A. COUNTY DISTRICT ATTORNEY AND AUTHORIZING THE CITY I MANAGER TO ENTER INTO AGREEMENT WITH THE L. A. COUNTY DISTRICT ATTORNEY; AUTHORIZING THE CITY MANAGER TO ESTABLISH ~ A JUVENILE CRIME j ENFORCEMENT COALITION AND AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO MAKE THE NECESSARY FUND APPROPRIATIONS AND TRANSFERS. i WHEREAS, The 1998 Congress authorized the Federal Juvenile Accountability Incentive Block Grant Program (JAIBG); and ~j WHEREAS, This program was created to promote greater accountability of ~ •, juveniles in the justice system and hold juvenile offenders accountable for their criminal f ; activities; and ii WHEREAS, Funds are being made available on a formula basis and the amount available to the City of Lynwood is $24,485; and ~ f . WHEREAS, tlue to time .constraints, the City is unable to meet the grant .requirements in establishing a Juvenile Crime Enforcement Coalition and Coordinated Enforcement plan; and ! j r WHEREAS, . in order not to lose the grant funds the City can enter into an ~ I agreement with the Los Angeles County District Attorney's Office to create a program that will reduce juvenile delinquency; and + ! ' WHEREAS, the City of Lynwood needs to decline to directly accept funds made available through the Juvenile Accountability Incentive Block Grant (JAIBG) Program administered by the Office of Criminal Justice Planning (hereafter referred to as OCJP); and' WHEREAS, a fund appropriation and transfer is needed to cover the ten (10) percent city match. ; NOW, THEREFORE, the City Council of the City of Lynwood does hereby find, proclaim, order and resolve as follows: Section 1. That the City of Lynwood waives its right to its direct subgrant:'. award and authorizes the funds to be expended. by the County of Los Angeles, District ~ Attorney's Office for the mutual benefit of both units of local government. I ~' Section 2. That it is agreed that any liability arising out of the performance of',this Grant Award Agreement, including civil court actions for damages, shall be the responsibilityof the grant recipient and the authorizing agency. The State of California and OCJP disclaim r responsibility for any such liability. t r ~ i! Section 3. That the grant funds received hereunder shall not be used to supplant expenditure controlled by this body. ~' f• Section 4. That" the City Manager is authorized to establish a Juvenile Crime Enforcement Coalition. _ ~~ i Section 5. That the City Manager is authorized. to enter into an agreement with the Los Angeles County District Attorney's Office to provide for enhanced prosecution of juvenile offenders. Section 7.
