On July 31 , 2012, Caltrans notified the City that the Federal Highway Administ ration, with issuance of the E-76 document, approved the Project to proceed into the construction phase. 3 . On August 17, August 22 , August 24 , and August 29, 2012 , the bid notice was published in the San Gabriel Valley Tribune, Pasadena Star News , and Temple City Highlander i nforming potential bidders of the Project. Van ir Constr uction Management also began active ly marketing the Project to approp r iately l icensed contractors and subcontractors v ia telephone, fax, and email. 4 . On October 4 , 2012 , five bids were received and opened . 5 . On October 6, 2012, the City Council approved a budget amendment of $1 ,945,065 .00 for the Project increasing the construction budget from $12 ,707,579.00 to $14,652 ,644 .00 . 6 . On October 16,2012, the City Counci l rejected the bids opened on October4, 2012, because the two responsive b idde rs (Griffith Company and Exce l Paving) were over budget , and authorized staff to rebid the Project. 7. On October 19, October 23 , and October 29 , 2012, the notice for the rebid was published in the San Gabriel Valley Tribune, Pasadena Star News , and Temple City Highlander informing potential bidders of the new bid dates for the Project. 8 . On November 6 , 2012, the City Council approved a budget amendment of $1 ,189,375.00 for the Project thereby increasing the construction budget from $14 ,652 ,644.00 to $15,842 ,019 .00 . 9 . On November 8 , 2012 , six bids were received and opened as summarized in the following table. On November 13, 2012, Griffith Company sent a letter of formal protest to the City stating that the bid from Los Angeles Engineering neither committed to the established Disadvantaged Business Enterprise (DBE) goal nor showed that a good faith effort was made to meet the DBE goal. 11. On November 14, 2012, after careful review of Los Angeles Engineering's DBE and Good Faith Effort submittals, the City's funding consultant, Avant-Garde, provided a letter stating that Los Angeles Engineering had adequately satisfied the federal Good Faith Effort requirement in lieu of meeting the DBE percentage requirement, thereby satisfying the requirements of the bidding process. 12. On November 14, 2012, after reviewing the letter provided by Griffith Company, the City Attorney recommended denial of the bid protest filed by the Griffith Company on the grounds that the apparent low bidder met the federal Good Faith Effort requirement and otherwise satisfied the requirements of the bidding process. 13 . On Novembe r 20, 2012, a contract was awarded to Los Angeles Engineering in the amount of $15,773 ,914.50 . 14. On January 24, 2013, construction of the Project commenced . Throughout the construction process , meetings were held with the Rosemead Boulevard Standing Committee to review the progress of the Project. 15. On May 10, 2014, the Rosemead Boulevard Grand Opening event was held, which served as the symbolic completion of the Project. Accordingly, staff and Los Angeles Eng ineering agreed to a substantial completion date of May 11, 2014 for the purposes of accepting the Project. 16. On October 24 , 2014, the Rosemead Boulevard Standing Committee reviewed the Project and recommended the acceptance of the Project. ANALYSIS : Since Rosemead Boulevard was relinquished from state control to City jurisdiction in March 2008, the City has eagerly sought to improve the safety, the multi-modal facilities , and access to businesses along Rosemead Boulevard . After a thorough design process that began in December 2010, the final plans and specifications were expedited through federa l and local agency approvals in early 2012. The Project is a safety enhancement and beautification project that established consistency along the entire length of Rosemead Boulevard (approximately two miles) from Call ita Street on the north end to the south side of the Union Pacific railroad tracks on the south end. The Project includes the following improvements: City Council December 16, 2014 Page 4 of 5 • Bicycle facilities ; • Sidewalk, curb, and gutter; • Accessibility improvements; • New traffic signals and upgrades of existing signals; • Rubberized pavement; • Raised, irrigated, and landscaped roadway medians; • Trees and landscaping; • Bus pads, street lighting, street furnishings, decorative planters, entry monuments, signage, and striping; and • Transit-stop improvements and seating nodes. Imp leme ntatio n of the Project improved the safety and appearance of Rosemead Boulevard between the north and south city limits, transforming Temple City's segment of Rosemead Boulevard from a regional hig hway into a multi-modal corridor. The Project enhanced vehicular circulation on Rosemead Boulevard through changes to some of the turning movement patterns, approach la ne changes, and signal control changes at several intersectio ns along the corridor. The Project enhanced pedestrian, bicycle, and public transit circulation of Rosemead Boulevard thro ugh the provision of new sidewalks, transit stop improvements, bicycle facilities, and other pedestrian and bicycle amenities. The provision for new trees and other landscaping along sidewalks and within new medians, new street lighting, street furnishings, decorative planters, reta ining walls, entry monuments, and signage enhance the appearance of Rosemead Boulevard by providing consistent visual elements along the length of the boulevard. CONCLUSION: The Project transfo rmed Rosemead Boulevard to a safe, attractive, and comfortably accessed street for travel by all users, including pedestrians, bicyclists , motorists, and public transit users of all ages and abilities. The contract amount awarded to Lo s Angeles Engineering, Inc. is $15,773,914 .50. The final construction cost is $15,537,122.70, which is $236,791.80 below the awarded contract amount. The cost savings were the result of field adjustments for more cost efficient implementation of various work items and alternatives, which were discussed with the Standing Committee at regular meetings throughout the project. The contractor's final invoice is attached as Attachment "A". City Council December 16, 2014 Page 5 of 5 FISCAL IMPACT: The Project funds are in City's approved budget for CIP POS-11. There is no impact on the Fiscal Year 2014-15 budget related to completion and acceptance of the construction of the Project. ATTACHMENT: A.
