HomeMy Public PortalAbout1981-056Member eAe as,by introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.%-� RESOLUTION APPROVING THE ABANDONMENT OF A DEVELOPMENT CONTRACT AND CANCELLING ASSESSMENTS BASED THEREON PURSUANT TO M.S.A. §435.202 WHEREAS, on October 2nd, 1981, the City of Medina entered into a Development Contract with K-L, a co -partnership con- sisting of Fredrick J. Keller and Donald C. Lindvall. WHEREAS, based upon the said Contract, K-L, acting through Fredrick J. Keller, filed a petition for local improvements; and WHEREAS, pursuant to the said petition the City of Medina adopted Resolution No. 81-48, a copy of which is attached hereto and made a part hereof by reference, which resolution established an improvement project on the lands described therein; and WHEREAS, the assessment roll was adopted with respect to the real estate described herein in the amount of $13,000, the payment of installments upon which were deferred under certain conditions, a copy of the said assessment roll being attached hereto and made a part hereof by reference; and WHEREAS, the assessment roll was certified to the County Auditor and County Recorder pursuant to the Statute; and WHEREAS, the City of Medina and K-L, a co -partnership, have abandoned the Development Contract to the extent that no benefit will accrue to the property owned by K-L, a co -partnership; NOW, THEREFORE, Be It Resolved by the City Council of the City of Medina as follows: 1) The Development Contract dated October 2, 1981, between the City of Medina and K-L, a co -partnership, may be and the same is hereby declared to be abandoned. 2) The City Clerk/Treasurer of the City of Medina, the County Auditor and County Recorder of the County of Hennepin, are hereby notified that the special assessments levied against the property owned by K-L, a co -partnership, in the amount of $13,000, may be and the same are hereby cancelled.
