RESOLUTION APPROVING LANE DIVISION WHEREAS, James and Joan Lane have requested approval of the division of a forty (40) acre parcel of land located at 2605 Hamel Road, the legal description of which is attached hereto and made a part hereof by reference as Exhibit A; and WHEREAS, the land to be divided consists of a twelve (12) acre parcel, the legal description of which is attached hereto and made a part hereof by reference as Exhibit B; NOW, THEREFORE, Be It Resolved, by the City Council of the City of Medina that the land division is approved, subject to the following conditions: 1) lded by/ the Cft way; 2) That James and Joan Lane execute an easement for street and utility purposes to the City of Medina, said ease- ment to be effective at a future date described in the instrument, to provide documentary evidence of the right- of-way for Hamel Road and Willow Drive as they presently exist, said easement to be thirty (30) feet in width along the northerly and the easterly boundaries of the land described in Exhibit Dated: - 4 ATTEST: CLERK MAYOR The motion for the adopti of the foregoing resolution was duly seconded by member��-,) and, upon vote being taken thereon, the following voted in favor thereof: and the following voted against same: Whereupon said resolution was declared duly passed and adopted. AGREEMENT TO CONVEY STREET AND UTILITY EASEMENTS WHEREAS, James and Joan Lane are the owners of the real_ estate described in Exhibit A and attached hereto and made a part hereof by reference, hereinafter referred to as the Owners; and WHEREAS, the City of Medina has approved a division of the said real estate into two (2) parcels, pursuant to its ordinances; and WHEREAS, as a condition of said approval, the City has re- quested and the Owners have agreed to convey an easement, thirty (30) feet in width, to provide documentary evidence of the right- of-way presently occupied by Hamel Road and Willow Drive; NOW, THEREFORE, It Is Agreed between the Owners and the City of Medina as follows: 1) The Owners agree to convey easements for street and utility purposes, by,documents approved by the Owners and the Medina City Attorney, pur- suant to legal descriptions drafted by the Medina City Engineer, describing the said easements, thirty (30) feet in width, said easements to be delivered to the City of Medina upon the happening of any of the following conditions: a) Upon the sale of any portion of the land described in Exhibit A, said sale to be evidenced by ap- proval of a land division under City Ordinances or by the sale documents, such portion of the easement abutting the property sold shall be conveyed at the time the said division is approved; b) At such time as the property owners abutting Hamel Road on the North and Willow Drive on the East, in the same location as the property de- scribed in Exhibit A shall convey a similar ease- ment, the Owners shall convey a like easement; c) The said easement shall be conveyed, in any event, on or before the day of /Yl a/GC w} , 19 �''(d . �e _ In Testimony Whereof the parties have set their hands this day of /7 .,c./i , 19 8 / State of Minnesota County of Hennepin ) ss .
