soil and sedimentation,wetlands,marshlands protection and shore protection ordinances and codes whether local,state or federal,including
all environmental laws and regulations when applicable,subsequent owners should be informed that any alterations to the property must be
approved by the issuance of another building permit. Permit holder agrees to hold the City of Tybee Island harmless on any construction
covered by this permit.
This permit must be posted in a conspicuous location in the front of building and protected from the weather. If this permit is not posted
work will be stopped. The building contractor will replace curb paving and gutter broken during construction. This permit will be voided
unless work has begun within six months of the date of issuance.

the Smith's had removed the wall's top row of block. I checked the wall on Saturday 1/19/13,the top row has been
removed.
I sent a text to Mr Cardillo advising him that I would relay the information to you. I advised Mr Cardillo that I would
also speak with Ms Anderson. I advised him that I would request that the Smith's scheduled appearance for Tues
1/22/13 be pasted or the case dismissed based on the City's ruling as to the acceptability of the Smith's actions.
Please let me know if the matter should be considered closed. I will relay your decision to Mr Cardillo.

Dear Frank:
Hopefully,this letter will suffice for our purposes and we can put the dispute to rest.
It is my understanding that the fence that runs generally in an east-west direction on the
north side of the Smith's property is to be altered by way of the removal of the top layer of
cinder block from the fence as erected. There will be no adornment, cap, or any addition above
the newly-created top level of the fence. In the event the fence is to be expanded at the same
height as the modified fence,a permit will need to be secured for the extension and a new fence
will have to be constructed, which also cannot have any adornment, cap,or other addition to the
top. Thus, the newly-constructed fence would be consistent with the existing fence after being
modified by removal of the top layer of cinder block.
Tybee will dismiss the citation,number 009666, and the issue will be put to rest.
I think this adequately resolves the matter and.I certainly hope that is the case. I am -
copying Dianne Otto and Warren Millikan in case any changes are thought to be necessary.
Please let me know if you concur.

Dianne -we can talk about this next week if that is ok.. It seems to me, clarification would help as to the
remainder of the fence & how high it is to be . That is, the height should not exceed the current fence as
modified by removal of the layer of block. Also, I am not sure this should be more than a memorandum of
understanding or something since all contracts of the city have to go to mayor & council,etc... I can probably
work that problem out with Frank though I would think

Back in June, Hodad cited Don Smith for a fence/wall that is too tall at 108 Jones Avenue. Smith's attorney is
Frank Cardillo. Judge Sheer was to finally hear the case on October 23rd, but I met with Cardillo before the
case was called. That discussion ultimately led to the attached Agreement being prepared by Cardillo. It
contains some information I cannot substantiate and other things I am not comfortable with. The intent is
agreeable - if the top course of blocks are removed from the wall, we are done with this. The next scheduled
court date is January 22nd. What would you advise at this point so we can get this wrapped up?

AGREEMENT
On or about October 12, 2006,the Smith's (homeowners)did apply for a permit to build a cinder
block fence along the northern border of their property line located at 108 Jones Ave., Tybee
Island, Georgia. On October 12, 2006, the City of Tybee Island did issue a permit for the
construction of the aforementioned fence. (Permit#06-0544)
o. The fence w.. co ructed in October 2006. Subsequently, in March 2010, representatives from
ti,5 oo, the City of Ty 1;e Island, including Jonathan Lynn, Chuck Bargeron, Downer Davis, and Nelson
So Kimmer, me Is.th the Smith's at 108 Jones Ave., Tybee Island,to review the fence in question.
At the co • usio of said meeting the fence was deemed compliant with the permit(#06-0544).
Subsequently, on or about June 20, 2012, the City of Tybee Island, and the Tybee Island Police
Department did issue a citation(citation#009666)to Don Smith(homeowner)with regard to the
same fence, which was previously permitted on October 12, 2006. The citation alleged that the
fence that was previously erected was in excess of the city's eight(8) foot height limitation. The
Smith's (homeowners) disputed this claim and asserted that the fence was within the eight(8)
foot height requirement.
After extensive discussion between the City of Tybee Island,the Tybee Island Police
Department, and the Smith's (homeowners), all parties have agreed to fa ..resolve this
dispute/controversy as follows:
-The Smith's (homeowners) agree to take off one (1) layer of cinder block from top of the fence
as erected. The Smiths (homeowners) further agree not to add any adornment or cap, etc.,to the
top of the fence which would add any height to the fence as it exists.
- The City of Tybee Island agrees.that upon the removal of the one(1)top layer of cinder block
from the existing fence,the fence will be in compliance with the city code and this matter will
fo r be resolved.;rd

Nothing in this agreement shall limit the smiths(homeowners)right to subsequently complete

a. I normally feel that I understand the purpose of a grading plan. In this case I do not. I offer
that only as a comment as my understanding of the purpose of the grading plan is not a permit
requirement.
b. If the grading results in preserving the existing grading pattern with the low area remaining
low and grading is confined to that area, then I will not require further detail of BMP's at this
time.
2) Filling against the concrete block wall along the north side lot line is not shown. My finding of this plan to
be acceptable is not concurrence for fill to be placed against the concrete wall on or near the north side lot line.
This concrete wall is not shown on the site plan.

This letter is to serve as a second notification of a
violation of the City of Tybee land Development Code
(LDC). As defined in Article II section 2-010 of the LDC,
the height of a privacy fence may not exceed eight (8) feet
above the average adjacent grade.
A letter from the City mailed to you on 5/1/12 advised
of the violation and requested the fence be brought into
compliance within thirty (30) days. Please be advised that
you now have fifteen (15) days to bring the fence into
compliance.
Failure to bring the fence into compliance within fifteen
(15) days could result in a citation to appear in Municipal
Court being issued.

Dear Sargent Millikan:
Don Smith has contacted me with regard to the correspondence he received from you on
or about May 1, 2012, with reference to the fence located on his family property located at 108
Jones Avenue. The fence you are referencing was previously permitted on October 12, 2006, as
you can see by the enclosed building permit. This permit was signed off by Diane Otto. The
fence was constructed in 2006 due in part to problems that the Smith's had with Sundae Café
employees continuously dumping trash on the Smith's property. The Smith's had complained
about the trash being dumped on their property all the way back to 2005.
Again, pursuant to Permit#06-0544, dated October 12, 2006,the fence was constructed.
Subsequently, in March of 2010, representatives from the City of Tybee Island met at 108 Jones
Avenue to review the fence in question. The Smith's (Mark, Tom and Don)were at this meeting
on the property along with Jonathan Lynn, City Marshall Chuck Bargeron, Tybee Island City
Engineer Downer Davis and Nelson Kimmer representing Hussy, Gay, Bell and DeYoung
Engineering. All parties were at the site and the fence in question was deemed to be compliant
with the permit previously issued on October 12, 2006. Further,the City of Tybee
representatives indicated that if the Smith's wanted they could continue the fence down the
existing property line.
In your recent correspondence, you attach a survey which was evidently prepared by Bart
Barrett indicating that a survey of 301 and 303 First Street was taken. Though the survey
appears to reference the back fence in question, it is not a survey of the property located at 108
Jones Avenue. Therefore, the survey in questions cannot be deemed accurate for 108 Jones
Avenue.
Further, as you are aware,the Smith's have been Tybee Island homeowners and
taxpayers for over a hundred years. During the past six or seven years,the problems that arose

documentation from 2006 indicating that Sundae Café previously was allowing run off water and
litter to be deposited on the 108 Jones Avenue property along with trash and grease consistently
spilling onto the Smith's property. The present attempt to claim that a fence that was previously
permitted in 2006 and revisited in 2010 appears to be a clear case of harassment. Again, I
reiterate Tybee Island previously permitted the fence in question and addressed the issue through
Jonathan Lynn, Chuck Bargeron and Downer Davis in 2010, who found that the fence was fully
in compliance. Based upon the recent correspondence, the Smith's are beginning to incur
attorney's fees to address an issue that has previously been decided.
As always, myself and the Smith's are available to meet and discuss the situation further
but it appears clear that this matter was put to rest by the issuance of the original permit in 2006
and the subsequent inspection in 2010.

As per our telephone conversation of 5/1/12 @ 0930,
this letter is to serve as notification of a violation of the
City of Tybee Land Development Code (LDC). As defined
in Article II section 2-010 of the LDC, the height of a
privacy fence may not exceed eight (8) feet above the
average adjacent grade.
The privacy fence erected at your property (108 Jones
Avenue) has been determined to be nine (9) feet in height.
This determination has been based on a survey prepared by
Land Surveyor Bert Barrett Jr. on 8/10/11 . As per your
request, I have enclosed a copy of Mr Barrett's survey.
The City of Tybee requires the privacy fence at 108
Jones Avenue been brought into compliance within thirty
(30) days of receipt of this notification. Failure to bring the
privacy fence into compliance within thirty (30) days could
result in a citation to appear in Municipal Court being
issued.

The undersigned hereby acknowledges that the issuance of this permit does not in any way grant
permission to the owner, owner's representative, or permit holder to proceed with demolition,
wrecking, or renovation of a structure prior to the filing of any required ten (10) day "Project
Notification for Asbestos Renovation Encapsulation or Demolition" form in accordance with
the Georgia Asbestos Rules. The Georgia Environmental Protection Division administers the
rules. In most cases, the rules require both the owner and the involved contractors to assure the
portion of the building involved in the project is thoroughly inspected by an Accredited Asbestos
Inspector for materials that contain asbestos; and the removal of the asbestos before renovation,
wrecking, or demolition begins almost without exemption. Georgia EPD requires a completed
demolition notification from be submitted 10 workings days in advance even if no asbestos is
present in the building. Further guidance for regulatory compliance and contact telephone

the Chu's shopping plaza. I spoke with the owners of Sundae's Deli and they have agreed to clean up the trash
and grease that have spilled onto your property. As per your request, I informed them that you had given your
permission for them to come onto your property to conduct this clean up. The owners assured me that they
would make every effort to clean up the grease and trash today and strive to prevent it from occurring in the
future. Please let me know if said clean up is done in a timely and satisfactory manner. Enclosed are copies of
the photos taken at the site depicting the grease and trash. Do not hesitate to contact me if you have any further
