Trotter, AICP, Town Planner DATE: August 10, 2017 SUBJECT: Access permit code amendments, Chapter 14 Fraser Municipal Code and corresponding amendments to Chapter 11 Fraser Municipal Code. MATTER BEFORE BOARD: Ordinance No. 446, adopting amendments to Chapter 14 of the Fraser Municipal Code. ACTION REQUESTED/EXECUTIVE SUMMARY: Approval of the proposed amendments to the Fraser Municipal Code, Chapter 14, Design Criteria and Construction Standards, and corresponding amendments to Chapter 11, in order to delete the requirements for an access permit for driveway construction. BACKGROUND: In our continued effort to analyze the Town of Fraser regulations and reduce the regulatory barriers to development, Staff is recommending revising our regulations to delete the requirements for an access permit for driveway construction. We will retain the design criteria and construction standards for individual driveways in Sec. 14-4-50, https://library.municode.com/co/fraser/codes/municipal_code?nodeId=CH14DECRCOST_ART4 PRIN_DIV1STDRDE_S14-4-50INDRCRCT , however we will not require an access permit and surety for driveway construction. Currently, at building permit issuance, the applicant will pay a $50.00 application fee for a driveway access permit, plus $500.00 surety to ensure the driveway is constructed per plans, if a driveway is accessed from a public right-of-way (ROW). The surety gets refunded after issuance of Certificate of Occupancy. We will continue to review the driveway design on the plan set to ensure the design meets Town of Fraser construction standards, however, in the best interest of time and resources for both Staff and the applicant, we will not be issuing a permit nor collecting any fee or surety in conjunction with driveway construction. RECOMMENDATION: Staff is recommending approval of Ordinance No. 446 to incorporate the said changes into the Fraser Municipal Code.
