ATTEST: Village Clerk September 28,1976 October 26, 1976 The Council of Bal Harbour Village met Tuesday, October 26, 19?i at 9:55 A.M. in the Village Hall. Present: Messrs. Beatty, Davis, Logan, Printup and Taplin Also present were Fred W. Maley, Village Manager; Mary T. Letterer, Village Clerk; and Alan Gold, Village Attorney. On motion of Mr. Davis, seconded by Mr. Beatty and voted, the minutes of the previous meeting of September 28, 1976 were approved as submitted. Presentation of credentials by landscape architects interested in the ocean -front beach landscaping project were made by Mr. Fred Stresau. of Stresau, Smith and Stresau; Mr. Richard Dickinson of Edward D. Stone, Jr. and Associates; and Mr. Douglas Ruth, of Douglas M. Ruth and Associates. Mr. Taplin arrived at the meeting at 10:10 A.M. prior to Mr. Ruth's presentation. Mr. Maley said he would like to inspect some of the local projects done by the above firms and make a recommendation at the November 30th meeting. Bids were opened for the landscaping and concrete work on West Bal Harbour Boulevard and 96th Street as follows: Landscaping - Custom Land- scaping Co., $14,719.00; Sinclair Landscape Nursery, Inc., $11,132.00; Melrose Nursery, $16,788.00: Art Landscape Co., $16,458.50; Russell, Inc., $6,950.00; Griffin Brothers Co., Inc., $13,415.00; J.D. Thornton Landscaping, $14,126,70. Mr. Maley said he would like to review the bids with Mr. Douglas Ruth, the landscape architect for the work, and award the contract to the lowest responsible bidder. Bids for the concrete work were submitted by Clifton Lightsey, Inc,, $16,436.00 and HMC Engineering Contractors, Inc., $20,000.00. On motion of Mr. Davis, seconded by Mr. Taplin, and voted, the concrete work was awarded to Clifton Lightsey, Inc, and Mr. Maley was authorized to award the landscape contract. Zti4 Mr. Ed. Eicher of the Resort Association introduced the members present and said that after interviewing seven firms, during which time some of the Council and the Manager were present, that they would like to recommend that the Village hire the firm of McColloch, Bryan and Cipriano Inc. to handle the promotions and advertising in the Tourism Department, also that a liaison person be hired to work in the Village Hall and handle the present promotions. It was moved by Mr. Davis, seconded by Mr. Beatty and voted that the Committee's recommendation be accepted. Mr. Stanley Whitman appeared to request a variance to construct two, five by ten foot entrance signs in the right-of-way between the side- walk and 96th Street to indicate the new entrance to the Bal Harbour Shops. It was suggested that Mr. Whitman might have cardboard signs of a like size erected so they could be viewed as to traffic and pedeStrain hazzards. Mr. Willie Beckham and Mr. Maley discussed the Comprehensive General Liability Insurance for the Village. It was suggested that the possibility of self -insuring be investigated and in the meantime we have a binder with U.S. Fidelity and Guaranty Company. After discussion, Mr. Printup said he would contact the owners -of the Bal Harbour 101 property to see if they would contact their attorneyland arrange to have the contempt of court order against some of the Council voided. It was the Council's decision that the payment due Shutts and Bowen would still be withheld. Mr. Gold told the Council that during the hearing before Judge Popper to enjoin the City of North Miami Beach from shutting off our water, which was granted, the Judge was concerned about monies not being escrowed against the amounts paid by Sal Harbour under the contract and the billed amount. Judge Popper ordered that the Village escrow the difference as of October 5, 1976 until the final hearing. In reference to the City of Miami Beach, Mr. Gold said that the attorneys were having a hearing today on the retroactive rates set by Miami Beach for the period of October 1, 1972 to October 1, 1975. Mr. Logan arrived at the meeting at 11:30 A.M. Mr. Gold said that he would like the authority to challenge the Miami Beach decision on the retroactive rates to keep them from calling the escrow. It was moved by Mr. Taplin, seconded by Mr. Beatty and voted to give Mr. Gold the authority to proceed. ORDINANCE No. 191 setting the new water rate at 850 per thousand gallons to conform with Judge Popper's order was read by the Village Clerk. On motion of Mr. Beatty, seconded by Mr. Taplin and voted the ordinance was passed as an emergency ordinance. Mr. Davis left the meeting at 11:50 A.M. after the previous vote. October 26, 1976 11 Lb0 The Village Clerk said that applications had been filed for the available taxi permits by the two firms now operating in the Village. On motion of Mr. Beatty, seconded by Mr. Taplin and voted AAA Auto Leasing d/b/a White Cab was granted 15 permits and Zilber Taxi Cab Service d/b/a Morse Taxi and Baggage Transfer was granted 31 permits. Mr. Maley reported that funds are being made available to municipalities under the Public Works Employment Act to combat unemployment. It was the decision of the Council that we should file the Statement of Assurance in case we wished to avail the Village of these funds. mr. Maley told the Council that Surfside had unilaterly reduced the budget of the library which action Bay Harbor Islands and we do not agree with. He said that he had asked our Library Board to speak for the Village. Alan Gold was asked to check our library agreement with Surfside inasmuch as Surfside had passed a Resolution stating that as of April 1, 1977 the costs of the library would be borne equally by the three towns. The Council discussed the status of the proposal for Bay Harbor, Bal Harbour and Surfside obtaining water from Dade County. It was agreed that a preliminary engineering study should be made and that we would be willing to pay half the cost of such a study if Surfside will not contribute to it. There being no further business on motion of Mr. Logan, seconded by Mr. Beatty, the meeting was adjourned at 12:15 P.M.
