Motion carried unanimously. Strategic Discussion - Copper Compliance (McLaughlin & Riordan): JFOC Environmental Attorney Gene Riordan provided background into the NPDES Permit Requirements related to the Treatment Plant’s current copper regulations, also known as water quality based effluent limits. These limits are developed using a mass balance equation that is based on the design capacity of the plant (2.499 MGD) and a calculated low flow for the river. Riordan reported that since the last JFOC meeting, they had discussed the copper compliance with the State with some success. The State acknowledged the seasonal flows of the Fraser River and agreed to the monthly limit concept. The State also agreed that a “translator” should be applied when calculating the permit limits to ensure that those limits are consistent with how the water quality standard is measured. However, in order to obtain tiered limits, the Committee would have to de-rate the plant capacity for the low discharge months which is a more extensive, time consuming, and uncertain process. If the Committee doesn’t de-rate the plant, it looks like the Treatment Plant could meet the re- calculated monthly limits in every month but September through December. These are the low discharge months when the copper concentrations in the discharge tend to be higher. To address the compliance uncertainty in these months, the State has offered to extend the compliance schedule (which, in essence, will defer the effective date of the recalculated permit limits) to April 2018 so that the Committee can further evaluate and take the necessary corrective actions to achieve compliance. McLaughlin and Riordan responded to questions. • Look into changing the building codes in reference to copper pipes in new homes construction. • Look into source treatment • Derate 2.0 MGD • Look into JFOC agreement. Filing a modified permit was agreed upon. Joint Facilities Oversight Committee Meeting June 10, 2016 Directed staff to draft a letter to the County requesting they look into modifying building codes in reference to copper. Chris Seemann, moved for the Town of Fraser to request the following modifications to the existing permit for the Upper Fraser Valley Treatment Plant: (a) monthly copper limits that have been translated to total recoverable from the dissolved water quality standard; and (b) an extension of the copper limit compliance date as appropriate to address the uncertainty as to whether the facility can consistently meet the new monthly limits; the motion was seconded by Tom Newton. Motion carried unanimously. Other Business & Updates: It was duly moved by Chris Seemann, and seconded by Tom Newton, and unanimously adopted that the meeting stand adjourned at 4:10 p.m. Secretary
