CITY OF MEDINA

RESOLUTION COMBINING DEVELOPMENT RIGHTS UNDER
THE SIGN ORDINANCE
WHEREAS, Donald Mayer is the owner of two pieces of
real estate, the legal descriptions of which are attached
hereto and made a part hereof by reference as Parcel A anu
Parcel B; and
WHEREAS, a gasoline service station within the meaning
set forth in the Medina Sign Ordinance is operated on Parcel
A and a bulk fuel storage plant is operated on Parcel B;
and
WHEREAS, the businesses located on Parcel A and Parcel B
are within close proximity to each other and separated by State
Highway No. 55; and
WHEREAS, the two businesses are operated under the same or
similar business name and are closely related in terms of
location, operation, and type of business, but are two distinct
and separate business enterprises with separate locations; and
WHEREAS, the Sign Ordinance permits business signs not
to exceed One Hundred Sixty-four (164) square feet in area on
Parcel A and One Hundred (100) feet in area on Parcel B; and
WHEREAS, Donald Mayer wishes to combine development rights
related to signs on the two parcels for the purpose of locating
additional signs on Parcel A.
NOW, THEREFORE, Be It Resolved by the City Council of the
City of Medina that development rights relating to signs on
Parcels A and B as described herein may be combined and divided
between Parcels A and B in any ratio determined by Donald Mayer,
provided, however, that the total sign surface on Parcels A and
B shall not exceed the total for the two parcels as permitted
by the Medina Sign Ordinance.
Be It Further Resolved, that a copy of this resolution be
filed with the Hennepin County Recorder in the Tract Index
for each parcel.
Be It Further Resolved, that Donald Mayer pay administrative
costs in an amount not to exceed $ 200.00 to defray the
costs of processing this application, costs of filing with the
Hennepin County Recorder and related costs, including legal and
administrative costs incurred by the City of Medina.

Resolved further that no construction in furtherance of the
erection of additional signs on either Parcel A or Parcel B
shall occur until agreement with the foregoing by Donald Mayer
is evidenced by his signature on this resolution.

Motion for the adopton of the foregoing resolution was duly

Whereupon said resolution was declared duly passed and adopted.
