PUBLIC HEARING - Adoption of Resolution No. 94-008, 'A Resolution of the Riverside County Transportation Commission Declaring that the Acquisition of Easement Interests in Certain Real Property by Eminent Domain is Necessary for the Widening and Realignment of State Highway 79, Also Known as Lamb Canyon Road' to Acquire Easements Needed for the Route 79, Gilman Springs Road to First Street in the City of BeaumontMeasureA Highway Improvement Proiect. Overview Following the public hearing, it is recommended that the Commission make the necessary findings as stated in the agenda and adopt Resolution 94-006, 'Resolution of the Riverside County Transportation Commission declaring that the acquisition of easement interests in certain real property by eminent domain is necessary for the widening and realignment of State Highway 79, also known as Lamb Canyon Road.' 6. CONSENT CALENDAR - All matters of the Consent Calendps will be approved in a single motion unless a Commission member requests separate action on specific items. 6A. Consent Calendar - Administrat. le Items. 6A1. Measure A Vision and Strategy Paper Policy Issues. Overview This item was referred to the WRCOG and CVAG. Staff is requesting extension of time and the Administrative Committee recommended that a special meeting be scheduled in late April. Page 2 March 9, 1994 Commission Meeting Agenda 6A2. Memorandum of Understanding with San Bernardino Associated Governments for Funding of Telecommutinq Projects. Overview Contribution Agreement No. 8-859 between RCTC and Cattrans provides funding in the amount of $300,000 to RCTC for continuance of telecommuting projects in Riverside and San Bernardino Counties. A Memorandum of Understanding between San Bernardino Associated Governments and RCTC is required to document the pass through of $150,000 to SANBAG for their County's projects. 6A3. Sacramento Monthly Report. Overview A report on legislation, from D.J. Smith/Will Kempton, is included in the Commission's agenda. 6A4. Upcoming Conferences. Overview The list of upcoming conferences is provided to the Commissioners. Interested Commissioners must notify staff by deadline date, if they are interested. 6B. Consent Calendar - Transit/Rideshare/Park-n-Rlde. 6E31. Membership on the Citizen's Advisory Committee/Social Service Transportation Advisory Council. Overview Staff recommends the appointment of Beverly Copeland and Phil Kaplan, with Susan Cote as the alternate, and reappointment of Gilbert Lopez to the Citizens' Advisory Committee/Social Service Transportation Advisory Council. 6B2. Amendment to the FY 1994-2000 RTA Short Range Transit Plan. Overview Riverside Transit Agency is requesting an amendment to their FY 1994-2000 Short Range Transit Plan to accelerate a capital project and delay/cancel two other capital projects. Page 3 March 9., 1994 Commission Meeting Agenda 6B3. Amendment to the FY 1994-2000 SunLine Short Range Transit Plan. Overview SunLine Transit Agency is requesting an amendment to their FY 1994-2000 Short Range Transit Plan to discontinue Line 92 (Coachella Valley High School) and to improve service to Line 30 (Cathedral City/Palm Springs). 6B4. Quarterly Transit Operator Report. Overview The Quarterly Transit Operator Report shows operations data for the public transit operators of Riverside County for the period October 1 through December 31, 1993. A more detailed analysis is provided as a mid -year review of the provision of public transit within the County. The more detailed analysis identifies areas that will need to be thoroughly evaluated during the update of the Short Range Transit Plan. The information used to develop this report was provided by the operators. 6B5. Commuter Assistance Program Employer Letter. Overview The Local Incentive Program of the Measure A funded Commuter Assistance Program provides financial incentives to commuters who live and work in Western Riverside County and form or join ridesharing arrangements. The reduction or elimination of trips through this program positively affects traffic congestion on local streets and roads as well as highways. 6B6. SB 821 Evaluation Criteria Recommendations. Overview At their meeting on September 8, 1993, the Commission adopted the FY 1993-94 SB 821 Bicycle and Pedestrian Facilities Program. The Commission also directed staff to reconvene the SB 821 Evaluation Committee to review the selection process, criteria and policies governing the SB 821 Program and return to the Commission with any recommendations following a review by the Technical Advisory Committee. Page 4 March 9-, 1994 Commission Meeting Agenda 6C. Consent Calendar - Congestion Management/Air Quality Programs. 6C1. Air Quality Conformity Regulations. Overview This item provides a monthly update on the status of air quality conformity issues in the Southern California Association of Governments (SCAG) region and the related impacts to Riverside County. Staff is reviewing the progress toward meeting these regulations and will request no action at this time. 6C2. Transportation Enhancement Activities Program Update. Overview In September, 1993, the Commission adopted a list of projects, in priority order, to be submitted to the California Transportation Commission for funding consideration. This agenda item details the projects funded by the CTC at their February meeting. 6D. Consent Calendar - Highway/Streets & Roads. 6D 1. Acquisition Settlements for the Route 79, Gilman Springs Road to First Street in the City of Beaumont, Measure A Highway Improvement Project. Overview The County of Riverside Real Property Department, acting as right-of-way acquisition agent for the Commission for the Route 79, Gilman Springs Road to First Street in the City of Beaumont project, is submitting settlements for the project to the Commission for their approval. The County of Riverside Waste Management has proposed to sell 10 parcels to the Commission for each parcel's respective appraised value. Also, the owner of Parcel No. 13147-1 has agreed to sell this parcel to the Commission for the appraised value. 6D2. Approval of Consultant Contract with O'Brien Kreitzberq for Construction Support Services Consultant Agreement for the Route 79 Lamb Canyon Measure A Highway Improvement Project; Overview The Route 79 Lamb Canyon Measure A Highway Improvement Project is scheduled to be advertised on April 1, 1994, to meet the SB300 State and Local Partnership Program requirements that the project be awarded for construction prior to June 30, 1994. To meet this tight schedule, Caltrans has given RCTC permission to advertise, award and administer the construction contract for this project. Staff and Caltrans have been negotiating with O'Brien Kreitzberg, the Page 5 March 9, 1994 Commission Meeting Agenda next firm on the Commission's Consultant Construction Support Services list, to provide continuing construction support services for the project which is anticipated to last approximately 18 months. 6E. Consent Calendar - Service Authority for Freeway Emergencies (SAFE). 6E1. Monthly Call Box Update. Overview The operational statistics for the Riverside County Motorist Aid Call Box System for the month of January 1994, are presented to the SAFE Board. 6E2. Status Report - Freeway Service Patrol. Overview The Riverside County Freeway Service Patrol (FSP) began providing service on four beats or segments of congested county freeways on June 28, 1993. The FSP tow trucks continuously patrol identified beats on Route 91 and Route 60/1- 215 during morning and afternoon peak periods of the work week. The program operates as a cooperative effort between Caltrans, the California Highway Patrol, and RCTC, with the Commission administering the tow truck contract and Cattrans and CHP providing daily field supervision of the program. 6F. Consent Calendar - Financial Items. Quarterly Financial Reports. Overview The data depicts the Combining Statements of Revenues and Expenditures and Changes in Fund Balances and the Cost & Schedule reports for the Quarter Ended December 31, 1993. Also enclosed are the RCTC Measure A Highway Projects Budget Report by Route, Contract Commitment and Amendments Report for the month ending January 31, 1994. 6G. Consent Calendar - Commuter Rail. 6G1. TCI Status Report. Overview The California Transportation Commission (CTC) hearing on the Transit Capital Improvement Program (TCI) is scheduled for February 23, 1994. Two Coachella Valley rail station projects have been submitted for consideration - Palm Springs and Palm Desert. RCTC and CVAG have proposed that funding requested for most costly station be approved to be equally divided between the two proposed stations. Page 6 March 9-, 1994 Commission Meeting Agenda 6G2. Pedley Station Consultant: 1) Contract Amendment #2 with Tom Berg and Associates on Agreement RO-9335; 2) Contract Amendment #2 with Pountnev and Associates on Agreement RO-9309. Overview Staff is bringing forward two contract amendments for Thomas Berg and Associates and Pountney and Associates for services on The Pedley Commuter Rail Station. 7. ADMINISTRATIVE ITEMS. 7A. Commission(s) Reports, !f Needed. Overview This item is placed on the agenda to provide Commissioners the opportunity to report on various Committees representing the Commission. 7B. Legislation Introduced by Senator Bill Leonard to Amend Riverside County Transportation Commission Membership. Overview This item addresses legislation introduced by Senator Bill Leonard to amend the composition of the Riverside County Transportation Commission membership. 7C. Request to Co -Sponsor Second Annual Inland Empire Economic Summit. Overview The Commission has received a request to co-sponsor the Second Annual Inland Empire Economic Summit. The amount of the co-sponsorship would be $1,000. 8. FINANCIAL ITEMS. Draft Revised Budget for Fiscal Year 1993/94. Overview Staff will be prepared to discuss with Budget and Finance the draft revised budget for fiscal year 1993/94. Page 7 March 9, 1994 Commission Meeting Agenda 9. CONGESTION MANAGEMENT/AIR QUALITY PROGRAMS. 9A. Congestion Management and Air Quality (CMAQ) Program Funding Changes in Relation to Air Quality Conformity Status. Overview This item addresses the potential impacts to statewide and Riverside County funding levels as they relate to changes in air quality status in a particular region. A briefing paper provided by SCAG for technical information is included in the agenda. The Commission is asked to review and comment on the proposal to ask the Federal Highway Administration (FHWA) to revise the funding criteria for air quality and provide those comments to SCAG as a part of a regional recommendation on this issue. 9B. Congestion Management Program (CMP) Linkage to the California Environmental Quality ACT (CEQA). Overview At the February Commission meeting, Commissioner Alex Clifford raised the issue of addressing transportation impacts associated with Specific and General Plan Amendments through the Congestion Management Program (CMP) process. 9C. Proposed AB 2766 Local ISTEA/TCM Partnership Program. Overview The Mobile Source Reduction Review Committee approved the extension deadline request from December 31, 1993 to March 31, 1994 for submittal of the Commission's FY 93/94 ISTEA/TCM Partnership Program. The Technical Advisory Committee and its subcommittee have identified and discussed various programs. Staff will report on their recommendations. 10. TRANSIT/RIDESHARE/PARK-N-RIDE/BICYCLE. 10A. Commuter Transportation Services, Inc. Board Appointment. Overview Under contract to RCTC, Commuter Transportation Services, Inc. provides regional rideshare services to commuters and employers in Riverside County. CTS is requesting that the Commission appoint a representative to serve on its Board of Directors. Page 8 March 9; 1994 Commission Meeting Agenda 10B. Measure A Commuter Bicycle Demonstration Program Final Report. Overview The Riverside Bicycle Commuter Coalition has completed its development and implementation of the Wheels to Work demonstration program funded by RCTC under its Measure A Commuter Assistance Program. Included in the agenda is the final report for the Program. 11. HIGHWAYS/LOCAL STREETS & ROADS. 11 A. Excess Dirt Disposal Agreement for the Route 79. Gilman Springs Road to First Street in the City of Beaumont. Measure A Highway improvement Project. Overview In August of 1993, the Commission gave their conceptual approval for an agreement with, David Pearson of the Landbank Company, for the disposal of excess soil material from the Lamb Canyon Project to his property. Staff and Legal Counsel have drafted an agreement in accordance with the terms outlined above. Staff and Legal Counsel have persistently tried to come to terms with Mr. Pearson and his Legal Counsel with no success. Mr. Pearson has requested that he be given a chance to meet with the Commission to address his reservations with the agreement in its current form. 11 B. Authorization to Advertise for Construction the Route 79 Lamb Canyon/Gilman Springs Road Grade Separation Measure A Highway Improvement Project. Overview Staff requests the Commission's approval to advertise for construction bids on the project on or around Monday, April 4, 1994. The bid period will be open for a period of five (5) weeks until Monday, May 9, 1994, at 10:00 a.m., at which time, the bids will be opened. Staff, Caltrans, Griener, and Legal Counsel will form a team which will review the bids for a period of two (2) weeks and make their recommendation of the lowest acceptable bid to the Commission at the June 8, 1994, Commission meeting. With this schedule, the construction contract will be signed and awarded prior to the June 30, 1994, SB300 deadline. 11 C. Discussion of Alternatives for Surveying Services and Material Testing Services for the Route 79 Lamb Canyon Project. Overview The Route 79 Lamb Canyon Measure A Highway Improvement Project is scheduled to be advertised on April 1, 1994, to meet the SB-300 State and Local Partnership Program requiremens that the project be awarded for construction prior to June 30, 1994. Staff has been negotiating with O'Brien Kreitzberg, the next firm on the Commission's Consultant Construction Support Services list, to provide continuing construction support Page 9 March 9, 1994 Commission Meeting Agenda services for the project. There are several options that staff would like to present to the Commission for discussion pertaining to surveying and material testing construction support services for the Route 79 Lamb Canyon Project. 11 D. Route 86 Expressway Project Update. Overview RCTC staff and Commissioners Larson, Wilson, and Jaffy have continued to work with representatives from CVAG, the cities of Coachella and Indio, other local agencies, Cahrans, and the federal agencies to move the Route 86 project ahead during this past month. The significant issues address are identified. A more detailed report is included in the agenda. 11 E. Route 71 Demonstration Project. Overview Proposals are being requested to submit proposals for additional demonstration projects for funding and Congressman Jay Kim (Chino Hills) has submitted the Riverside County portion of Route 71 for demonstration funding. The Commission may want to reassess its position on Route 71. 12. COMMUTER RAIL. 12A. lCC Ruling that RCTC is a 'Railroad'. Overview The Interstate Commerce Commission (ICC) has determined that the county agencies which purchased rail rights -of -ways from Santa Fe are 'railroads' subject to their regulation. ICC had previously determined that LAMTA is a 'railroad' following its purchase of rights -of -way from the Southern Pacific. In LAMTA's case, many of the more onerous reporting requirements have been waived, but no waiver has been provided for compliance with Railroad Retirement Tax Act requirements; LAMTA will most likely appear or take some other remedial action, but is not yet in compliance. 12B. Commuter Rail Station Development Project. Overview Included in the agenda is a report on the status of commuter rail station development on the ATSF line. Page 10 March 9, 1994 Commission Meeting Agenda 12C. Schedule for Start -Up of San Bernardino to Riverside to Irvine and Riverside to Fullerton to Los Angeles and Metrolink Commuter Rail Services. Overview At the January 12, 1994 meeting, staff was directed to generate project development schedules for the projects related to start-up of the San Bernardino to Riverside to Irvine and the Riverside to Fullerton to Los Angeles Metrolink commuter rail services. Information is provided on the status of the various rail improvements necessary to begin service as well as recommendations on proposed service start-ups. 13. CLOSED SESSION of necessary). 14.
