Members Present: Andre Griben, Robert Murphy, Craig Nation, Marcus Waldron, Bob Ingram:

The Commission signed the following documents:
- Fitzpatrick, 4 DiCarlo Road – Certificate of Compliance (188-1439)
- NSTAR Gas, Lumber Street - Certificate of Compliance (188-1299)
- NSTAR Gas, Lumber Street - Certificate of Compliance (ERO)
Mr. Waldron made a motion to approve the Request for Payment dated 12 March 2012. The
motion was seconded by Mr. Nation and it passed unanimously
A discussion was held regarding the proposed project change submitted by Legacy Farms
LLC, Roadway South (188-1469). Mr. Nation made a motion to approve, as an insignificant
project change, the proposed relocation of the bioretention basin #4 as noted in the letter
dated 14 February 2012 and identified on the site plan highlighted red and received on 03
February 2012, subject to final approval by BETA Group. The motion was seconded by Mr.
Waldron and it passed unanimously.
A discussion was held regarding the proposed project change submitted by Sipowicz, 13
Cedar Street Extension (188-1473). Mr. Waldron made a motion to approve, as an
insignificant project change, the proposed footprint reduction of the deck as identified on the
site plan highlighted red and received on 05 February 2012. The motion was seconded by
Mr. Nation and it passed unanimously

Notice of Intent
David. Marquedant, JD Marquedant & Associates, Inc.
Mr. Marquedant provided an overview of the Notice of Intent application and presented a copy of
the survey plans entitled “Sketch Plan of Land in Hopkinton, Massachusetts” and dated 03
February 2012. A discussion was held about the proposed construction of a garage, driveway,
planting areas, utilities, and associated site work. The Commission noted the permanent
immovable barrier needed to be extended further north and east along the erosion control barrier.
Mr. Marquedant noted a revised plan could be provided for review.

Mr. Nation made a motion to close the hearing and issue an Order of Conditions, subject to the
submittal of a revised plan, with the standard and noted special conditions. The motion was
seconded by Mr. Waldron and it passed unanimously.

Request for Determination of Applicability
Daniel McIntyre, McIntyre Engineering
Mr. McIntyre provided an overview of the Request for Determination of Applicability application
and engineered plans entitled “Septic System Design Plan” and dated 10 February 2012. A
discussion was held about the replacement of the failed septic system. The Commission
determined not to approve the wetland delineation identified on the plans as accurate.
Mr. Waldron made a motion to close the hearing and issue a negative Determination of
Applicability with the standard and noted special conditions. The motion was seconded by Mr.
Griben and it passed unanimously.

Request for Determination of Applicability

Mr. Holmes provided an overview of the Request for Determination of Applicability application
and site plans entitled “Wetland Delineation Overlay Plan Proposed Gas Main Extension” and
dated February 2012. A discussion was held about the proposed installation of a gas utility line.
Mr. Nation made a motion to close the hearing and issue a negative Determination of
Applicability with the standard and noted special conditions. The motion was seconded by Mr.
Waldron and it passed unanimously.
