the event of termination by the Village, the Consultant shall be paid for all work
accepted by the Village Manager up to the date of termination, provided that the
Consultant has first complied with the provisions of Paragraph 8.4.
8.4. The Consultant shall transfer all books, records, reports, working drafts, documents, maps,
and data pertaining to the Services and the project to the Village, in a hard copy and
electronic format within fourteen (14) days from the date of the written notice of
termination or the date of expiration of this Agreement.
9. Insurance.
9.1. Consultant shall secure and maintain throughout the duration of this agreement insurance
of such types and in such amounts not less than those specified below as satisfactory to
Village, naming the Village as an Additional Insured, underwritten by a firm rated A -X or
better by A.M. Best and qualified to do business in the State of Florida. The insurance
coverage shall be primary insurance with respect to the Village, its officials, employees,
agents, and volunteers naming the Village as additional insured. Any insurance maintained
by the Village shall be in excess of the Consultant's insurance and shall not contribute to
the Consultant's insurance. The insurance coverages shall include at a minimum the
amounts set forth in this section and may be increased by the Village as it deems necessary
or prudent.
9.1.1. Commercial General Liability coverage with limits of liability of not less than a
$1,000,000 per Occurrence combined single limit for Bodily Injury and Property
Damage. This Liability Insurance shall also include Completed Operations and
Product Liability coverages and eliminate the exclusion with respect to property under
the care, custody and control of Consultant. The General Aggregate Liability limit
and the Products/Completed Operations Liability Aggregate limit shall be in the
amount of $2,000,000 each.
9.1.2. Workers Compensation and Employer's Liability insurance, to apply for all
employees for statutory limits as required by applicable State and Federal laws. The
policy(ies) must include Employer's Liability with minimum limits of $1,000,000.00
each accident. No employee, subcontractor or agent of the Consultant shall be allowed
to provide Services pursuant to this Agreement who is not covered by Worker's
Compensation insurance.
9.1.3. Business Automobile Liability with minimum limits of $1,000,000 per occurrence,
combined single limit for Bodily Injury and Property Damage. Coverage must be
afforded on a form no more restrictive than the latest edition of the Business
Automobile Liability policy, without restrictive endorsements, as filed by the
Insurance Service Office, and must include Owned, Hired, and Non -Owned Vehicles.
9.1.4. Professional Liability Insurance in an amount of not less than One Million Dollars
($1,000,000.00) per occurrence, single limit.
9.2. Certificate of Insurance. Certificates of Insurance shall be provided to the Village,
reflecting the Village as an Additional Insured (except with respect to Professional

Liability Insurance and Worker's Compensation Insurance), no later than ten (10) days
after award of this Agreement and prior to the execution of this Agreement by Village and
prior to commencing Services. Each certificate shall include no less than (30) thirty -day
advance written notice to Village prior to cancellation, termination, or material alteration
of said policies or insurance. The Consultant shall be responsible for assuring that the
insurance certificates required by this Section remain in full force and effect for the
duration of this Agreement, including any extensions or renewals that may be granted by
the Village. The Certificates of Insurance shall not only name the types of policy(ies)
provided, but also shall refer specifically to this Agreement and shall state that such
insurance is as required by this Agreement. The Village reserves the right to inspect and
return a certified copy of such policies, upon written request by the Village. If a policy is
due to expire prior to the completion of the Services, renewal Certificates of Insurance
shall be furnished thirty (30) calendar days prior to the date of their policy expiration.
Each policy certificate shall be endorsed with a provision that not less than thirty (30)
calendar days' written notice shall be provided to the Village before any policy or
coverage is cancelled or restricted. Acceptance of the Certificate(s) is subject to approval
of the Village.
9.3. Additional Insured. Except with respect to Professional Liability Insurance and Worker's
Compensation Insurance, the Village is to be specifically included as an Additional
Insured for the liability of the Village resulting from Services performed by or on behalf
of the Consultant in performance of this Agreement. The Consultant's insurance,
including that applicable to the Village as an Additional Insured, shall apply on a primary
basis and any other insurance maintained by the Village shall be in excess of and shall not
contribute to the Consultant's insurance. The Consultant's insurance shall contain a
severability of interest provision providing that, except with respect to the total limits of
liability, the insurance shall apply to each Insured or Additional Insured (for applicable
policies) in the same manner as if separate policies had been issued to each.
9.4. Deductibles. All deductibles or self -insured retentions must be declared to and be
reasonably approved by the Village. The Consultant shall be responsible for the payment
of any deductible or self -insured retentions in the event of any claim.
9.5. The provisions of this section shall survive termination of this Agreement.
10. Nondiscrimination. During the term of this Agreement, Consultant shall not discriminate
against any of its employees or applicants for employment because of their race, color, religion,
sex, or national origin, and will abide by all Federal and State laws regarding
nondiscrimination.
11. Attorneys Fees and Waiver of Jury Trial.
11.1. In the event of any litigation arising out of this Agreement, the prevailing party
shall be entitled to recover its attorneys' fees and costs, including the fees and expenses
of any paralegals, law clerks and legal assistants, and including fees and expenses charged
for representation at both the trial and appellate levels.

11.2. IN THE EVENT OF ANY LITIGATION ARISING OUT OF THIS
AGREEMENT, EACH PARTY HEREBY KNOWINGLY, IRREVOCABLY,
VOLUNTARILY AND INTENTIONALLY WAIVES ITS RIGHT TO TRIAL BY
JURY.
12. Indemnification.
12.1. Consultant shall indemnify and hold harmless the Village, its officers, agents and
employees, from and against any and all demands, claims, losses, suits, liabilities, causes
of action, judgment or damages, arising from Consultant's performance or non-
performance of any provision of this Agreement, including, but not limited to, liabilities
arising from contracts between the Consultant and third parties made pursuant to this
Agreement. Consultant shall reimburse the Village for all its expenses including
reasonable attorneys' fees and costs incurred in and about the defense of any such claim
or investigation and for any judgment or damages arising from Consultant's performance
or non-performance of this Agreement.
12.2. Nothing herein is intended to serve as a waiver of sovereign immunity by the
Village nor shall anything included herein be construed as consent to be sued by third
parties in any matter arising out of this Agreement or any other contract. The Village is
subject to section 768.28, Florida Statutes, as may be amended from time to time.
12.3. The provisions of this section shall survive termination of this Agreement.
13.
Notices/Authorized Representatives.
Any notices required by this Agreement shall be in
writing and shall be deemed to have been properly given if transmitted by hand -delivery, by
registered or certified mail with postage prepaid return receipt requested, or by a private postal
service, addressed to the parties (or their successors) at the addresses listed on the signature
page of this Agreement or such other address as the party may have designated by proper
notice.
14. Governing Law and Venue. This Agreement shall be construed in accordance with and
governed by the laws of the State of Florida. Venue for any proceedings arising out of this
Agreement shall be proper exclusively in Miami -Dade County, Florida.
15. Entire Agreement/Modification/Amendment.
15.1. This writing contains the entire Agreement of the parties and supersedes any prior
oral or written representations. No representations were made or relied upon by either
party, other than those that are expressly set forth herein.
15.2. No agent, employee, or other representative of either party is empowered to modify
or amend the terms of this Agreement, unless executed with the same formality as this
document.

16. Ownership and Access to Records and Audits.
16.1. Consultant acknowledges that all inventions, innovations, improvements,
developments, methods, designs, analyses, drawings, reports, compiled information, and
all similar or related information (whether patentable or not) which relate to Services to
the Village which are conceived, developed or made by Consultant during the term of this
Agreement ("Work Product") belong to the Village. Consultant shall promptly disclose
such Work Product to the Village and perform all actions reasonably requested by the
Village (whether during or after the term of this Agreement) to establish and confirm such
ownership (including, without limitation, assignments, powers of attorney and other
instruments).
16.2. Consultant agrees to keep and maintain public records in Consultant's possession
or control in connection with Consultant's performance under this Agreement. The Village
Manager or her designee shall, during the term of this Agreement and for a period of three
(3) years from the date of termination of this Agreement, have access to and the right to
examine and audit any records of the Consultant involving transactions related to this
Agreement. Consultant additionally agrees to comply specifically with the provisions of
Section 119.0701, Florida Statutes. Consultant shall ensure that public records that are
exempt or confidential and exempt from public records disclosure requirements are not
disclosed, except as authorized by law, for the duration of the Agreement, and following
completion of the Agreement until the records are transferred to the Village.
16.3. Upon request from the Village's custodian of public records, Consultant shall
provide the Village with a copy of the requested records or allow the records to be
inspected or copied within a reasonable time at a cost that does not exceed the cost
provided by Chapter 119, Florida Statutes, or as otherwise provided by law.
16.4. Unless otherwise provided by law, any and all records, including but not limited to
reports, surveys, and other data and documents provided or created in connection with this
Agreement are and shall remain the property of the Village.
16.5. Upon completion of this Agreement or in the event of termination by either party,
any and all public records relating to the Agreement in the possession of the Consultant
shall be delivered by the Consultant to the Village Manager, at no cost to the Village,
within seven (7) days. All such records stored electronically by Consultant shall be
delivered to the Village in a format that is compatible with the Village's information
technology systems. Once the public records have been delivered upon completion or
termination of this Agreement, the Consultant shall destroy any and all duplicate public
records that are exempt or confidential and exempt from public records disclosure
requirements.
16.6. Any compensation due to Consultant shall be withheld until all records are received
as provided herein.
16.7. Consultant's failure or refusal to comply with the provisions of this section shall
result in the immediate termination of this Agreement by the Village.

16.8. Notice Pursuant to Section 119.0701(2)(a), Florida Statutes. IF THE
CONSULTANT HAS QUESTIONS REGARDING THE
APPLICATION OF CHAPTER 119, FLORIDA STATUTES, TO THE
CONSULTANT'S DUTY TO PROVIDE PUBLIC RECORDS
RELATING TO THIS AGREEEMENT, CONTACT THE

17. Nonassianability. This Agreement shall not be assignable by Consultant unless such
assignment is first approved by the Village Manager. The Village is relying upon the apparent
qualifications and expertise of the Consultant, and such firm's familiarity with the Village's
area, circumstances and desires.
18. Severabilitv. If any term or provision of this Agreement shall to any extent be held invalid or
unenforceable, the remainder of this Agreement shall not be affected thereby, and each
remaining term and provision of this Agreement shall be valid and be enforceable to the fullest
extent permitted by law.
19. Independent Contractor. The Consultant and its employees, volunteers and agents shall be
and remain an independent contractor and not an agent or employee of the Village with respect
to all of the acts and services performed by and under the terms of this Agreement. This
Agreement shall not in any way be construed to create a partnership, association or any other
kind of joint undertaking, enterprise or venture between the parties.
20. Compliance with Laws. The Consultant shall comply with all applicable laws, ordinances,
rules, regulations, and lawful orders of public authorities in carrying out Services under this
Agreement, and in particular shall obtain all required permits from all jurisdictional agencies
to perform the Services under this Agreement at its own expense.
21. Waiver. The failure of either party to this Agreement to object to or to take affirmative action
with respect to any conduct of the other which is in violation of the terms of this Agreement
shall not be construed as a waiver of the violation or breach, or of any future violation, breach
or wrongful conduct.
22. Survival of Provisions. Any terms or conditions of either this Agreement that require acts
beyond the date of the term of the Agreement, shall survive termination of the Agreement,
shall remain in full force and effect unless and until the terms or conditions are completed and
shall be fully enforceable by either party.

23. Prohibition of Contin2encv Fees. The Consultant warrants that it has not employed or
retained any company or person, other than a bona fide employee working solely for the
Consultant, to solicit or secure this Agreement, and that it has not paid or agreed to pay any
person(s), company, corporation, individual or firm, other than a bona fide employee working
solely for the Consultant, any fee, commission, percentage, gift, or any other consideration,
contingent upon or resulting from the award or making of this Agreement.
24. Public Entity Crimes Affidavit. Consultant shall comply with Section 287.133, Florida
Statutes (Public Entity Crimes Statute), notification of which is hereby incorporated herein by
reference, including execution of any required affidavit.
25. Counterparts. This Agreement may be executed in several counterparts, each of which shall
be deemed an original and such counterparts shall constitute one and the same instrument.
26. Conflicts. In the event of a conflict between the terms of this Agreement and any exhibits or
attachments hereto, the terms of this Agreement shall control.
27. E-Verifv Affidavit. In accordance with Section 448.095, Florida Statutes, the Village requires
all contractors doing business with the Village to register with and use the E -Verify system to
verify the work authorization status of all newly hired employees. The Village will not enter
into a contract unless each party to the contract registers with and uses the E -Verify system.
The contracting entity must provide of its proof of enrollment in E -Verify. For instructions on
how to provide proof of the contracting entity's participation/enrollment in E -Verify, please
visit: https://www.e-verify.gov/faq/how-do-i-provide-proof-of-my-participationenrollment-
in-e-verify. By entering into this Agreement, the Contractor acknowledges that it has read
Section 448.095, Florida Statutes; will comply with the E -Verify requirements imposed by
Section 448.095, Florida Statutes, including but not limited to obtaining E -Verify affidavits
from subcontractors; and has executed the required affidavit attached hereto and incorporated
herein.

The Center for Public Safety Management, LLC (CPSM), the exclusive provider of public safety technical
assistance for the International City/County Management Association (ICMA), is pleased to submit this
proposal to the Village of Key Biscayne for a Workforce Assessment of its Fire Rescue Department in
response to Request for Proposal (RFP) No. 2022-06.
CPSM Background
Founded in 2007 as part of ICMA, CPSM specializes in providing technical assistance to municipalities and
other government entities for independent, comprehensive assessments of their public safety agencies.
We assess police, fire, rescue, and EMS agencies to evaluate and analyze their organization and
operations and use the results of our data analysis and operational assessment to develop practical
recommendations for improving effectiveness and efficiencies as well as to address future needs.
Operating as an independent company since 2014, CPSM is the exclusive provider of public safety
technical assistance for ICMA. CPSM provides training and research for the ICMA's members and
represents the association in its dealings with the federal government and other public safety
professional associations such as CALEA, PERF, IACP, IFCA, IPMA-HR, DOJ, BJA, COPS, NFPA, and others.
CPSM routinely performs comprehensive evaluation and analysis of fire, rescue, EMS, and police using
our unique methodology and industry subject matter expertise. Depending on our client's specific needs
we may examine such aspects as department organizational structure and culture, identify workload and
staffing needs, and align department operations with industry best practices. We have conducted more
than 400 such studies in 46 states and provinces and 310 communities ranging in population from 8,000
(Boone, Iowa) to 800,000 (Indianapolis, Indiana). Our services are designed to assist our clients in
achieving more efficient and effective public safety service delivery that is grounded in data and best
practices, as well as to assist in strategic planning.
The CPSM Approach
CPSM offers a unique and more comprehensive approach than ordinary accreditation or competitor
studies. In general, our analysis involves the following major tasks:

• Conducting a data -driven forensic analysis to identify actual workload, response times, and
resiliency. This data feeds into the GIS demand mapping and travel time mapping from fire
stations which is essential when identifying gaps in fire station coverage and locations;
• Identifying and recommending appropriate staffing and deployment levels for every discrete
departmental operational and support function;
• Performing a gap analysis, comparing the "as -is" state of the department to industry best
practices and standards;
• Measure the fire and rescue department's ability to respond to the community risk and demand
for service, assemble an effective response force for various fire responses, provide goals and
alternatives for effective service delivery.
• Recommending a management framework to ensure accountability, increased efficiency, and
improved performance.
From the day of project launch, we will seek to provide ongoing recommendations and information that
will be used to create the budget for the village. Beginning the gap analysis, looking at alternative service
delivery models, and possible short term deployment methodologies will be refined using data. The final
report will utilize that data to drill down and identify additional recommendations that may look at longer
implementation.

B. Proposal Narrative
B.1. CPSM History
CPSM is a nationally recognized expert in fire protection and EMS service organization analysis and
planning. We routinely analyze deployment of resources including station location, size, etc. against
existing and future needs. We specialize in this work and have completed hundreds of such analyses for
municipal clients nationwide and in Canada. We are able to offer our clients the kind of insight and
creative options available from the broad scope of our experience. As a result of our studies, we have
provided our clients with hundreds of strategic planning recommendations for enhanced service delivery
and efficiencies and cost avoidance.
CPSM's business is exclusively focused on working with municipal governments and agencies responsible
for the administration and/or operation of fire, EMS, or police services. The firm was started as part of
the International City/County Management Association (ICMA), a non-profit organization founded in
1914 and dedicated to assisting local governments and their managers in providing services to its citizens
in an efficient and effective manner. ICMA launched the Center for Public Safety in 2007 to provide
support to local governments in the areas of fire, EMS, and police services. In 2014, as part of a
restructuring at ICMA, CPSM was spun off as a separate company and is now the exclusive provider of
public safety technical assistance for ICMA. CPSM maintains the same team of individuals performing the
same level of service as when it was a component of ICMA.
The firm's principals are shown in Figure 1. All three principals have been with CPSM since its inception.
CPSM's staff includes a team of 30 fire, rescue, and EMS subject matter experts, police subject matter
experts, and data analysts. CPSM is headquartered in Washington, DC, with a quantitative analysis group
based in West Orange, New Jersey, and subject matter experts throughout the U.S.

CPSM has been performing fire and EMS operational and administrative analyses for towns, cities, and
counties —large, medium, and small —for more than 14 years. CPSM has a record of completing its
projects on time, within the established budget, and in compliance with contractual requirements. Many
of our clients are repeat clients, coming back to us for additional studies or to update previously
performed studies.
CPSM offers the Village of Key Biscayne unparalleled experience in performing fire department workforce
assessments using highly capable and experienced fire and rescue services and data analysis subject
matter experts with a track record of competently and efficiently performing similar projects for
municipal clients. Each of our fire and rescue services subject matter experts are current and former fire
and rescue chief officers who have years of experience working in the local government setting and with

CPSM offers the Village of Key Biscayne a project team comprising highly capable and experienced fire
and rescue services and data analysis subject matter experts with a track record of competently and
efficiently performing similar projects for municipal clients. Each of our Fire and Rescue Services
operational subject matter experts are current and former fire, rescue, and EMS chief officers who have
years of experience working in the local government setting. This experience includes working with
municipal leadership and elected officials. Our subject matter experts themselves have prior experience
serving as practitioners, line officers, and middle managers. Their expertise has been applied to similar
projects that CPSM has performed for its clients.
CPSM's proposed project professionals will be available to support the project as needed through
completion. CPSM's subject matter experts have a long history with the firm, which means staff turnover
is not a significant concern. Based on our experience, a dedicated, consistent project team works more
efficiently and effectively, ensuring both continuity of project knowledge and budget management.
Because we have a stable workforce, our project team members have a history of collaborating on similar
projects.

For this project, CPSM has assembled a premier team of experts with hands-on experience and
knowledge directly relevant to performing the required Fire Rescue Department Workforce Assessment.
Chief Joseph Pozzo will be the project manager for this contract. He will lead our project team of Fire and
Rescue and Data Analysis subject matter experts in performing the required scope of services in
accordance with the contract, CPSM's quality standards, and the established project budget and
schedule.
As project manager, Chief Pozzo will serve as a principal point of contact with the Villages's project team.
He will ensure that CPSM performs the required study with the same exceptional quality and service for
which CPSM is recognized. After contract award, at the project kickoff meeting, our project manager will
solicit input on our proposed approach and schedule and document the mutually agreed upon final plan
that CPSM will follow to complete the project.
Chief Pozzo is a Senior Manager for Fire and EMS for CPSM and reports directly to CPSM's Director,
Thomas Wieczorek. Chief Pozzo has completed more than 50 similar studies while with CPSM. He has
had a 40 -year career in public service that includes serving as the Director of Public Protection for
Volusia County, Florida.

Thomas Wieczorek is an expert in fire and emergency medical services operations. He has served as a
police officer, fire chief, director of public safety and city manager and is former Executive Director of the
Center for Public Safety Excellence (formerly the Commission on Fire Accreditation International, Inc.). He
served on the Honolulu Accreditation Review Team for Center for Public Safety Excellence, Commission
on Fire Accreditation International.
He has taught a number of programs at Grand Valley State University, the National Highway Traffic Safety
Administration (NHTSA), and Grand Rapids Junior College. He has testified frequently for the Michigan
Municipal League before the legislature and in several courts as an expert in the field of accident

Chief Pozzo has a 40 -year career in public service, and most recently served as the Director of Public
Protection for Volusia County, Florida where he provided executive leadership to the Fire, EMS,

Department is the largest department in Volusia County and includes 945+ employees, an EMS Division
that handles over 50,000 transports per year and utilizes Florida's first ever Nurse Triage system in the
911 Center, an all -hazards Emergency Management Division that specializes in coastal storm preparation
and response, and a Fire Division that responds to 23,000 calls/year utilizing ALS staffed apparatus.
From March 2015 to September of 2018, Chief Pozzo served as the Assistant Director of Human

benefits administration, and occupational health services functions and teams, as well as assisted in the
management and negotiation of six collective bargaining agreements/units. He was also involved in
developing and implementing the County's Diversity and Inclusion initiative.
Chief Pozzo has also served as the Deputy Director of the Department of Public Protection Volusia
County, Florida, where he was responsible for the day-to-day operations of Fire, EMS, Emergency
Management, Medical Examiner, Beach Safety, Corrections, and Animal Services. He was formerly Fire
Chief of Volusia County Fire Services, where he developed and implemented a service model designed to
introduce EMS transport into the agency, incorporate fleet efficiencies, and enhance the wild land/urban
interface efforts.
Prior to Chief Pozzo's appointment in Volusia County in 2010, he served as the Chief of the Loudoun
County Department of Fire and Rescue. This agency is a combination fire and rescue system providing
fire, rescue, and emergency management services in one of the fastest growing counties in the nation.
The fire and rescue system during Chief Pozzo's tenure provided these services to over 275,000
permanent residents living in 520 square miles of diverse suburban and rural area located within the

National Capital Region. Services were executed through 450+ career staff and 1,400+ volunteer
members operating out of 19 stations.
Prior to his appointment with Loudoun County, Chief Pozzo served as Chief of the Portsmouth Fire,
Rescue and Emergency Services Department. This agency is one of the oldest professional departments
on the eastern seaboard and served over 100,000 residents during Chief Pozzo's tenure. Chief Pozzo also
served in the City of Virginia Beach, Virginia Fire Department for 19 years, reaching the level of Deputy
Fire Marshal and then Battalion Chief prior to embarking on his career as a Fire Chief/Director.
Chief Pozzo holds a Master of Public Administration degree from Troy University, a B.A. in Public
Administration from Saint Leo University, and numerous public safety technical certifications. He holds
the Chief Fire Officer Designation from the Center for Public Safety Excellence and is a Senior Certified

Mark I. Piland is the Fire Chief and Emergency Management Coordinator for the City of Frisco, Texas, one
of the fastest growing cities in the United States. Previously, Piland served as the Fire Chief for Volusia
County Fire Services in Volusia County, Florida and as Shift Commander in Operations for the Virginia
Beach Fire Department in Virginia Beach, Virginia.
Chief Piland has over 35 years in the Fire -Rescue service, beginning as a volunteer, amassing experience
in the areas of Fire Administration, Fire Prevention, Fire Operations, Emergency Management and CERT,
Training, Special Operations, Fire Accreditation, emergency response with local, state, and federal
governments, and executive level management, and budget. Chief Piland has strong expertise in the
areas of executive leadership and community disaster preparedness response and outreach programs.
Chief Piland has served with the Federal Emergency Management Agency (FEMA) as a Task Force Leader
with Virginia Task Force 2 (VATF-2), a FEMA Urban Search and Rescue Team, as well as the East Coast
Task Force Divisional Representative for the FEMA US&R System. He also served as a FEMA Working
Group Member for Command and General Staff and Incident Support Team Leader. Chief Piland served
as The Plans Chief for the Pentagon incident during the 9-11 terrorism attack and deployed as the Task
Force Leader for VATF-2 (Type 180 persons) for Hurricane Katrina in New Orleans (2005), and the
Earthquake in Port Au Prince, Haiti (2010).
Chief Piland has served as a Principal Member on NFPA Technical Committee 1981 Standard on Open
Circuit Self Contained Breathing Apparatus for seven years. He was recently selected to represent the
International Association of Fire Chiefs (IAFC) at the NFPA Forum, a think tank of fire service leaders
brought together to discuss and make recommendations for the protection of the fire service as well as
the life and safety protection needs of society.
Chief Piland possesses a masters of public health degree from Eastern Virginia Medical School and a
bachelor of psychology degree from Old Dominion University. He is a graduate of the National Fire
Academy's Executive Fire Officer Program, The Executive Leaders Program at the Post Naval Graduate
School, Center for Homeland Defense, and Senior Executives in State and Local Government from The
Kennedy School at Harvard.

Chief Rondall L. Early, MPA, EFO, NREMT-P — Associate
Fire Chief, Wake Forest, North Carolina
Chief Early has more than 30 years of fire and EMS experience as a practitioner, middle manager, and
Chief officer in the planning, organizing, delivering, and administration of fire and EMS department
operations. Since 2008, Chief Early has commanded the Wake Forest Fire Department. The Wake Forest
fire department is a combination fire department that provides fire suppression, basic life support
emergency medical services first response, hazardous material response, fire prevention, and fire and
emergency medical services training programs.
Prior to his appointment in Wake Forest, Chief Early served the Portsmouth, VA Fire and EMS Department
for 20 years. In Portsmouth, Chief Early rose through the ranks from firefighter to Battalion Chief, working
in all areas of this department to include engine and ladder companies, EMS transport, and training.
Chief Early's final assignment in Portsmouth prior to leaving for Wake Forest was as the Division Chief for
Emergency Medical Services, where he oversaw the EMS transport operations, EMS billing, training, and
administration of this departmental function.
Chief Early holds a Master in Public Administration degree from Troy University, is a 2011 graduate of the
National Fire Academy's Executive Fire Officer Program, holds the certification of Nationally Registered
Emergency Medical Technician -Paramedic, and holds the rank of 2nd Lieutenant with the North Carolina
Civil Air Patrol in charge of Emergency Services.
Deputy Chief James L. Mauney, (Ret.) — Associate
Former Deputy Fire Chief, Volusia County, Florida; Former Deputy Operations Supervisor, Volusia County
Emergency Management; Former Fire Chief, Lake County Fire & Rescue, Former Director of the Emergency
Services Institute; Volusia County Fire Services.
Jim has a 30 -year career in public safety, beginning as a State Trooper with the Florida Highway Patrol.
Since his retirement from Volusia County, Jim has embarked on a post -retirement career where he
develops and conducts specialized training that includes incident command and management; wild
land/urban interface suppression and defensible communities; design, development, implementation,
and evaluation of emergency response exercises; firefighter principles and practices; fire company officer
leadership, continuity of operations planning, and hazardous materials. Jim is certified in the Homeland
Security Exercise Evaluator Program (HSEEP), and conducts training supported by the Department of
Justice, State of Florida, National Wildfire Coordinating Group, FEMA, NIMS.
As an Assistant Chief with Volusia County, FL, Jim trained Florida's first wildland fire crew in 1994; the
Volusia County Fire Service Firewalkers. These 30 certified firefighters were trained in wildland
firefighting tactics, Florida fuels topography, and weather. In 1998 the team was instrumental in saving
lives, businesses and homes in Volusia County during what is still recognized as "the most complex fire in
America's history". During this incident, Jim served as the Area Commander for the 6 weeks, managing
resources for 968 individual wildland fires totaling 147,000 acres.
Jim is a subject matter expert in the concepts for determining the risks associated with the wild
land/urban interface and Firewise Community development. Jim also has extensive experience in the
principles and practices of Emergency Management. During Jim's career in Emergency Management, he
coordinated operations with 16 municipalities to incidents within the County during 50 -plus

federally declared disasters. Jim maintains his Florida Department of Law Enforcement certifications and

Dov Chelst is an expert in analyzing public safety department workload and deployment. He manages the
analysis of all public safety data for CPSM. He is involved in all phases of CPSM's studies from initial data
collection, onsite review, large-scale dataset processing, statistical analysis, and data report design. To
date, he has managed over 140 data analysis projects for city and county agencies ranging in population
size from 8,000 to 800,000.
Dr, Chelst has a PhD in Mathematics from Rutgers University and a B.A. Magna Cum Laude in
Mathematics and Physics from Yeshiva University. He has taught mathematics, physics, and statistics at
the university level for nine years. He has conducted research in complex analysis, mathematical physics,
and wireless communication networks, presented his academic research at local, national, and

Xianfeng Li, PhD — Public Safety Data Analyst
Dr. Xianfeng Li is a professional computational scientist and certified SAS programmer with a wealth of
knowledge and research experience in complex system modeling, data analysis, and statistical physics. He
performs CPSM's fire and EMS data analyses. He previously worked as a Research Associate at Clemson
University.
Dr. Li earned his PhD and Master's degree in Polymer Science within the Institute of Chemistry from the
Chinese Academy of Sciences in Beijing. He earned his Bachelor's degree in Chemistry at Jilin University in
Changchun.

E. Technical Approach and Understanding
E.1. Methodology and Approach
CPSM has performed 160+ Fire, Rescue, and EMS administrative and operational analyses. This includes a
staffing and deployment study for the City of Miami Beach in 2014. In each, our teams have evaluated
administrative and operational staffing. Our subject matter experts have developed a matrix they follow
when conducting a workforce analysis, which includes:
• Examination of the factors that impact the client's current fire services staffing model.
• Examination of the organization's strengths, weaknesses, opportunities, and threats as related to
administrative and operational staffing and deployment of resources.
• Exploration of various strategic alternative approaches to accomplish the goals of fire staffing and
deployment of resources.
• Delineation of resources needed for the client to accomplish the long-term staffing and deployment
of resources.
• Analysis of the current operational service delivery model to determine if the department has
sufficient resources deployed to meet current workload demands.
• Review and analysis of operational guidelines for the fire services — service delivery system.
• ldentifcation and recommendation of key industry standards and/or best practices that should be
considered as part of the staffing plan.
• Conduct of a Community Risk Analysis and determination of fire department's ability to assemble an
Effective Response Force for the most prevalent risk in the community.
• Examination of factors that enhance/impact department's current service delivery model.
• Examination and analysis of operational guidelines and their connection to the current service
delivery model.
• Exploration of various strategic and performance -related alternative approaches to accomplish the
goals of the current service delivery model with a focus on sustainability.
Using the analysis performed, CPSM will identify and recommend decision -making triggers for additional
administrative and operational personnel.
A key component to our operational deployment modeling strategy is to identify emergent and non -
emergent workloads. This is essential if future planning because this analysis will provide factually based
options to alter service delivery models based on the severity of the call type. Through this analysis, we
provide the forensic support to adjust and modify deployment strategies based on risk. This is the
essence of the CPSE Standard of Cover (SOC) concept. Every call is not the same, and the ability to
interrogate the caller at the 911 call center and make tactical determinations based on proven and
clinical findings will then allow a" Smart Deployment Strategy" that optimizes resources to improve
efficiencies. The study will also analyze fire call data to provide a comprehensive review of how fire
services are delivered to the community including a detailed analysis of workloads and response times.
The analysis of the workloads should begin with an in-depth study of the types and severity of calls
managed. The goal of this data gathering would be to explicate the fundamental nature of the fire
challenge faced by the fire department.

Within the last 24 months, our Fire and EMS teams have utilized this approach with much success in
Exeter, NH, and El Mirage, AZ. The Exter, NH analysis included an evaluation of administrative and
operational staffing and a fire facility location analysis. The Town of Exter, like many, has many municipal
funding needs. The Town engaged CPSM to explore current staffing potential opportunities with a focus
on operational staffing. The Town deploys both Fire and EMS response units (EMS transport) and sought
guidance on how to effectively staff both disciplines.
CPSM conducted an administrative and operational analysis, to include an All -Hazards Community Risk
Assessment, analysis of the current Town ISO-PPC review, and conducted a workload, resiliency, and
response time data analysis. The analysis drove staffing and resource deployment alternatives and
recommendations, spaced over time so that the Town can properly secure funding and appropriately
budget for any additional positions. The Town is moving forward with CPSM's recommendations.
The El Mirage Fire Department (EMFD) engaged CPSM to evaluate the current operational efficiency and
status of the EMFD and identify future needs for strategic planning purposes. This included a staffing
analysis of each component of the department. During the study, CPSM reviewed community risks via an
All -Hazards Risk Assessment, which analyzed factors, from the environment and population growth to
building hazards and incident demand, that enhance risk of emergency within a community. CPSM also
analyzed staffing, deployment, and performance data to evaluate how well the department provided
services per key state and federal standards.
After completing its evaluation and analysis, in February 2022, CPSM issued a 149 -page report outlining
EMFD's functionality and recommending data -backed solutions to expand the department's operational
capacity. CPSM recommended enhancing service delivery in terms of additional assets, including a second
fire station, ladder truck, personnel expansion and improvements within the primary public safety
answering point. These additions would alleviate the risks presented by the presence and anticipated
growth of commercial development and multifamily residences in the community and address current
operational constraints related to response time and staffing.
"CPSM's analysis really shows us the map forward," added Chief Long. "Effective partnerships are key to
effective solutions, and the CPSM team brought combined expertise in data, management and fire
service. They truly understood the needs of our department and the information we shared with them,
so their analysis and recommendations provide our department and our community a lot of value."
The study and its recommendations have been received well by the community and are already being
enacted. City Council approved the addition of three new firefighter positions in line with the proposed
staffing model, as well as a timeline for addition of a new fire station and ladder truck to the City's five-
year Capital Improvement Plan.

and final reports. After contract award, we will discuss the draft timeline with the Village and submit a

CPSM will conduct a virtual meeting with Village's project team. Our
project manager will kick off the project by introducing our team,
clarifying, and confirming expectations, detailing study parameters,
discussing our proposed approach and schedule, and commencing
information and data gathering.
Immediately following the kickoff meeting, our Project Manager will
deliver an information request. This request will provide us with a
detailed understanding of the Village's relevant policies, practices,
organization, management, staffing, etc.
Additionally, our Data Analysis Lead will submit a preliminary data
request, which will evaluate the quality of the CAD system data.
This will be followed by a comprehensive request for data from the
CAD system and the City's NFIRS report information to conduct a
response and workload analysis from these systems.
Once our Data Team is confident the CAD and NFIRS data are
accurate, they will certify that they have all the data necessary to
complete the analysis, and data analysis will commence.
Our Operations Team will review the data and information
uploaded to our cloud file and begin the Operational Analysis.
During this period, our Project Manager and operations team
members will gather additional information as they build the
background information for the report through virtual meetings,
email request, and conference calls. We will develop the
preliminary gap analysis and make budget recommendations to the
City throughout this process.
Our Data Team will provide the client a Draft Data Analysis Report
for review. The City will provide CPSM with a consolidated set of
comments on the report that CPSM will address and incorporate.
Once the Draft Data Analysis is in draft form, and the operations
team has completed the background information sections of the
Operational Analysis, our Project Manager will schedule an onsite
visit. The purpose of this visit is to collect additional administrative
and operational information as needed, conduct stakeholder
interviews, and confirm information already recorded in the draft
report. This portion will utilize the data and preliminary gap analysis
information to refine and recommend long-term deployment
changes that will have a lengthier implementation. Data is required
to enable CPSM to make these types of recommendations and are
based on calls for service, response, and demographics.
