RESOLUTION NO. J 0 410.
RESOLUTION AMENDING RESOLUTION NO. 79-22 ACCEPTING THE THEIS
DIVISION/CONSOLIDATION
WHEREAS, on May 15, 1979, the Council of the City of
Medina approved the consolidation of Lots 5, 6 and 7, Block 9,
Independence Beach, Hennepin County, and the division thereof
into parcels 1 and 2 under Medina Ordinance No. 159, which
resolution assigned existing special assessments for public
improvements, fifty (50%) per cent thereof to parcel 1, and
fifty (50%) per cent thereof to parcel 2; and
WHEREAS, due to the location and depth of peat deposits
on the property it becomes necessary to adjust the boundary
line between parcel 1 and parcel 2 in order to make the lot
usable for single family dwelling purposes;
NOW, THEREFORE, Be It Resolved by the City Council of
the City of Medina, that parcel 1 which is legally described
as follows:
Parcel 1: Lot 5, and the Westerly 30
feet of Lot 6, said Westerly 30 feet
measured parallel to and 30 feet Easterly
of the boundary line between Lots 5 and 6,
all in Block 9, Independence Beach, Henne-
pin County.
shall be amended to the following legal description:
Parcel 1: Lot 5, and that part of Lot 6,
which lies Westerly of the following described
line: Commencing at a point on the North line
of the said Lot 6 which is 30 f_eetEast of the
Northwest corner thereof, thence Southerly on
a line parallel with the East line of the
said Lot 6, to the South line of the said
Lot 6 and there terminating, all in Block 9,
Independence Beach, Hennepin County.
Be It Further Resolved, by the City Council of the
City of Medina, that parcel 2 which is legally described
as follows:

Parcel 2: Lot 7 and Lot 6, except the
Westerly 30 feet of Lot 6, said Westerly
30 feet measured parallel to and 30 feet
Easterly of the boundary line between Lots
5 and 6, all in Block 9, Independence
Beach, Hennepin County.
shall be amended to the following legal description:
Parcel 2: Lot 7 and that part of Lot 6 lying
Easterly of the following described line:
Commencing at a point on the North line of
the said Lot 6 which is 30 feet Westerly of
the Northeast corner of the said Lot 6,
thence Southerly along a line parallel with
the East line of the said Lot 6, to the South
line of the said Lot 6 and there terminating,
all in Block 9, Independence Beach, Hennepin
County.
Be It Further Resolved that the existing special assess-
ments for public improvements shall be divided as follows:
Parcel 1: Fifty (50%) per cent thereof;
Parcel 2: Fifty (50%) per cent thereof.
Provided further that the applicant shall pay an ad-
ministratj_ve fee to the City of Medina in the amount of
$ •50
Provided further that the applicant shall obtain a
land division/consolidation for taxing purposes from the
Hennepin County Finance Department consistent herewith.
