COUNCIL MINUTES MARCH 1,, 1977 CALL TO ORDER Mayor Greenberg called the regular meeting of the City Council to order at 7 :32 p.m,. on Tuesday, March 1, 1977, in the Council. Chamber of the City Hall. Present: City Manager Koski, City Attorney Martin, Assistant City Manager Biel, Planning Director Dragicevich, Parks and Recreation Director Kobett APPROVAL OF MINUTES;, Councilman. Gilbertson moved to approve the, minutes of the regular meeting held February 15, 1977, as written, seconded by Councilman.. Dennis.: and carried. At this time Mrs. Margie Calamia presented a brass plaque inscribed by the Temple City Bicentennial Committee .commemorating the flag and pole erected in Temple City Park and a copy of presentation by the Honorable John H. Rousselot into the 94th Congressional Record commending the Bicentennial Celebrations of Temple City:.`. On behalf of the City Council, Mayor Greenberg presented a plaque to Mrs. Calamia.in:.recognition of her outstanding contribution to the community as ;'.President of the Temple City Bicentennial Committee UNFINISHED BUSINESS: 6. PUBLIC HEARING: 7:3.0 p.m. PARKING /STORING OF OVERWEIGHT COMMERCIAL VEHICLES ON RESIDENTIAL PROPERTIES City Manager Koski presented background information,: stating the City Council, at their regular meeting held February 15, 1977, set public hearing for March 1, 1977, to consider an ordinance amending. the Temple City Zoning Code relating to the parking and storing of cotnmercLal vehicles on residential properties, and referred the . matter to the Planning Commission for their recommendation, Planning Commission, at their regular meeting of February 22, 1977 . reviewed the draft ordinance and suggested the City Attorney research the validity of the proposed ordinance and identify some cases where such an ordinance was tested in the courts, and it was their opinion it would be desirable to increase the weight from 3 to 4 tons appli- cable to licensed commercial vehicles parked or stored on R -zoned property. The Department of Motor Vehicles advises the total unloaded vehicle weight, with the commercial classification, must be shown on the registration card of the vehicle and for purposes of enforcement, a commercial license plate is not a good indicator of commercial activity. 1 Mayor Greenberg declared the public hearing open. In response to question from Councilman Gilbertson whether the. City can legally exempt certain types of vehicle, City Attorney Martin. Council Minutes March 1, 1977 - Page 2 stated the control would be by . gross weight of the vehicle, and if maximum weight is high enough, City need not be concerned with. exemptions, Mr. Kenneth Gillanders, 4831 Ryland Avenue, stated he felt the proposed ordinance infringes on the property owner's right to use his own property as he sees fit, and questioned why this ordinance . came about. Mr. Gillanders was advised the City has received many . complaints from citizens who are bothered by trucks being stored on residential property. There being no other person to come forward to speak, Councilman Tyrell moved to close the public hearing, seconded by Councilman Gilbertson and carried: City Attorney Martin introduced, Ordinance No 77-446 AN ORDINANCE OF THE "CITY .COUNCIL OF THE CITY OF TEMPLE CITY ADDING NEW SUBPARA- GRAPH (d) TO SECTIONS 9332(1), 9351(1) and 9361(1) OF THE TEMPLE. CITY ZONING CODE RELATING TO THE PARKING OF COMMERCIAL VEHICLES ON RESIDENTIAL PROPERTIES for first reading by title only.: Council- man .Tyrell moved to instruct the City Attorney, to revise the ordinance setting a four ton limit, and to waive further reading, seconded by Councilman Gilbertson and carried.: . SET PUBLIC. HEARING: ASSESSMENT FOR STREET .IMPROVEMENTS - CAMBURY AVENUE, 5400 BLOCK (Pursuant to Chapter 27, Streets & Highways Code) City Manager Koski presented background information, stating the City Council, at their regular meeting of October 5,'.1976, authorized the installation of two :7 ,000 lumen' lights on Cambury.. Avenue in the. 5400 block;' delays were experienced by the utility company in obtaining luminaires and the lights were not installed and energized until February 11,`'.1977. In accordance with Council policy established in July of 1976, the cost of the installation divided equally among the 7 property owners in the block. Councilman Gilbertson moved to accept the installation of two 7,000 lumen lights on the 5400 block of Cambury and set public hearing March 15, 1977 to approve assessments and instruct the Superintendent of Streets to so notify the property owners, seconded by Councilman Tyrell and carried: NEW BUSINESS; 8. RECOMMENDATION FROM 'PARKING COMMISSION = Meeting of February 16, 19.77 . RENEWAL OF AGREEMENT - PERMIT TO CROSS OVER PEDESTRIAN MALL #3, LOT #5, PARKING. DISTRICT #3,`A. W. Driver, 9611 Las Tunas Drive City Manager Koski advised the Parking `Commission . reviewed the conditions established by the City Council relative to an agreement permitting Mr. A. W. Driver, 9611 Las Tunas Drive, to cross over the pedestrian mall located behind the building at subject address, and concurred that Mr. Driver had met conditions as set forth in the . agreement and recommended the permit be renewed for a one year period. Councilman Gilbertson moved to renew agreement to cross over Pedestrian Mall #3, ...subject to .conditions as set forth by City Council in agree- ment dated March 8, 1972, . seconded by Councilman Dennis and carried. 9: RECOMMENDATION FROM PARKS & RECREATION COMMISSION - Meeting of February 16, 1977: REQUEST FOR USE OF FACILITIES AT LIVE OAK PARK - LINCOLN TRAINING CENTER City Manager Koski presented background information, stating the Parks and Recreation Commission approved a request'from.the Lincoln Training Center to conduct a Social Dance and Party in the auditorium at Live Oak Park on Friday, April 15, 1977, 7 p.m. to 9:30 p.m. for the members of the Training Center subject to the conditions of park use and recommended to City Council their application: be approved on a fee - free basis. Councilman Merritt moved to approve request for use of the auditorium at Live Oak Park Friday, April 15, 1977 from 7 p.m. to 9:30 p.m. by 1 Council Minutes., March 1, 1977 - Page 3 the Lincoln Training Center with the additional conditions 1 through 3 set forth in memo dated February 17, 1977 and on file in the'City: Clerk's office, seconded by Councilman Gilbertson and carried. 10. RESOLUTION NO. 77- 1611: EMPLOYMENT OF PERSONNEL Councilman Tyrell moved to adopt Resolution No 77-1611 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING. PERSONNEL, seconded by Councilman Dennis and carried. 11. RESOLUTION NO. 77-1612: WARRANTS & DEMANDS, DEMAND NOS:. 6 -12 THRU 6152 IN THE AMOUNT OF $100,856.72 Councilman Merritt moved to adopt Resolution No 77 -1612 A RESOLUTION OF THE CITY COUNCIL: OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS :IN THE SUM OF $100,856.72, DEMAND NOS. 6012` THRU .6152, seconded by Councilman Gilbertson and carried: 12. COMMUNICATIONS; A. Supervisor Hayes re Watson Moratorium On motion by Councilman Tyrell, seconded by Councilman Gilbertson and carried, Council received and filed a communication from Super- visor Hayes concerning the Watson moratorium on reassessment of residential property in Los Angeles County. B. Supervisor Hahn re: Mission Canyon Landfill City Manager Koski presented communication from Supervisor Hahn:` requesting Council's support of the County Sanitation District's . appeal to the. City of Los Angeles Planning Commission denial for conditional use perjnit to use Mission Canyon Landfill. It was the consensus of : the ;Council. that more information would be required to take a stand on the issue, and on motion by Councilman Tyrell, seconded by Councilman Dennis. and carried, Council received and filed;,; 13 TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Mrs. Marianne Milch, Temple City Chamber of Commerce, stated the Chamber was very pleased with this year's festival and the, committee should have a report within a week.:. The Chamber luncheon meeting to be held March 9 will feature Marvin Stephens of the Metropolitan Water District., Also the legislative committee is very concerned with some of the proposed legislation which will affect businesses and they are working toward putting together a forum for the public to make everyone aware of the issues. RECESS TO CRA: The City Council recessed at 8:05 p.m. to meet, as the. Community Redevelopment Agency, all members being present; approved the minutes of the regular meetin€ held February 15, °1977;approved wall signs for Clark Drugs; accepted the work performed under Contract No 5 and authorized payment; approved Second Modification to Construction, Operation. and Reciprocal Easement Agreement and Third Amendment to Option, Maintenance and Management Agreement, Covenants, and requested City Council to approve Second Amendment to Agree- ment for Operation and Maintenance of Parking Facilities; authorized payment, to Coldwell Banker pursuant to the Commission Agreement; and adopted reso- lution approving warrants and demands. The minutes are set forth in full in the record of the Agency. RECONVENE AS CITY COUNCIL: 14. ACTION ON REQUEST BY CRA: A. RESOLUTION NO. 77 -1613 Pursuant to request of the Community Redevelopment;Agency, Councilman.. Tyrell moved to adopt Resolution No. 77 -1613 A RESOLUTION OF THE CITY ouncil Minutes, March 1, 1977 - Page 4 COUNCIL OF THE CITY OF TEMPLE CITY APPROVING AND AUTHORIZING THE EXECUTION OF SECOND AMENDMENT TO AGREEMENT FOR OPERATION AND MAINTENANCE OF PARKING FACILITIES, seconded by Councilman Dennis and carried. 15. MATTERS FROM CITY OFFICIALS: A. SCAG Request t� ,Adopt Resolution of Support re: Public Works , .Employment Act On Motion by Councilman Tyrell, seconded by Councilman Gilbertson, and carried. „Council received and filed a report from Southern California Association of Governments on the Public Works Employ- ment Act, requesting a resolution supporting their findings . B. Councilman Tyrell moved to support AB 333 providing for creation of new counties in Los Angeles County, seconded by Councilman - Gilbertson and carried. C. Councilman Gilbertson advised the San Gabriel Valley Association of Cities have approved a City Managers' Division of the organization and implementation is now proceedings. Councilman Gilbertson also directed Council's attention to Health. Systems Agency for Los Angeles 'County,. A representative of the association gave a report to the San Gabriel Valley Association of . . • • • Cities. The HSA has the responsibility of approving federal health care programs with a governing body of 30; of the 30, 16 will be users ofs,public health services and 14 will be affiliated with pro- viding health serviceS. To vote for members of the governing body will require going through a registration process which requires you to state your nationality, income level, etc. Councilman Gilbertson has discussed the legality of the HSA with Congressman Rousselot and Senator Richardson. Councilman Gilbertson also directed Council's attention to material in circulate regarding Los Angeles County's proposal for paramedic funding. Councilman Gilbertson further advised the Los Angeles Economy and Efficiency Commission made a strong recommendation to the Board of Supervisors to eliminate prevailing wage clause and step schedule for county employees'; the 'Board of Supervisors has agreed to put the elimination of prevailing wage clause on the ballot in 1978. D. Councilman Merritt stated he had an opportunity to speak to Supervisor Schabarum when he attended the Camellia Festival and express Council's concern regarding county zoning standards in areas which are in Temple City sphere of influence. 16. ADJOURNMENT On motion by Councilman. Tyrell, seconded by Councilman. Gilbertson and carried, meeting adjourned at 8:32 p.m. Next regular meeting of the City Council will be held Tuesday-, March 15, 1977, 7:30 p.m. in the Council Chamber of the City Hall.
