HomeMy Public PortalAbout1977-04-26 Meeting0 6 it a April 26, 1977 The Council of Bal Harbour Village met Tuesday April 26, 1977, at 9:30 A.M. in Village Hall. Present: Messrs. Beatty, Davis, Krez, Printup and Taplin Also present were Fred W. Maley, Village Manager; Mary T. Wetterer, Village Clerk; and Alan Gold, Village Attorney. On motion of Mr. Taplin, seconded by Mr. Beatty, and voted the minutes of the previous meetings of March 29, 1977 and April 18, 1977 were approved as submitted. Mayor Printup asked all to stand in memory of R. W. "Pat" Patterson, our Building Inspector who passed away on April 22, 1977. Mr. Gold advised that the Village Manager and our Zoning Consultant need more time to prepare the full text of an ordinance covering the proposed zoning restrictions on the oceanfront district. Mr. Gold then read the title of proposed Ordinance No. 193 and motion of Mr. Taplin, seconder' by Mr. Beatty, and voted Ordinance To. 193 was pa.sed by title for .first reading,-. Mayor Printup asked if anyone present wished to speak on the conriaerati.on of the Building Moratorium of the oceanfront. There being none, after• discussion it was moved by Mr. Beatty, seconded by Mr. Taplin, and voted to continue the building; moratorium until t}e amendment to the Zoning Ordinance could be completed. Mr. Gold said that there is li.tiration pending regarding Dade County receiving all of Florida. Power & Light Co's Municipal franchise monies and the courts have enjoined Florida Power &. Light Co. from renegotiating any municipal franchises. He recommended tabling the matter of an early renewal of our franchise with Florida Power & Light pending the courts decision. Mr. Maley reported he did not have enough time to receive proposals from qualified consulting firms to advise on the Business District Zoning. Mr. Gold advised the Council as to the requirements of Bal Harbour Ordinance 182 which must be considered and determined in order to impose a building moratorium on the Business District in Bal Harbour. Discussion among the Council members followed. Upon motion by Mr. Beatty, seconded by Mr. Taplin, and vote of the Council, it was determined that the existing zoning district (as identified in Appendix A, Code of Bal Harbour Village) and regulations thereof may be detrimental to the area should they continue to remain applicable. The Council instructed Mr. Cold to prepare a formal resolution reouiring a public hearing to be held on May 31, 1977 to determine whether a building moratorium should be established on the Business District, in accordance with Ordinance 182 of Bal Harbour Village. The building official was directed not to issue any building permits in the Business District pending the public hearing. l# Mr. Henry von Oesen discussed the proposed "ence at the North ennement to the beach. The Council discussed the Agreement between Bai Harbour Village and the Dade County Police Benevolent Association with Mr. Les Heat of the P. B. A. Mayor PrinLup reported that due to the action of the cities of miami Beach and North Miami Beach on the water rates, that Taal. Farbour and :Hay Harbor Islands are progressing on securing t eir own water directly from Dade Country. He said i.t way., hoped that Surfside and Indian Creek Island would ,join us and that they share in the expenses. Mr. Maley reported that `lade County has ua.sed an ordinance which renuires all municipalities in Dade County to pay "prnvailing wages" on contracts over $50,000.00 on Public Buildings and Public ldorkr projects. On motion of Mr. Taplin, seconded by Mr. Krez, and voted Mr. Herbert Davis w�r appointed as the Ba.l Harbour representative on the Dane Leat -ue of Cities Bo "rd of Directors. The council discussed the financial statements for the first six month';; operation for F'Y77. On motion of Mr. Davis, seconded by Mr. Taplin the statements were filed for audit. Mr. Gold told the council that members of the council could not meet with the Ba.i Varbour Club Board of Directors regarding residential street improvements unless it was a meeting open to the public. It was decided that Mr. Maley and Mr. Logan who had been appointed by the Mayor to this committee would attend the meeting. Mr. Maley said that the Library Board of Trustees were meeti.nT on May 7th and that he would represent the Village as requested by their chairman. There being no further business on motion of Mr. Davis, seconded by Mr. Beatty the meeting was adjourned at 11 :50 A.M. i Mayor ATTEST: Village Clerk April 26, 1977
