HomeMy Public PortalAbout1980-08PP - Member bi `C /am its adoption: e/3 s' introduced the following resolution and requested CITY OF MEDINNA d RESOLUTION NO. 0 g RESOLUTION ACQUIRING LAND FOR PUBLIC PURPOSES WHEREAS, Lots 1,2 & 16 , Block 24 , Independence Beach, Hennepin County, has become tax forfeit and the City of Medina's request for a private land sale by the County of Hennepin to the City was approved by the County Board at a cost of $500. eachfor Lot 1 and 2 & 16 for Lot , plus$45.00 for administrative costs for a total of 1545.00 ; and WHEREAS,Robert Derus did on September 19,1979ffer to purchase said real estate for $1500. plus administrative costs of $45.00 ; did agree to assume financial responsibility for any special assessments here- tofore levied; and to pay the City's legal costs; and NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, as follows: (1) There is a public purpose in acquiringLots 1,2,16, B1.24 Independence Beach, Hennepin County; (2) The City of Medina shall acquire said real estate at a cost of $15 5• and the Mayor and City Clerk are hereby authorized to execute all documents necessary to acquire said real estate, subject to the foll- owing conditions: (a) Robert Derus shall post a cash escrow with the City Clerk in the amount of $1545.00 ; execute an agreement in a form drafted by the City Attorney assuming liability for the SKecial Assessments hereto- fore levied and to pay the City' s legal (_ o.•t -; (b) The Clerk shall be directed to publish a notice of sale of said lands to Robert Derus and the terms thereof, and to request that any person wishing to bid a higher price while meeting all of said terms and conditions, notify the City Clerk in writing within 10 days of the pub- lication of said notice and submit therewith a cash escrow in the amount of $1545•00 together with a signed agreement as set forth in Sub -para- graph (a) hereof; (c) If any person shall so notify the Clerk and submit the said escrow and the said ,agreements, the said real estate shall be sold to the highest bidder at auction, said bidders being limited to those who have posted said cash escrow and said signed agreements.
