CITY OF MEDINA
RESOLUTION NO.
RESOLUTION APPROVING VARIANCES FOR
THE CONSTRUCTION OF
DOCKSIDE TOWNHOUSES
WHEREAS, John Spaeth has requested approval of site and
building plans for the Dockside Townhouses and has requested
certain variances from the zoning regulations of the City of
Medina, said Dockside Townhouses to be constructed on property
the legal description of which is attached hereto and made a
part hereof by reference as Exhibit A; and
WHEREAS, the Council finds that the subject property is
approximately 2.0 acres in size, is generally irregular and
triangular in shape, and is composedof the following approxi-
mate dimensions: approximately 108 feet on the south, 433
feet on the east, 375 feet on the north, and 538 feet on the
west and southwest;
NOW, THEREFORE, Be It Resolved, by the City Council of
the City of Medina that the variances described on Exhibit B
which is attached hereto and made a part hereof by reference,
are granted, based upon the following considerations:
1) The size, configuration and irregular shape
are unique, exceptional and extraordinary in
their effect on the development of the property
which is not applicable generally to other
properties in the same zone and that undue hard-
ship would result if the regulations of the
zoning ordinances were strictly applied;
2) The size, shape and irregularity of the property
are not within the owner's control;
3) Strict enforcement of the provisions of the setback
requirements of the zoning ordinance would deprive
the owners of the rights enjoyed by other property
owners in the same zoning district;
4) That the special conditions do not result from
the actions of the owners of the property;
5) The granting of variances will not confer special
privileges on the owners which is denied to other
property owners in the same district;
The variances granted are the minimum variances
which will alleviate the hardship;
7) The granting of variances will not be materially
detrimental to the purposes of the zoning
ordinance or to properties in the same zone
or vicinity;
8) The variances granted are consistent with setback
variances granted and housing density existing
in adjacent residential areas.
Be It Further Resolved, that these variances are granted
upon the condition that the subject property be platted and
developed in accordance with the resolAitions processed con-
temporaneously herewith rezoning the property to multi -family
residential, approving the final plat, and in accordance with
the pending approval of site and building plans by the City
Council.
Be It Further Resolved, that these variances are granted
upon the condition that the building construction plans be
prepared by an Architect, Registered and Licensed, pursuant
to Chapter 326 of Minnesota Statutes.
