HomeMy Public PortalAbout1981-024Member Crosby introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 81-24 DECLARING TRACT C, R.L.S. 1368, HENNEPIN COUNTY, TO BE A BUILDABLE LOT WHEREAS, Tract C, R.L.S. 1368, files of the Registrar of Titles, Hennepin County, was a lot of record prior to the adoption of the current zoning ordinance and the Individual Sewage Treatment and Disposal Systems Code of the City of Medina; and WHEREAS, Clint Eide owns property adjacent to the said Tract C, and intends to purchase the said Tract C; and WHEREAS, the said Tract C does not contain sufficient suitable soils for an on -site sewage disposal system, but is nevertheless a buildable lot by virtue of its being a lot of record prior to the present zoning and septic system restrictions; and WHEREAS, the combining of the said Tract C in single ownership with adjoining lands might require consolidation of the said Tract C with adjoining lands in order to meet code requirements; NOW, THEREFORE, Be It Resolved by the City Council of the City of Medina, that Tract C, R.L.S. 1368, Hennepin County, is hereby declared to be a buildable lot and combination thereof with adjacent parcels shall not be required in order to obtain building permits and on -site sewage disposal system permits as otherwise permitted by law. Be It Further Resolved, that this resolution is approved upon the condition that the applicant dedicate the northerly 30 feet of the property to the City of Medina for street, drainage and utilities purposes.
