P -��1,/ RESOLUTION APPROVING THE FINAL PLAT OF DOCKSIDE WHEREAS, John Spaeth has requested final plat approval, rezoning from Commercial to Multiple Family Residential, Guidelines for Development, and numerous variances for construction of townhouses and single family dwellings on property which is bounded on the north by Lakeshore Drive, on the east by County Road 19, on the south by the Hennepin County Park Reserve District, and on the west by Lake Independence, the said property being legally described as set forth on Exhibit A_ which is attached hereto and made a part hereof by reference. NOW, THEREFORE, Be It Resolved, by the City Council of the City of Medina, that the final plat of Dockside dated the 6th day of October, 1981, prepared by or under the supervision of Gary Gabriel, Registered Surveyor, No. 9066, be, and the same is hereby approved as a final plat upon the following conditions and contingencies: 1) That the developer meet the criteria for granting variances and obtains approval for the variances from the City Council as set forth on Exhibit B which is attached hereto and made a part hereof by reference; 2) That the developer shall encumber the property with a Declaration of Covenants, Conditions, Restrictions and Easements, said Declarations to be approved by the City Attorney and to include, among other things, a restriciton on the habitable space, as defined herein, to be per- mitted on each lot, prohibitions on the out- side storage of various items of personal pro- perty, limitations on boat storage, and dock usage, and other matters of a similar nature, provided, however, that the City of Medina shall be granted the authority to enforce the said covenants; 3) That a Park Dedication Fee in the amount of $12,500.00, be paid to the City Clerk; 4) That the developer and the City waive the restriction on rezoning as set forth in Minnesota Statutes, �462.358, Subd. 3c; 5) That upon construction of the storm sewer, a temporary sediment basin be provided at the storm sewer outlet to be maintained until the City Engineer determines that construction cleanup and reestablishment of vegetation has progressed to a point at which the danger of excess sediment being deposited in public waters has substantially ceased; 6) That the developer pay, according to City Ordinances and Resolutions governing the cost of sewer and water connections, all connection charges required, at the time building permits are issued; 7) That existing special assessments upon the property shall be allocated as follows: Lot 1 Lot 2 Lot 3 $3,750.44 $3,750.44 $3,750.44 Lot 8 $3,750.44 Lot 9 $3,750.44 Lot 10 $3,750.44 8) That the developer provide to the City Attorney certification by an attorney licensed to practice law in the State of Minnesota, that the developer is the owner of the property described herein; 9) That the developer sign a subdivision agreement drafted by the City Attorney and post a performance bond and a public contractor's bond in an amount established by the City Engineer, in which docu- ments the developer shall agree and guarantee to construct the subdivision in accordance with the plans submitted and approved by the City Council; 10) That the Developer shall reimburse the City for expenses incurred for planning, engineering, legal and administrative services in processing this application in the amount of $2,922.00, through and including August 31, 1981 and, that the Developer shall pay any additional costs incurred thereafter and during construction until final approval of the construction by the City Council, including Building Plan Review by the City Staff and City Council; 11) That the Mayor and Clerk are hereby authorized and directed to sign the plat on behalf of the City, provided, however, that the Clerk is authorized and directed to retain the signed plat in her office until such time as the developer has complied with paragraphs 2, 3, 4, 8, 9 and 10 12) That no action be taken by the developer in furtherance of construction upon the subdivision until the plat has been filed with the Hennepin County Recorder. BE IT FURTHER RESOLVED, by the City Council of the City of Medina, that in the event of a failure to comply with any condition set forth herein, this preliminary plat approval and any subsequent approvals are hereby declared to be null and void. DESCRIPTION OF PREMISES That part of the following described tracts: That part of Government Lot 3, Section 18, Township 118, Range 23 lying Westerly of the centerline of County Road Number 19, as laid out and traveled September 28, 1943; That part of Government Lot 3, Section 18, Township 118, Range 23 lying Easterly of the centerline of County Road Number 19, as laid out and traveled September 28, 1943 and Westerly of the Westerly right-of-way of County Road Number 19 as laid out and traveled April 9, 1981; Lying Northerly of the following described line and its Westerly extension: Beginning at a point on the North and South centerline of said Section 18, distant 2200.17 feet North from the South quarter cor- ner of said Section 18 as measured along said North and South quarter line; thence South 79 degrees 27 minutes West (assuming said North and South quarter line as bearing North) to the shoreline of Lake Independence and there terminating.
