HomeMy Public PortalAbout2004-27 - AMENDMENT - TRAFFIC AND PARKING REGULATIONS" ORDINANCE 2004 -27 AN ORDINANCE AMENDING TRAFFIC AND PARKING REGULATIONS WHEREAS, the Common Council of the City of Greencastle wishes to update and amend certain sections of the Greencastle Code regarding traffic and parking regulations. NOW THEREFORE be it ordained by the Common Council of the City of Greencastle that it hereby amends Section 8 -20.c, to add subsection 15, to read as follows: c. No vehicle shall be stopped, stood, or parked, except when necessary to avoid conflict with other traffic or to avoid conflict with law or the directions of a police officer or traffic control device, in any of the following places: 15. In a manner such that the vehicle takes up two parking spaces NOW THEREFORE be it further ordained that Section 8 -25 of the Greencastle City Code is amended to read as follows: � a. No vehicle shall be stopped, stood, or parked upon the streets or parts of streets designated in the Schedule of Limited Parking Zones in Section 8 -26 for a continuous period of time longer that the maximum time limit specified in the schedule when notice of the limitation on standing and parking is given by signs erected adjacent to the limited parking zone. b. Officers may place chalk upon the tires of any vehicle parked in a limited parking zone to monitor the length of time the vehicle has remained in the same parking space No person may remove the chalk or move their vehicle within the same parking space in a manner to cover the chalk mark. c. If more than one (1) maximum time limit is specified for a street or part of a street in the Schedule of Limited Parking Zones in Section 8 -26 or in any other section of this Article, the maximum time limit of the least duration applies if a sign or signs have been erected giving notice of such time limit on the affected street or part of a street. d. A vehicle that is parked in violation of this section is subject to a parking violation assessment of not more than one hundred dollars ($100.00) in favor of the City C'��1 NOW THEREFORE, be it further ordained that Section 8 -55. b. and c. shall be amended to read as follows: • b. The payment that may be tendered to and accepted by the City as a settlement of a parking violation assessment shall be in the amount specified in the Schedule of Parking Violation Assessment in Section 8 -57 as the "settlement amount' for the specific violation for which a parking citation was issued. If a settlement amount or a parking violation assessment is not specified in the Schedule, the settlement amount is fifteen dollars ($15.00). c. Settlement deadlines (1) Unless otherwise stated herein, the opportunity for payment of the scheduled settlement amount for a parking violation assessment shall terminate at the end of the sixtieth day following the day of issuance of a parking citation; however, the City may accept late payment of the scheduled settlement amount. (2) For violations of Section 8 -26 of this Code regarding Limited Parking Zones, subsection c.1. above, shall apply except that the opportunity for payment of the scheduled settlement amount for a parking violation assessment of fifteen dollars ($15.00) as listed in Section 8 -56 of this Code, shall terminate at the end of the seventh day following the day of issuance of a parking citation; after that date the settlement amount shall increase to $25.00, which shall be the settlement amount until the • end of the sixtieth day. The payment that may be tendered to and accepted by the City as a settlement of a parking violation assessment shall be in the amount specified in the Schedule of Parking Violation Assessments in Section 8 -57 as the "settlement amount" for the specific violation for which a parking citation was issued. If a settlement amount for a parking violation assessment is not specified in the Schedule, the settlement amount is fifteen dollars ($15.00). C. The opportunity for payment of the scheduled settlement amount for a parking violation assessment shall terminate at the end of the sixtieth day following the day of issuance of a parking citation; however, the City, upon demonstration of a reasonable excuse by any person liable for the payment of a parking violation assessment for the failure to pay the scheduled settlement amount before the end of the sixtieth day, may accept the late payment of the scheduled settlement amount. d. Acceptance by the City of payment of the full amount required as settlement of a parking violation assessment shall constitute complete satisfaction of any liability for payment of the assessment. C. The tendering of any payment as settlement for a parking violation assessment shall not be deemed to be an admission of the violation for which the payment is made. (Ord.
