CITY OF MEDINA
RESOLUTION N0. 51'-.:
RESOLUTION APPROVING THE DIVISION AND CONSOLIDATION OF PLATTED
AND UNPLATTED LAND
WHEREAS, Donald M. Erickson and Ernestine E. Erickson,
husband and wife; John M. Enby and Mary C. Luby, husband and wife,
are the fee owners of portions of the real estate set forth on
Exhibit A which is attached hereto and made a part hereof_ by
reference; and
WHEREAS, the above described owners of the two parcels
have made application to divide and consolidate the real estate
as set forth on Exhibit B which is attached hereto and made
a part hereof by reference; and
WHEREAS, no special assessments are outstanding on any
of the parcels set forth in Exhibit A or Exhibit B; and
WHEREAS, the proposed divisions and consolidations
will not create the need for additional streets; and
WHEREAS, a survey of the real estate and concise
legal descriptions of the various parcels have been filed with
the application; and
WHEREAS, the proposed consolidation serves the public
interest by bringing Parcel one, Exhibit A, closer to the minimum
lot size requirements of the City of Medina.
NOW, THEREFORE, BE IT RESOLVED, by the City Council
of the City of Medina as follows:
1, That the said divisions and consolidations are
hereby permitted as a variance to the Platting Code of the
City of Medina due to the unique size and shape of the parcels
of real estate, subject to the following conditions:
A, The applicant shall obtain appropriate divisions and
consolidations for taxing purposes from the Hennepin
County Finance Department consistent herewith,
B. The applicant shall pay an administrative fee 6
to the City of Medina in the amount of $ /� v `�— .
2, Be it Further Resolved that the drainage and utility
easement described as follows:
The South 10 feet of Lot 1, Block 1, D.M.E. Addition

The motion for the adoption of the foregoing resolution was

DESCRIPTION BEFORE DIVISION
Of Erickson Property:
Lot 1, Block 1, D.M.E. Addition; also
That part of the Northwest Quarter of Section 25, Township 118
North, Range 23, West of the 5th Principal Meridian, described
as follows: Commencing at the Northwest corner of Lot 1, Block
1, D.M.E. Addition; thence Westerly along the Westerly extension
of the North line of said Lot 1, a distance of 100 feet, to the
intersection with a line drawn parallel with and distant 100 feet
West of the West line of said Lot 1; thence Southerly along said
last described parallel line, a distance of 160 feet, to the
intersection with the Westerly extension of the South line of
said Lot 1; thence Easterly along said extension of the South
line of said Lot 1 to the Southwest corner of said Lot 1; thence
Northerly along the West line of said Lot 1, to the point of be-
ginning.
All according to the U.S. Government Survey thereof and plat of
record, Hennepin County, Minnesota.
Of Luby Property:
The Southeast Quarter of the Northwest Quarter, and the South
Half of the Northeast Quarter of the Northwest Quarter, all in
Section 25, Township 118, Range 23, according to the United States
Government Survey thereof, Hennepin County, Minnesota.
Except, however, (i) the North 280.5 feet of said South Half of
the Northeast Quarter of the Northwest Quarter; (ii) ghat part
thereof platted as Luby's Plateau; (iii) that part thereof platted
as D.M.E. Addition; and. (iv) that part of the Northwest Quarter
of Section 25, Township 118 North, Range 23, West of the 5th Prin-
cipal Meridian, described as follows: Commencing at the Northwest
corner of Lot 1, Block 1, D.M.E. Addition; thence Westerly along
the Westerly extension of the North line of said Lot 1, a distance
of 100 feet, to the intersection with a line drawn parallel with and

northwest corner of Lot 1, Block 1, D.M.E. Addition; thence west
on the westerly extension of the north line of said Lot 1, 65.41
feet; thence deflecting left along a tangential curve to the
left, radius 70 feet, an internal angle of 65 degrees an arc
distance of 79.41 feet; thence southwest tangent to the end of
last described curve, 74.7 feet; thence deflecting left 78 de-
grees 44 minutes and 24 seconds a distance of 172.25 feet; thence
east parallel with the south line of said Lot 1 to the east line
of said Northwest Quarter; thence north along the east line of
said Northwest Quarter to the intersection with the easterly ex-
tension of the south line of said Lot 1; thence west and north
along the south and west lines (and the easterly extension of
said south line) of said Lot 1, to the point of beginning.
