HomeMy Public PortalAbout20100419 OLD COUNCILREGULAR COUNCIL MEETING APRIL 19, 2010 1 FIRST MEETING - OLD COUNCIL CALL TO ORDER The Regular Council Meeting of April 19, 2010, was convened at 6:00 P.M. by Mayor John Landwehr. ROLL CALL The following Council Members were present for the roll call: Present: Carroll, Ferguson, Harvey, Klindt, Koon, Medin, Penfold, Pope, Scrivner and Struemph Absent: None A quorum was declared present. Mayor John Landwehr asked if anyone present wished to be added to the list of those who would like to make a presentation to the Council tonight, and added those names to the list. PUBLIC HEARINGS (a) Rezoning 2.31 Acres at 3306 W. Truman Blvd. from RA -2 and RS -1 to C -O, and Endorsing Associated Comprehensive Plan Amendment City Planner Janice McMillan made a staff presentation giving details of the requested rezoning. Following her presentation, the following persons came forward to speak on the issue: In favor: Dr. Michael Ryan, owner of the property involved in the rezoning request, asked the Council to approve the request. Mr. Leonard Steinman, Jefferson City, stated he is in favor of the request because he believes more medical facilities are needed in the area. Opposed: No one came forward to speak in opposition to the proposed rezoning. REGULAR COUNCIL MEETING APRIL 19, 2010 2 FIRST MEETING - OLD COUNCIL Mayor John Landwehr declared that the evidentiary portion of the public hearing was now closed and that the Council would take up the associated pending bill. Bill 2009 -147, sponsored by Councilman Struemph, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, BY REZONING 2.31 ACRES FROM RA -2 HIGH DENSITY RESIDENTIAL AND RS -1 LOW DENSITY RESIDENTIAL TO C -O OFFICE COMMERCIAL, FOR LAND ADDRESSED AS 3306 WEST TRUMAN BOULEVARD, CITY OF JEFFERSON, COLE COUNTY, MISSOURI, AND ENDORSING AN AMENDMENT ON THE DEVELOPMENT PLAN MAP OF THE COMPREHENSIVE PLAN TO REFLECT SUCH CHANGE. Bill 2009 -147 was read third time by title, placed on final passage and passed by the following roll -call vote as Ordinance 14659: Aye: Carroll, Ferguson, Harvey, Klindt, Koon, Medin, Penfold, Pope, Scrivner, and Struemph Nay: None MISCELLANEOUS AGENDA ITEMS Proclamation Declaring April as Fair Housing Month - Assistant to the City Administrator Melva Fast introduced Mr. Eric Krekel of Housing and Urban Development, made a presentation regarding Fair Housing Month. Mayor John Landwehr read and presented the proclamation to Mr. Krekel. MINUTES AND REPORTS RECEIVED AND FILED Mayor John Landwehr stated the following minutes have been received and are on file for review in the City Clerk's office: a. Public Safety Committee, March 19, 2010 b. Certification of Cole and Callaway County April 6 Election Results to City Clerk c. Airport Advisory Committee, March 1, 2010 d. Conference Design & Construction Committee / Finance Subcommittee, March 18, 2010 e. Planning & Zoning Commission, March 11, 2010 f. Parks & Recreation Commission, March 9, 2010 g. Historic Preservation Commission, March 9, 2010 REGULAR COUNCIL MEETING APRIL 19, 2010 3 FIRST MEETING - OLD COUNCIL Mayor Landwehr thanked the volunteers who serve on these Boards and Commissions for their vital contribution to our community. COUNCIL LIAISON REPORTS Administration Committee - Councilwoman Carrie Carroll announced that the appointments on tonight's agenda were approved at the last meeting of the Committee, as well as several other topics which were discussed and moved on to the full Council. Finance Committee - Councilman Koon reported that the Committee had met last Friday, April 16, following the Brown Bag Work Session. Public Safety Committee - Councilman Dan Klindt reported that no meetings had been held since the last Council meeting. Public Works & Planning Committee - Councilman Jim Penfold reported that the next meeting will be held on Thursday, April 22. Ad Hoc Committees, if any: Councilman Jim Penfold announced that a meeting of the Conference Center Design and Construction Committee will be held on Thursday, April 22 at 4:30 P.M. in the Boone - Bancroft Room. ANNOUNCEMENTS OF OTHER UPCOMING MEETINGS AND EVENTS Mayor John Landwehr presented outgoing Councilman Dan Klindt with a plaque and made remarks commending Councilman Klindt for his service to the City. Following his presentation, Council Members each made farewell remarks to Councilman Klindt, after which Councilman Klindt made comments from the podium to the Mayor, City Council and staff. CONSENT AGENDA The following items were presented to the Council for their approval by Consent: Minutes of April 2 and April 5, 2010 City Council Meetings REGULAR COUNCIL MEETING APRIL 19, 2010 4 FIRST MEETING - OLD COUNCIL A motion was made by Councilman Jim Penfold to approve the Consent Agenda, seconded by Councilman Rich Koon, and approved unanimously. BILLS PENDING Bill 2009 -148, sponsored by Councilman Penfold, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SUPPLEMENTAL AGREEMENT NO. 2 TO THE PROFESSIONAL SERVICES AGREEMENT WITH BURNS AND MCDONNELL FOR THE PURPOSE OF PROVIDING ADDITIONAL SERVICES REQUIRED TO COMPLETE A "BOUNDARY SURVEY / EXHIBIT A PROPERTY MAP" FOR THE JEFFERSON CITY MEMORIAL AIRPORT. Bill 2009 -148 was read third time by title, placed on final passage and passed by the following roll -call vote as Ordinance 14660: Aye: Carroll, Ferguson, Harvey, Klindt, Koon, Medin, Penfold, Pope, Scrivner, and Struemph Nay: None Bill 2009 -149, sponsored by Councilman Medin, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING SECTION 19- 401, (STREETS AND HIGHWAYS), SCHEDULE (J), (PARKING PROHIBITED), SUBPARAGRAPH (A), OF THE CODE OF THE CITY OF JEFFERSON, PERTAINING TO PORTIONS OF WEATHERED ROCK ROAD AND A PORTION OF WEATHERED ROCK COURT. RESOLUTIONS RS2009 -50 Waiver of Special Tax Bill Issued Against 120 Amador Ave Rear (Koon) Councilman Ron Medin announced that he will recuse himself on discussion or action on this item due to a conflict of interest. A motion was made by Councilman Jim Penfold for adoption of RS2009 -50 as presented, seconded by Councilman Bryan Pope, and approved unanimously by the following roll -call vote: Aye: Carroll, Ferguson, Harvey, Klindt, Koon, Penfold, Pope, Scrivner, and Struemph Nay: None Abstain: Medin SCHEDULED REPORTS REGULAR COUNCIL MEETING APRIL 19, 2010 6 FIRST MEETING - OLD COUNCIL There were no reports scheduled for this time. PRESENTATIONS FROM THE GALLERY ON OTHER TOPICS No presentations were made at this time. NEW BUSINESS There was no new business brought forward at this meeting. UNFINISHED BUSINESS There was nothing brought before the Council at this point. ADJOURN SINE DIE MayorJohn Landwehrannounced that immediately after this meeting adjourns Sine Die, the administration of the oaths of office to newly elected Council Members will be officiated by by the Honorable Patricia S. Joyce, Presiding Judge, 19th Judicial Circuit, Div.
