A RESOLUTION OF THE CITY OF MCCALL, IDAHO, REGARDING A SETTLEMENT
AGREEMENT FOR THE PROPOSED SPRING MOUNTAIN MEADOWS SUBDIVISION.
WHEREAS, on January 11, 2005 the McCall Planning & Zoning Commission approved the
preliminary plat for the Spring Mountain Meadows Subdivision (SUB-05-2); and
WHEREAS, on May 26, 2005 the McCall Planning & Zoning Commission adopted findings and
conclusions related to that approval; and
WHEREAS, on August 2, 2005 the McCall Planning & Zoning Commission recommended
approval of the final plat for Spring Mountain Meadows Subdivision to the McCall City Council;
and
WHEREAS, on August 10, 2005 the recommendation of the McCall Planning & Zoning
Commission was appealed to the McCall City Council by Lloyd Hess, a resident on Cedar Lane
in the Spring Mountain Ranch PUD; and
WHEREAS, on August 11, 2005 the recommendation of the McCall Planning & Zoning
Commission was appealed to City Council by Rand Spiwak and Donn Park, also residents on
Cedar Lane; and
WHEREAS, on October 13, 2005 the McCall City Council held a public hearing on the appeals;
and
WHEREAS, on November 2, 2005 the McCall City Council denied the appeals; and
WHEREAS, the appellants subsequently filed for judicial review of the denial of the appeal by
the McCall City Council; and
WHEREAS, the appellants, the City of McCall and the applicant have reached a Settlement
Agreement that would resolve the dispute between the parties.
NOW, THEREFORE, it is resolved by the Mayor and City Council of the City of McCall,
Valley County, Idaho, as follows:
Section 1: McCall City Council authorizes the Mayor to sign the Settlement Agreement.
Section 2: McCall City Council approves the signs, monuments, barriers, roadway names
and traffic calming devices described in the Settlement Agreement, subject to
engineering review of the monuments, barriers, and traffic calming devices by the
City Engineer for safety of the said improvements and compliance with applicable
engineering standards.
Section 3: McCall City Council reaffirms the City's obligations under the Golf Course Long
Term Maintenance and Operations Agreement of December 20, 1995,

This Resolution shall take effect and be in force from and after its passage and approval.
