HomeMy Public PortalAboutRES-CC-1983-11RESOLUTION NO. 83-11 RESOLUTION FOR THE ACQUISITION OF LOW COST FEDERAL HYDROELECTRIC POWER Adopted on June 21, 1983 WHEREAS, the Western Area Power Administration ("WAPA"), as an arm of the United States Department of Energy, is charged with distributing low-cost federal hydroelectric power generated from various facilities, including the Hoover Dam, components of the Colorado River Storage Project (Collbran, Provo River and Rio Grande Project); and WHEREAS, in distributing such power, WAPA is governed .by certain federal statutes which provide that preference in the sale of such power shall be given to municipalities and other public entities; and WHEREAS, in the past, WAPA has refused to make sales to preference entities (such as municipalities) for resale to privately -owned utilities for distribution and sale to consumers found within the municipalities' boundaries; and WHEREAS, it is a primary purpose of the governing statutes that federal hydroelectric power be distributed in a manner that provides the most widespread use thereof and promotes the interest of consumers of an adequate and reliable supply of energy at the lowest reasonable cost; and WHEREAS, the power distribution system of Utah Power & Light Company presently services the electric -power needs of the -2- residents of the City and Utah Power & Light Company has been granted a franchise by this City to serve the electrical requirements of its inhabitants; and WHEREAS, under WAPA's present marketing criteria, the residents of the City are precluded from receiving the benefit of low cost federal hydroelectric power, while through happenstance of residence, electric power consumers residing within the boundaries of other municipalities enjoy the benefit of such low cost power; and WHEREAS, the City Council deems such preclusion as being inequitable in the sale of federal hydroelectric power; and WHEREAS, WAPA is in the process of adopting new marketing criteria for the sale of federal hydroelectric power; and WHEREAS, the City is a Utah municipal corporation required to act on behalf of and for the benefit of its residents. NOW, THEREFORE, IT IS HEREBY RESOLVED that the City Council hereby authorizes and directs Utah Power & Light Company, through its franchise granted by this City, the Mayor and any other authorized representatives of the_ City, to engage in all activities necessary and convenient for the acquisition of low-cost federal hydroelectric power for distribution to the -3- residents of the City, which activities shall include, but are not limited to, the following: 1. To make any applications for federal hydroelectric power for distribution thereof through Utah Power & Light Company's City franchised power distribution system to the residents of the City; 2. To file comments with respect to WAPA's proposed or promulgated marketing criteria and to otherwise participate in public proceedings in connection with the adoption of such criteria; 3. To engage, singularly or in conjunction with Utah Power & Light Company in public proceedings, including administrative agency actions and/or judicial actions, for the purpose of obtaining a proper and lawful interpretation and application of the statutes and regulations governing the sale of federal hydroelectric power.
