HomeMy Public PortalAbout1981-007Member L u ti introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. Y/_ 7 RESOLUTION DENYING VARIANCE REQUEST FOR THE THOMAS MALIK BARN WHEREAS, Thomas Malik is one of the owners of real estate described on Exhibit A and attached hereto and made a part hereof by reference; and WHEREAS, over the past several years commencing in 1972, a building was constructed on the property which is located fifty-nine (59) feet from the property line which abuts Iroquois Drive; and WHEREAS, Mr. Malik requests approval of the present location of the building to be used as a horse barn, either by Variance or by declaration of its status as a valid non -conforming use; and WHEREAS, City records indicate that the building was con- structed for use as a garage and for the storage of personal property; NOW, THEREFORE, Be It Resolved by the City Council of the City of Medina, as follows: 1) The request for a Variance is denied because the standards for Variance set forth in the Zoning Ordinance cannot be met; 2) The request for a declaration of status as a valid non -conforming use is denied because n- er the original construction nor th- additiorized use of the building for a ma barn Dated: ATTEST: o��-�-Lee} CLERK The motion for the option of the foregoing resolution was duly seconded by member �jle i`, and, upon vote being taken thereon, the fol owing voted in favar thereof: and the following voted against same: Whereupon said resolution was declared duly passed and adopted.
