HomeMy Public PortalAbout1981-053Member Crosby introduced the following resolution and moved its adoption: CITY OF MEDIN RESOLUTION NO. / -.5,3 RESOLUTION REZONING THE DOCKSIDE FROM COMMERCIAL TO MULTI --FAMILY RESIDENTIAL WHEREAS, John M. Spaeth and Cheryl A. Spaeth, are the owners of real estate legally described on Exhibit A which is attached hereto and made a part hereof by reference; and WHEREAS, the owners have requested rezoning of the property from Commercial to Multi -family Residential; and WHEREAS, the subject property is a commercial use consisting of a combination bar, restaurant and dance hall which has existed as a commercial use in some form since prior to the adoption of zoning regulations in the City of Medina; and WHEREAS, the subject property is approximately 2.2 acres, is roughly triangular in shape, being approximately 108 feet on the south, 433 feet on the east, 375 feet on the north, and 538 feet on the west and southwest; and WHEREAS, the subject property is well served by transportation corridors, being County Road 19 on the east and Lakeshore Avenue on the north; and WHEREAS, the property is served by public sanitary sewer and water; and WHEREAS, the property is narrow in dimension and is of irregular shape to the extent that variances from existing set- back regulations are required for most residential uses which gives the City Council the authority to control density through the various processes. NOW, THEREFORE, Be It Resolved, by the City Council of the City of Medina that the property described on Exhibit A is hereby rezoned to Multi -family Residential, and appropriate amendments to the Zoning Map of the City of Medina are hereby authorized based upon the following considerations: 1) Minutes of the City Council and Planning Commission meetings of the past two years reflect that a public hearing on the proposed rezoning was held on the loth day of September, 1980, and that numerous additional meetings of the Planning Commission and the City Council have been held, at which citizen input has been extensive; 2) The original zoning on the property resulted from the fact that a commercial use existed at the site prior to any zoning regulations being adopted by the City of Medina and the existence of a small commercial district surrounded by residential and open space development is inconsistent, in- compatible, and erroneous; 3) Sanitary Sewer and Water were introduced into the residential area which lies to the north of the subject property in 1975 which has resulted in significant upgrading of theshousing stock, and the construction of additional dwelling units, while, within the past fifteen years, the property lying to the east and south of the subject parcel has been converted to long-term parkland use, all of which is inconsistent with the present commercial zoning and use of the subject property; 4) The rezoning to Multi -family Residential with a maximum density of 8900 sq. ft. per dwelling unit is a logical and compatible extension of the existing residential development to the north. Be It Further Resolved, that the rezoning to Multi -family Resi- dential is conditioned upon the development of the property in accordance with the plat approval, the variance approval, and the construction plan approval being processed contemporaneously here- with; Be It Further Resolved, that the rezoning to Multi -family Residential is conditioned upon a waiver by the owners of the requirements of §504.2(4) of the Medina Zoning Code and similar provisions contained within the previous Medina Zoning Code.
