CITY OF MEDINA
RESOLUTION NO. ca,2—%'j1-
RESOLUTION APPROVING A CONDITIONAL USE
PERMIT FOR HOLY NAME OF JESUS CATHOLIC CHURCH
WHEREAS, the Reverend Arnold Weber, pastor of. Holy Name of
Jesus Catholic Church has requested approval of a conditional
use permit to allow the expansion and construction of class-
rooms, gymnasium, parking, liturgical and social functions
on property owned by the church and legally described as set forth
on Exhibit A which is attached hereto and made a part hereof by
reference; and
WHEREAS, the matter was heard by the Medina Plannj.ng Commis-
sion on June 8, 1982, and pursuant to suggestions of the Commission,
revised plans were submitted which are attached hereto and made a
part hereof by reference as Exhibit B;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Medina that the Holy Name of Jesus Catholic Church is
hereby granted a conditional use permit, subject to the following
conditions:
1. Construction and development of the project shall proceed
in accordance with Exhibit B and the minutes of the Medina City
Council meeting dated July 6, 1982, and this resolution;
2. That the portion of the church property lying South of
County Road 24 be combined and divided into two parcels;
3. That the church convey easements for street and utilities
purposes to the City of Medina for Brockton Lane and for Holy Name
Drive as .recommended by the City Engineer;
4. That the access from County Road 24 to the church property
which lies South of County Road 24 and which access is described
in the letter from Hennepin County dated June 1.8, 1982 be closed;
that access from County Road 24 to the church property lying South
of County Road 24 at the two remaining locations as shown on Exhibit
B be continued and maintained; that access from Brockton Lane to
the church property lying South of County Road 24 be opened and
maintained to provide access to the new parking area; that
appropriate traffic and vehicular signs and controls be designed
by the City Engineer and installed at the expense of the church;
5. That asphalt surfacing of the proposed new parking lot
be deferred for a period of one year to allow a study of the
church's need for parking and that the parking lot be surfaced
with gravel in the interim, with the exception that the Easterly
50 feet of the driveway to Brockton Lane be finished with asphalt
surfacing;
6. That the City Engineer conduct a study of the stacking
and turning movements on Brockton Lane and report back to the
City Council within one year on recommendations, if necessary,
for handling stacking and turning movements, including the possi-
bility of widening of Brockton Lane to provide for additional
lanes of traffic; that the church pay the cost of the engineering
study and the construction costs of any improvements which are
reasonably required;
7. That all grading base and surfacing for parking lots,
streets, driveways, drainage corrections and other associated
construction be subject to specifications as set out by the City
Engineer;
8. That no parking be permitted on County Road 24 beginning
on the date of this resolution, and that no parking be permitted
on the church property North of County Road 24 after construction
of the new parking lot, with or without asphalt surfacing;
9. That prior to a decision by the church to raze, remove
or discontinue maintenance of the existing church structure, the
church shall give the City 180 days notice and thereafter cooperate
with the City in any efforts it may make to preserve the church
as a historic landmark;
10. That regular school bus traffic use the permitted access
points from County Road 24 only, for ingress and egress to the
church property lying South of County Road 24;
11. That any changes in the sewer agreement between the
cities of Plymouth and Medina dated October 17, 1977 be initiated
by the church and approved by both cities;
12. That the church enter into a development contract to
insure the construction of the project in accordance with the
plans approved;
13. That the church reimburse the City for all engineering,
legal and administrative costs incurred by the City to date and
to be incurred by the City in the future in furtherance of the
project, said costs to date to include the following:
