HomeMy Public PortalAbout2004-19 - AMENDMENT - ZONING MAPORDINANCE NO. 2004 -_* AN ORDINANCE AMENDING TILE GREENCASTLE PLANNING • AND ZONING ORDINANCE BY AMENDING THE ZONING MAP WHEREAS, the Plan Commission of the City of Greencastle, pursuant to the Application of John F. Cunningham, has prepared this Ordinance to amend the Greencastle Planning and Zoning Ordinance by amending the zoning map; and WHEREAS, the Greencastle Plan Commission has reported that it held a public hearing concerning this ordinance on June 28, 2004, after timely notice of the hearing was given by publication in the Banner - Graphic Greencastle, Indiana on June 18, 2004; and WHEREAS, the Greencastle Plan Commission has reported that it paid reasonable regard to the following factors enumerated in I.C. 36 -7-4 -603 in consideration of the ordinance and determination of a recommendation to be made to the Common Council: 1, the Comprehensive Plan; 2, current conditions and the character of current structures and uses in each district; 3. the most desirable use for which the land in each district is adapted; 4. the conservation of property values throughout the jurisdiction; and 5. responsible growth and development; and WHEREAS, the Greencastle Plan Commission has certified this Ordinance to the Common Council with a recommendation by a majority vote in favor of adoption; and ® WHEREAS, the Common Council has considered the recommendation of the Greencastle Plan Commission and has paid reasonable regard to the factor enumerated in I.C. 36 -74-603 before acting on this Ordinance; and WHEREAS, the Common Council has determined that this Ordinance should be adopted without amendment as certified by the Greencastle Plan Commission. NOW THEREFORE be it ordained and adopted by the Common Council of the City of Greencastle, Indiana, that: The City of Greencastle Zoning Map of the City of Greencastle Code, is hereby amended by changing the zoning classification for the following described real estate from SDI to GB in accordance with I.C. 36 -7-4 -614: Lot Numbers I and 2 in Maplecrest Subdivision an addition to the City of Greencastle, as perplat thereof recorded in Plat Book S, Part 1, page 24, in the office of the Recorder of Putnam County, Indiana. Commonly known as 829 E. Washington Street, Greencastle, Indiana (Maplecrest Subdivision Lots 1 and 2). This ordinance shall have full force and effect upon passage. The Applicant, Mr. John F. Cunningham of Frankfort, IN owns the entirety of Albin's Subdivision to the west of the subject lots, and would like to incorporate these parcels into the Master Plan of his proposed retail development that will be coming to the City in the near future. Whether these proposed re -zoned lots will be used for parking, buffer or improvements is unknown at this time. Mr. Cunningham appeared with his representative to the Planning Commission David Masten, Engineer Ron Smith, Builder Stan Smith, Architect George Brunner and Surveyor John Phillips (the last four were primarily here for the next item on the agenda, site plan evaluation of this property and the rest of Mr. Cunningham's property). Mr. O Cunningham stated that the acquisition and rezoning of this property will square up the southeastern end of the property to allow for more parking or buffer. Glen has concerns about the sanitary sewer that runs on the Raders western property line and also Wilma's western property line. It was decided that that would be addressed in site plan review.
