A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LYNWOOD URGING THE CALIFORNIA LEGISLATURE TO
ADOPT AB 1939 (VINCENT), AND AUTHORIZING THE
MAYOR TO SIGN A LETTER OF SUPPORT
WHEREAS, the California Integrated Waste Management Act (CIWMA),
commonly known as AB 939, mandates that all cities reduce their waste by 25% in
1995, and by 50% in 2000; and
WHEREAS, failure to meet the 50% requirement this year would result in cities
~' being subject to a $10,000 per day penalty; and
WHEREAS, Assemblyman Bob Margett (R-Arcadia) and Assemblyman Ed
Vincent (D-Inglewood) introduced AB 1939, and is designed to provide relief for all
California cities that have. to meet the diversion requirements of the CIWMB; and
WHEREAS, AB 1939 is also designed to assist cities and counties across the
state in reaching their 50% diversion goals by increasing the use of cutting-edge waste
disposal technologies and by reducing the reliance on simply counting the waste
diverted; and .
. WHEREAS, such controls, if not properly designed or maintained, could become
sources of pollution rather than pollution mitigants; and
WHEREAS, AB 1939 requires the state, when evaluating a city's waste diversion
plan; to take into account whether or not it has executed its source reduction programs.
This is intended to alleviate the sole reliance on the "counting" aspect of AB 939; and
WHEREAS, AB 1939 was formulated after input from the cities within Los
Angeles County, the County, waste management industries, and the public.
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE
CITY OF LYNWOOD, STATE OF CALIFORNIA, DOES HEREBY RESOLVE,
DECLARE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That the City Council supports AB 1939, Solid Waste Diversion
Requirement and Compliance Measurement.
SECTION 2. That the City Council authorizes the Mayor to sign a letter in
support of AB 1939.
SECTION 3. That the City Clerk is directed to send a certified copy of this
resolution to the Governor Gray Davis, the Assembly, and the Senate.
SECTION 4. That this resolution shall take effect immediately upon its adoption
PASSED; APPROVED AND ADOPTED this 4th day of Apri 1 , 2000.
