CITY OF MEDINA
RESOLUTION NO. go- /
RESOLUTION ACQUIRING LAND FOR PUBLIC PURPOSES
WHEREAS, Lots 8.9.10.11, Block 21 , Independence Beach, Hennepin County,
has become tax forfeit and the City of Medina's request for a private land
sale by the County of Hennepin to the City was approved by the County Board
at a cost of$500. each for Lots 8,94nd10 &2500. for Lot 11 , plus $120.00
for administrative costs for a total of $4120.00 ; and
Gerald Markey and
WHEREAS Gatheri ne Jean Ma.rkg*d on 11-26-79 offer to purchase said
real estate for $4000.00 plus administrative costs of $120.00_, did
agree to assume financial responsibility for any special assessments here-
tofore levied; and to pay the City's legal costs; and
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
as follows:

(1) There is a public purpose in acquiring Lots 8,9,10,11B1gxandependence
.Beach, Hennepin County;
(2) The City of Medina shall acquire said real estate at a cost of
$4120 and the Mayor and City Clerk are hereby authorized to execute
all documents necessary to acquire said real estate, subject to the foll-
owing conditions:
Gerald Markey and
(a)Catherine Jean Markeyall post a cash escrow with the City Clerk
in the amount of $4120.00 ; execute an agreement in a form drafted by
the City Attorney assuming liability for the Special Assessments hereto-
fore levied and to pay the City's legal cost-
(b) GThe, llgakkehall be directed to publish a notice of sale of said
lands toCa a line 5gA Oke+he terms thereof, and to request that any
person wishing to bid a higher price while meeting all of said terms and
conditions, notify the City Clerk in writing within 10 days of the pub-
lication of said notice and submit therewith a cash escrow in the amount
of$4120.00 together with a signed agreement as set forth in Sub -para-
graph (a) hereof;
(c) If any person shall so notify tr,e Clerk and submit the said
escrow and the said agreements, the said real estate shall be sold to
the highest bidder at auction, said bidders being limited to those who
have posted said cas;z escrow and said signed agreements.
