AMENDING MUNICIPAL CODE SECTION 2-G C -5 TO REDUCE SIZE OF
THE PUBLIC ART S COMMISSION
RECOMMENDATION:
T he City Co un ci l is req ues ted to waive fu rt he r read in g and adopt Ordinance No . 15-1003
amending Municipa l Code Section 2-6C-5 to reduce size of the Public Arts Commission .
BA CKGROUND:
1. On Apr il 21 , 201 5 , Council direct ed staff to prepare and introduce an ordinance
reducing size of th e Public Arts Comm ission from seven to five members.
2 . On May 5, 201 5 , Council intro du ced its first read in g of Ordinance No. 15-1003 to
amend Munic ipal Code Section 2-6C-5 reducing the Comm ission 's size .
ANALYSIS:
Provided as Attach ment "A", the ord inance amends Municipal Code Section 2-6C-5
(previous ly Sect io n 2635) to reduce s ize of the Commission from seven to five
members . Specifica lly, the proposed language reads :
"The City Council hereby establ is hes a Pub lic Arts Commission which will review
and adv ise t he C ity Council o n Pub l ic Art Projects and the Art in Public Places
Program Pl an . The City Counci l s ha ll appoint five members to the Commission in
accordance wi th Sect ion 1103 of the City Charter. Commiss ion members shall be
appointed to te rm s of office in accordance with Section 2-6F -O of this Code ."
Upon enactment of t he ordinance , t he new provision takes effect June 19 , 2015 .

CONCLUSION:
Council is requested to waive further reading and adopt Ordinance No . 15-1003
amending Municipal Code Section 2-6C-5 to reduce the Commission 's size .

ORDINANCE NO. 15-1003
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
AMENDING MUNICIPAL CODE SECTION 2635 REDUCING SIZE OF THE PUBLIC
ARTS COMMISS ION FROM SEVEN TO FIVE MEMBERS
WHEREAS, on Aug ust 21 , 2013, the City Council adopted Ord inance No. 12-
960 estab lishing an Art in Public Places Program and a five -member Public Arts
Commission ; and
WHEREAS, on April 16 , 2013, the City Council adopted Ordinance No. 13 -
971, creating a seven-member Pub lic Arts Commiss ion to review and advise the City
Counci l on matters with in the scope of the Art in Public Places Program; and
WHEREAS, on April 21 , 2015, the City Counc il unanimously d irected the City
Manager to prepare and re introduce an ordinance reducing size of the Public Arts
Commission from seven to five, with a determination that five members could
effect ive ly review and advise on the City's Art in Public Places Program .
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY HEREBY ORDAINS
AS FOLLOWS :
SECTION 1: Amendment of Section 2-6C-5. The City Counci l hereby
amends Section 2-6C -5 (Public Arts Commiss ion Esta blished ) of the Temp le City
Munic ipa l Code, as adopted by Ordinance No . 13-971 , to read as follows :
"The City Council hereby establishes a Public Arts Commission which will
review and advise the City Council on Public Art Projects and the Art in Public
Places Program Plan . The City Council shall appoint five members to the
Commission in accordance with Section 1103 of the City Charter. Commission
members shall be appointed to terms of office in accordance with Section 2-6F-
O of this Code."
SECTION 2: Severability . The City Council hereby declares that , should any
provis ion , section, subsection , paragraph, sentence , clause, phrase or word of this
Ordinance or any part thereof, be rendered or declared inva lid or unconstitutional by
any fina l court action in a court of competent jurisdiction or by reasons of any
preemptive leg islation, such decision or action sha ll not affect the va lidity of the
remaining section or portions of the Ordinance or part thereof. The City Council
hereby declares that it would have independently adopted the remaining provisions ,
sections , subsections , paragraphs. sentences . clauses, phrases or words of th is
Ordinance irres p ec tive of the fact that any one or more provisions, sections ,
subsections, paragraphs , sentences, clauses, phrases, or words may be decla red
invalid or unconstitutional.
SECTION 3: Publication . The City Clerk shall certify to the passage and
adopti on of this Ordinance and to its approval by the mayor and shall cause the
same to be published according to law .
