MINUTES
AUGUST 2, 1977
Mayor Merritt called the regular meeting of the City Council to
order at 7:36 p.m. on Tuesday, August 2, 1977, in the Council
Chamber of the City Hall.
2. The invocation was given by Pastor Leo DePalma, Temple City Christian
Center, 5319 N. Halifax Road.
3. The Pledge of Allegiance to the Flag was led by Mayor Merritt.
4. ROLL CALL:

Absent: Councilmen- Atkins, Greenberg

Councilman Tyrell moved to excuse Councilmen Atkins and Greenberg for
cause, seconded by Councilman Dennis and carried.
5. APPROVAL OF MINUTES:
Councilman Dennis moved to approve the minutes of the regular meeting
of the City Council held July 19, 1977, as written, seconded by Council-
man Tyrell and carried.
UNFINISHED BUSINESS:
6. ORDINANCE NO. 77 -450: 2nd read. CHANGE OF ZONE FROM R -1 TO C -2,
9934 E. Las Tunas
In the absence of two Councilmen, Ordinance No. 77 -450 was continued
to August 16, 1977 for second reading and adoption.
7. ACCEPTANCE OF WORK: ALLEY IMPROVEMENTS - EDA FUNDED, ALLEYS NORTH AND
SOUTH OF LAS TUNAS DRIVE, CASH CONTRACT 1222X
City Manager Koski presented background information, stating the work
under subject cash contract was completed June 29, 1977; Superintendent
of Streets Morhar has recommended that the work performed in the re-
construction existing alleys be accepted.
Councilman Tyrell moved to accept the work completed under Cash
Contract 1222X; authorize payment to E. C. Construction in the amount
of $17,453; authorize filing of Notice of Completion and release of
the 107 retention at the end of the 35 -day lien period, seconded by
Mayor Merritt and carried.
City Manager Koski presented background information, stating the Super-
intendent of Streets has requested approval and authorization of
additional work in connection with construction being performed under
Cash Contract 1225X by Norlund Construction Company; that sufficient
funds are available as the contract was $60,000 under the grant award;
the additional work is required to join the concrete drive aprons with
the existing asphalt concrete driveways on Oak Avenue and Golden West
Avenue.

Councilman Dennis moved to find the extra work has no significant
effect on the environment and to approve and authorize the additional
work outlined in Superintendent of Streets letter dated July 6, 1977,
seconded by Councilman Tyrell and carried.
9. PROJECT AGREEMENT: STATE, URBAN, AND COASTAL BOND ACT OF 1976 -
LIVE OAK PARK
City Manager Koski presented background information, stating the
City Council, at their regular meeting held April 19, 1977, adopted
resolution approving the application for 1976 State grant funds for
the construction of three tennis courts at Live Oak Park; an Environ-
mental Impact Report was prepared and certified by the City Council
November 2, 1976; the State Department of Parks and Recreation has
now submitted the Project Agreement for Council approval. When the
document has been executed, the City will be authorized to request
10% of the grant for costs in preparation of plans and specifications
which must be submitted to the State for approval. When the plans
and specifications have been approved by the State, the City will be
authorized to advertise for bids and request an addtional 807 of the
grant, the remaining 107 to be available upon completion of the project
and inspection by the State. Total funds available will be $93,439.
Councilman Tyrell moved to approve Agreement and authorize the Mayor
and City Clerk to sign, seconded by Councilman Dennis and carried.
10. APPROVAL OF FINAL TRACT MAP 32489 - 5323 & 5329 SANTA ANITA AVENUE
City Manager Koski presented background information, stating Tentative
Tract Map 32489 was approved by the City Council November 19, 1974;
an extension of time was granted twice for the Final Tract Map, each
time for a six month period; the proposed condominium will consist of
nine units; the development is consistent with the General Plan; the
Map has been checked by the City Engineer who recommends approval.
The Covenants, Conditions and Restrictions relating to this developmen
have been checked by the City Attorney and have been approved by him.
Councilman Dennis moved to approve the Final Tract Map 32489 and make
the findings 2(a) through (d) as set forth in staff memo dated
July 27, 1977 and on file in the City Clerk's office, and instruct the
City Clerk to certify the approval on the face of the map, seconded by
Councilman Tyrell and carried.
11. LOMA AVENUE SEWER PROJECT: AUTHORIZE PARTIAL PAYMENT FOR COMPLETION
OF WORK
City Manager Koski presented background information, stating the City
Council, at their regular meeting held May 3, 1977 conducted public
hearing and adopted resolution confirming assessment and ordering
rights -of -way acquired and improvement made on Loma Avenue (north of
Sereno Drive); contract was awarded to the lowest bidder and awarded
bonds to be issued to represent unpaid assessments. Council further
authorized the City Treasurer to transfer the sum of $9,600 from the
Reserve Fund to the Improvement Fund as a loan. The City Engineer, in
his letter dated July 29, 1977, has advised the work has been completed
and recommends that partial payment in the amount of $8,586 be paid
to the contractor.
Councilman Tyrell moved to authorize the City Treasurer to make partia
payment to the contractor in the amount of $8,586 against the Improve-
ment Fund, seconded by Councilman Dennis and carried.
12. ACCEPTANCE OF WORK: TRAFFIC SIGNAL INSTALLATION, ROSEMEAD BOULEVARD
City Manager Koski presented background information stating a traffic
signal was installed on Rosemead Boulevard midblock between Las Tunas
Drive and Broadway as a part of the improvement in the development of
the Community Redevelopment Agency's project; installation of the signal

within State right -of -way required approval from Caltrans who has ,
now found the signal to be satisfactorily completed to State standards
and specifications.
Councilman Dennis moved to accept the work completed under Cash
Contract TC 76 -05, authorize payment to the contractor in the amount
of $4,075.68, authorize filing of Notice of Completion, and release
of the 10% retention at the end of the 35 -day lien period, seconded
by Councilman Tyrell and carried.
13. WEST SAN GABRIEL VALLEY JUVENILE DIVERSION PROJECT: APPROPRIATION
OF FUNDS
City Manager Koski advised the Juvenile Diversion Project is entering
its fourth year and funds are no longer available from LEAA; City
Council, at an earlier study session agreed with continuing partici-
pation in the project provided all other member agencies agreed to
continue in the consortium; subject to the Project's final budget
approval, Temple City's allocation for administrative cost only will
be $6,757. Funds for the direct clinical services will be requested
upon the negotiation of contracts with service agencies and will be
brought back to City Council at a later date.
Councilman Tyrell moved to approve funds in the amount of $6,757 for
administrative costs only to continue the City's participation in the
Juvenile Diversion Project for one year and appropriate additional;
funds in that amount and amend the adopted budget accordingly, seconded
by Councilman Dennis and carried.
14. FIREWORKS STAND 1977 - REFUND OF DEPOSIT
City Manager Koski advised City Council, at their regular meeting
held July 19, 1977 approved refund of deposit to 11 organizations
and excepted refund to Job's Daughters Bethel #179, who had not
as yet removed the power pole. This has now been done and the site
cleared of all debris.
Councilman Dennis moved to authorize refund in the amount of $100
to Job's Daughters, seconded by Mayor Merritt and carried.
NEW BUSINESS:
15. RECOMMENDATIONS FROM PARKS AND RECREATION COMMISSION - Adjourned
Meeting of July 27, 1977
A. ATHLETIC FIELD LIGHTING
City Manager Koski presented background information, stating the City
Council, at their regular meeting held July 19, 1977, received a
recommendation from the Parks and Recreation Commission to accept the
offer from American Little League of Temple City to install lights on
the north ball field at Live Oak Park with volunteer labor and to make
available to the League, through an agreement, the sum of up to $12,000
for reimbursement of approved project funds. At that time Council took
no action as the free poles which were to have been received in time to
complete the project by August 4, 1977 were not available and the prior
urgency no longer existed. The matter was referred back to the Parks
and Recreation Commission for review and recommendation for a compre-
hensive lighting package. The Parks and Recreation Commission, at
their adjourned meeting held July 27, 1977, recommended to City Council,
based on the need for lighted athletic facilities, the north ball field
at Live Oak Park, the four tennis courts at Temple City High School, and
the three proposed new tennis courts at Live Oak Park be lighted for
night time use.
Councilman Tyrell stated he feels the City should have an agreement
with the school district that the lights will be used exclusively for
tennis as a condition to lighting the four tennis courts at the high

school. Councilman Tyrell further stated he would not be in favor
of lighting the three proposed new tennis courts at this time. In
his opinion the money would be better spent on another tennis court.
Councilman Dennis moved to continue this matter to September 6, 1977
for consideration by a full council, seconded by Councilman Tyrell
and carried.
B. OFFER OF DONATION: SOROPTIMIST INTERNATIONAL OF TEMPLE CITY
City Manager Koski advised the Parks and Recreation Commission receive
a request from Soroptimist International of Temple City wishing to
donate a park bench to the City for placement in Live Oak Park for
public use. They would like the bench placed in a temporary location
at this time and later relocated under the Deodor trees they donated
earlier, Parks and Recreation Commission, at their adjourned meeting
held July 27, 1977, moved to recommend to City Council to accept the
donation of a park bench.
Councilman Tyrell moved to accept donation as recommended by the
Parks and Recreation Commission, with appreciation, seconded by Council-
man Dennis and carried.
16. RENEWAL OF AGREEMENT: COMMUNITY RECREATION BETWEEN COUNTY OF LOS
ANGELES AND CITY OF TEMPLE CITY
City Manager Koski advised the Los Angeles Department of Parks and
Recreation submitted agreement for renewal of agreement to conduct
after school, holiday and vacation recreational services for the
fiscal year 1977 -78 as a part of City's recreation program on the
grounds of Emperor School.
Councilman Tyrell moved to renew agreement for Community Recreation
Program between the City and the County of Los Angeles for fiscal
year 1977 -78 and authorize the Mayor and City Clerk to sign, seconded
by Councilman Dennis and carried.
17. AMEND ORDINANCE NO. 74 -390: ESTABLISHING PERMIT INSPECTION FEES
City Manager Koski presented background information, stating the City
Council, at their regular meeting held August 20, 1974, adopted
ordinance amending fee schedule relating to costs of issuance of per-
mits and inspection for work within public right -of -way. During the
past year staff has experienced a problem with both commercial and
residential properties wherein the permit fee has not covered reim-
bursement of costs in connection with driveway closures, sidewalks
or fill -ins, and curb and gutter inspections, and recommend adoption
of an ordinance to allow for change of fees by resolution.
City Attorney Martin introduced Ordinance No. 77 -451 AN ORDINANCE OF
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ESTABLISHING PERMIT IN-
SPECTION FEES BY RESOLUTION for first reading by title only. Council-
man Tyrell moved to waive further reading, seconded by Councilman
Dennis and carried.
Council directed staff to prepare a comprehensive report regarding
permit inspection fees to include typical costs, the amount of public
improvements performed in the residential area and commercial projects
and the extent of work undertaken by the City which precludes the
necessity of the property owner applying for a permit.
18. LIVE OAK AVENUE, BALDWIN AVENUE TO EASTERLY CITY BOUNDARY - COOPERATIVE
IMPROVEMENT PROJECT, CITY OF ARCADIA AND CITY OF TEMPLE CITY
City Manager Koski advised staff had solicited participation in a
cooperative effort with the City of Arcadia in the construction of
improvements on Live Oak Avenue, within the subject limits, and Arcadia
has indicated concurrence in a joint project with Temple City. The

City of Arcadia will be assuming the assessment of costs for curb
and gutter and sidewalk on the north side of Live Oak Avenue within
its jurisdiction; in the past, our City has initiated Chapter 27
petitions on select system streets, such as Encinita Avenue and Longden
Avenue, wherein property owners participate in the cost of curb,
gutter and driveway aprons and joins for improvements constructed in
front of their property. The City Council may wish, at this time, to
consider whether Temple City will assume the costs for all of the
improvements or if Chapter 27 petitions are to be initiated for
circulation among property owners.
Councilman Tyrell moved to continue the matter to September 6, 1977
for consideration by a full Council, seconded by Councilman Dennis
and carried.
19. AMEND CONTRACT RE: TRAFFIC SIGNAL MAINTENANCE SERVICES
City Manager Koski advised the City received notification from Signal
Maintenance, Inc. of legal merger with TSM, with Signal Maintenance, Inc.
being the surviving company. As a result SMI is assuming all contract-
ual obligations of TSM whose current contract with the City of Temple
City runs to August 5, 1980.
Councilman Tyrell moved to approve and authorize the City Clerk to
acknowledge the merger, seconded by Councilman Dennis and carried.
20. LOCAL AGENCY -STATE AGREEMENT NO. 07 -5365 (FEDERAL AID HIGHWAYS PROJECTS)
City Manager Koski advised the City has received a new agreement from
the State Department of Transportation which provides for all future
federal aid projects in the City. This agreement replaces the agreement
approved by City Council at their regular meeting held January 6, 1976.
Councilman Tyrell moved to adopt Resolution No, 77 -1658 A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING AND AUTHORIZING
THE EXECUTION OF LOCAL AGENCY -STATE AGREEMENT FOR FEDERAL -AID PROJECTS,
seconded by Councilman Dennis and carried.
21. RESOLUTION NO. 77 -1656: WARRANTS & DEMANDS, DEMAND NOS. 7142 THRU
7244 IN THE AMOUNT OF $216,148.39
Councilman Dennis moved to adopt Resolution No. 77 -1656 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND
DEMANDS IN THE SUM OF $216,148.39, DEMAND NOS, 7142 THRU 7244, seconded
by Councilman Tyrell and carried.
22. COMMUNICATIONS:
A. Request for Encroachment Permit - 5702 Encinita Avenue
City Manager Koski presented a communication received from property
owner at 5702 Encinita Avenue requesting an encroachment permit for
a curb to be installed adjacent to the sidewalk to minimize the slope
of the property following the recent installation of sidewalk by the
City, all at property owners' expense.
Councilman Dennis moved to approve request and authorize staff
approval of similar public works improvements, this type of improve-
ment not warranting the formality of an encroachment permit, seconded
by Councilman Tyrell and carried.
B. Request to Paint House Numbers on Curbs -
City Manager Koski presented a request from Tom Best and Steven
Sanchez for permission to paint resident house numbers on curbs in
the City.
Councilman Dennis moved to approve request subject to their obtaining
the required Public Works permit, seconded by Mayor Merritt and carried.

C. Tree Removal Request - Bogue Street, between Baldwin and Glickman
City Manager Koski presented petition from property owners on the
north side of Bogue within subject limits for the removal of Modesto
Ash trees. Over the past several years, the City has experienced
problems in that the trees have caused curb, gutter and driveway
damage, eruptions of the street, sprinkler, sewer and lawn damage,
and limb breakage. Estimated cost for removal and replacement of
the trees is approximately $7,000. If Council desires removal and
replacement of the trees, they may wish to replace them in a manner
similar to Broadway where they are phased out over a period of time.
Those residents in favor of this request represent 52.6% of the
property owners within subject limits.
Councilman Tyrell moved to continue the matter to September 6, 1977
for discussion by a full Council, seconded by Mayor Merritt and
carried.
23. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK:
Glen Hiler, 6013 N. Camellia Avenue, stated the City maintenance man
will not allow his friends and himself to play fleece ball in Temple
City Park because games with propelled objects are not allowed in
that park. Glen showed the soft ball to Councilmembers and asked for
a four -foot square dirt spot for a batting area.
Parks and Recreation Director Kobett advised Council the Commission
heard the boys' request at their regular meeting held July 20, 1977
and the Commission indicated they would uphold Section 3567 of the
Municipal Code and not set aside an area in Temple City Park for
ball playing.
Scott Osten, 6052 N. Camellia Avenue, stated they sometimes have only
an hour for play and it takes 15 to 20 minutes to ride to Live Oak Par
Anthony Reddin, 6035 Kauffman Avenue, stated the ball is soft and does
not propell very far and could not interfere with other people using
the park.
Jay Hiler, 6013 N. Camellia Avenue, said if they can't play in the
park, they would have to play in the street; that some of their mothers
do not want them going all the way to Live Oak Park.
Councilman Tyrell advised the boys there are school grounds and Live
Oak Park for such activities and the older generation in the City
should have a place to sit and read without flying objects to be con -
cerned about.
Councilman Dennis stated this type of activity occasionally would not
create a problem, however on a regular basis it detracts from the
intentional use of the park and there are school grounds and Live Oak
Park for these specific purposes.
Pete Hiler, 6013 N. Camellia Avenue, father of two of the boys, stated
he has seen older boys playing frisbee in the park; that parks are for
children to play in; he does not want his children going to Live Oak
Park to play.
Council advised the City sponsors a recreation program'at Live Oak Par
and school grounds all over the city for after school and summer
activities, and also suggested they ask permission to play on the
Pacific Ackworth grounds which is quite close to their homes, and
stated Temple City Park would continue to be maintained as a park for
senior citizens, young tots and other quiet activities.
Mrs. Marianne Milch, Manager, Temple City Chamber of Commerce, invited
Council to attend the Chamber luncheon to be held August 11, Tiffany's
Restaurant; speaker will be Jack Kelley on EXPO 81.

Mr. Boyce O'Bannon, 10316 Olive Street, presented Council with petitions
for the property tax initiative designed by People's Advocate, and
requested they study the petition and endorse it in principle.
RECESS TO CRA:
The City Council recessed at 8 :36 p.m. to meet as the Conuuunity Redevelopment
IAgency, Mr. Atkins and Mr. Greenberg being absent; approved the minutes of the
regular meeting held July 19, 1977; and approved the exterior design for the
store front of the King Arthur's Restaurant in the Rosemead Boulevard Rede-
velopment Project area as shown on Exhibit "A -1 "; and adopted a resolution
adopting a rule of parliamentary procedure.` The minutes are set forth in
full in the records of the Agency.

25. MATTERS FROM CITY OFFICIALS:
A. Designation of Alternate to JPA
On motion by Councilman Dennis, seconded by Mayor Merritt and carried,
Councilman Tyrell, as alternate to the California Contract Cities
Association, was named alternate to the Southern California Joint Powers
Insurance Authority. Also named as alternates were staff members Karl
L. Koski and Leonard Biel.
B. Resolution No. 77 -1657: Adopting a Rule of Parliamentary Procedure
Councilman Tyrell moved to adopt Resolution No. 77 -1657 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ADOPTING A RULE OF
PARLIAMENTARY PROCEDURE, seconded by Councilman Dennis and carried.
C. City Manager Koski advised the City Attorney has prepared new
regulations for processing Environmental Impact Reports as a result
of recent changes in CEQA requirements which will be forwarded for
Council review prior to the August 16, 1977 meeting.
D. Councilman Tyrell complimented Little League for the fine job they
are doing in preparing Live Oak Park for the upcoming tournament.
E. Councilman Dennis stated the state rental assistance program for
senior citizens has not been publicized sufficiently and requested
staff contact Temple City Times regarding dissemination of information
so that those residents eligible will have the information prior to the
August 31 filing deadline.
F. Mayor Merritt commended the boys for bringing their problem relating
to park use to the Parks and Recreation Commission and the City Council.
26. ADJOURNMENT:
On motion by Councilman Tyrell, seconded by Councilman Dennis meeting
adjourned at 8:48 p.m. Next regular meeting of the City Council will
be held Tuesday, August 16, 1977, 7:30 p.m.in the Council Chamber of
the City Hall.
