HomeMy Public PortalAboutResolution 05-24 Police Department disposal of unclaimed personal propertyRESOLUTION NO.05-24 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MCCALL, IDAHO RELATING TO UNCLAIMED PERSONAL PROPERTY ACQUIRED BY THE MCCALL POLICE DEPARTMENT; AUTHORIZING AND DIRECTING THE DISPOSAL OF UNCLAIMED PROPERTY; PROVIDING FOR RELATED MATTERS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of McCall, Idaho ("City") Police Department has taken into custody certain personal property through abandonment, impoundment, and other legal processes; and WHEREAS, such personal property has remained unclaimed for a time period which exceeds the retention limits as established under Idaho Code Section 55-403; and WHEREAS, the City Council of the City has deemed it unnecessary to retain such property specifically listed and described in Exhibit A attached hereto and by this reference incorporated herein ("unclaimed personal property"); and WHEREAS, the City Council of the City desires to dispose of the unclaimed personal property listed in Exhibit A. NOW, THEREFORE, it is hereby RESOLVED by the City Council of the City of McCall, Idaho as follows: Section 1: The City Council finds and declares that the City is no longer required to retain the personal property listed and described in Exhibit A. Section 2: The City Clerk is authorized and directed to conduct a sealed bid auction for the purposes of selling the surplus property to the highest bidder for cash at public sale after public notice. Section 3: The City Clerk and/or City Manager are authorized to donate or otherwise dispose of any item of surplus property if the bids on the surplus property are not in the best interest of the City, if no bids are received, or in the event that surplus property has no saleable value because of condition, obsolescence, or if the surplus property is inappropriate for use by the public. Section 4: This Resolution shall take effect and be in force immediately upon its passage and approval.
