HomeMy Public PortalAbout1980-22CITY OF MEDIN RESOLUTION NO. h0-v3Z, RESOLUTION AUTHORIZING SET -BACK VARIANCES FOR CONDiOMINIUMS ON THE DOCKSIDE PROPERTY. WHEREAS, the owner Mr. John Spaeth has requested several set -back variances in order to construct Low-rise and Town -House Condominium :Dwelling Units, including remodeling of the existing Inn which is located on property bounded by Lake Inde- pendence, Co. Rd. 19, Lakeshore Avenue and Baker Park. . WHEREAS, the site is irregular in shape, too narrow at the south end to meet city set -back requirements and the present structure is in violation of set -back requirements. WHEREAS, the following facts have a bearing on this resolution. 1. Variances for set -backs are common to the Independence Beach area due to irregular shaped lots. 2. The Zoning Code permits 11 dwelling units in a R-2 (Multi -Family District) and that district permits 50' front yards, 10' side yards, and 2 % of lot depth, but not less than 40' or greater than 75' for rear yards. 5. The City policy for lake shore is 75' but is not addressed in the Zoning Ordinance or mandated by The Dept. of Natural Resources. 4. The City doesn't have right of way for the south of Lakeshore Avenue and snow and drainage easements should be obtained. 5. There are only seven sewer assessments applied to the property, but the City would like more use to solve a flow problem. 6. On -Street parking is non existant. 7. Eleven apartment units will generate more taxes than will the present facility. 8. The hard surface area will not exceed the present use. THEREFORE, be it resolved by the City Council of the City of Medina. 1. The City will permit set -back variances due to physical limitations of the site if the following items are complied with: A. Ability to obtain rezoning to a Multi -Family District. B. Give the City a 20' right-of-way from the center of Lakeshore Ave. C. That the fence meet the City Fence Ordinance including the 45° angle starting 70' from the intersection of the new right-of-way. D. That only density as permitted by Ordinance, not to exceed 12 units are erected and that no structure exceed 2 stories in height. E. That the extra sewer assessments and permits be obtained.
