CITY OF MEDINA
RESOLUTION NO. R1_39
RESOLUTION APPROVING THE PRELIMINARY PLAT OF
INDEPENDENCE ESTATES
WHEREAS, Gary Lindgren has requested preliminary plat
approval of the real estate which is described on Exhibit "A"
and attached hereto and made a part hereof by reference;
NOW, THEREFORE, Be It Resolved by the City Council of the
City of Medina that the real estate described on Exhibit "A"
is hereby given preliminary plat approval as Independence
Estates, subject to the following conditions:
(1) That Mr. Lindgren construct or reconstruct the
grading, base and asphalt surfacing, thirty (30)
feet in width, according to specifications estab-
lished by the Medina City Engineer of the following
streets:
a) Birch Street from the centerline of
Maple Street, to the centerline of Walnut
Street, said Birch Street to be
constructed with a 100 foot vertical
curve;
b) Maple Street from the centerline of
Cedar Avenue to a point 375 feet, +
easterly thereof, including an
asphalt curb on the southerly edge and the
surface sloped toward the curb according
to specifications established by the
Medina City Engineer, provided that the
City shall pay up to $1500 to defray all
or a portion of the cost of the gravel
base;
c) Cedar Avenue from the centerline of
Walnut Street to the centerline of Maple
Street, to the extent necessary to restore
the street after utility construction.
(2) That Mr. Lindgren install sanitary sewer and water
lines and connect them to existing municipal systems in
accordance with specifications of the Medina City
Engineer;
(3) That Mr.Lindgren pay, prior to the issuance of
building permits, sanitary sewer and water connection
charges as required by City Ordinance and resolutions;
(4) That Mr. Lindgren provide a utility easement over
the southerly ten feet of the subject property;
(5) That Mr. Lindgren dedicate for street and utility
purposes, the north 29.5 feet of proposed Lot 4,
Block 1;
(6) That Mr. Lindgren prepare and file an erosion
control plan with the Zoning Administrator and that
the erosion control plan be approved by the Medina
City Engineer;
(7) That Mr. Lindgren dedicate a drainage easement,
ten feet in width, the centerline of which is on the
boundary line between proposed Lots 2 and 3, Block 2,
and continuing easterly from Birch Street through
Outlot 5, Block 2, to Ardmore Creek;
(8) That Outlot 5, Block 2, be recognized as an unbuild-
able lot unless Mr. Lindgren or the owner thereof,
demonstrates that it meets the Medina Septic System
Ordinance, or is served by municipal sanitary sewer;
(9) That Lots 1, 2, 3 and 4, Block 2, and 5, 6, 7, and
8, Block 1, front on Birch Street;
(10) That a variance be and the same is hereby granted
from the Medina Zoning Ordinance to permit construction
in the front yard setback area of each lot at a point
which is no less than 35 feet from the front lot line;
(11) That Mr. Lindgren submit the plat for approval by
the Pioneer Creek Watershed Commission, and follow any
recommendation of the said Commission;
(12) That no more than one driveway, curb cut or entrance
be permitted on any one lot;
(13) That Mr. Lindgren pay a Park Dedication Fee of
$ .
(14) That Mr. Lindgren pay City administrative costs in
the amount of $
(15) That Mr. Lindgren enter into a subdivision agreement
with the City and post a Subdivision Bond in the amount
of $120,000.00;
(16) That Mr. Lindgren file a Public Contractor's Bond
in the amount of $
(17) That Mr. Lindgren submit to the City Attorney,
an abstract of title, continued to -date, evidencing
the fact that he has marketable title to the property.

The motion for the adoption of the foregoing resolution was duly
seconded by member Scherer and upon roll call the following
members voted in favor thereof: Anderson, Crosby, Reiser, Lutz
and Scherer.
