MOORCROFT PLAT WHEREAS, United Way of Minneapolis Area, a Minnesota corporation, , and Gerald H. Guetzkow and Mary Guetzkow have requested approval of the plat of Moorcroft, Hennepin County, City of Medina, Minnesota; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina hereby approves the plat of Moorcroft subject to the following conditions: 1. The property owned by Elizabeth Dovydenas, as shown on the preliminary plat, shall be excepted from the plat and combined with adjacent land outside the plat; 2. The subdivider shall pay a park dedication fee of $6,000.00; 3. A Declaration of Covenants and Easements shall be approved by the City Attorney and Zoning Administrator; 4. The Developer shall construct the roads, land developments, drainage measures, erosion controls and other improvements according to the plat on file with the City of Medina and the minutes of all council meetings applicable to plat approval, and shall make no modification thereto without the consent of the Medina City Engineer. All development shall conform to the requirements of the letters of the City Engineer dated October 8, 1981 and June 21, 1982. The development shall further conform to the requirements of the letter of the Hennepin Soil Water Conservation District dated November 19, 1981. 5. The subdivider shall enter into a Private Road Agreement as approved by the City Attorney; 6. The subdivider shall enter into a Development Contract and Performance Bond and Agreement in a form approved by the City Attorney; 7. The subdivider shall provide to the City Attorney, an Abstract of Title continued to date, or a Certification of Title approved by the City Attorney; 8. Construction of the subgrade, base and gravel surface of Oakview Lane shall be completed on or before October 31, 1982, provided that no more than three building permits will be issued until the asphalt surface is completed and the street is accepted by the City, said completion of the asphalt surfacing to be done prior to October 31, 1983; 9. The subdivider shall be responsible for all street mainten- ance including snow plowing until Oakview Road has been accepted by the City; and 10. The subdivider shall conform in all respects to the Medina subdivision Regulations and the Medina Zoning Code. 11. The Developer shall seal -coat the paved surfaces of all public streets in accordance with City standards within five years after final completion of the said public streets at a time determined by the City Council upon advise of the City Engineer. The Developer shall pay fifty percent (50%) of the costs of such seal -coating and shall provide a performance bond to guarantee performance. 12. The Developer shall permit no damage to that portion of Tamarack Drive which abuts the plat as a result of the construc- tion of a subdivision and the dwellings thereon; in the event such damage does occur, the Developer shall repair and correct the damage in accordance with the recommendations of the City Engineer and shall pay the cost thereof. 13. Four intersection lights shall be installed and the design and annual cost of intersection lighting shall be subject to the approval of the City Council. 14. No dwelling shall be constructed on the easterly one-half of Lot 2, Block 3, Moorcroft. 15. The site of the drain field on each lot shall be identified by the Developer and protected from vehicular traffic and the movement of construction equipment. 16. The Developer shall reimburse the City for all engineering, legal and administrative costs incurred by the City to date on this project and for all such costs incurred in the future. Costs incurred to date shall be paid prior to the release of the plat and shall include the following: up to and including May 1982 Engineer $565.00 Attorney $364.50 17. The City of Medina reserves the right to have its Engineer make periodic visits to the site during construction to insure performance with plat approval, and with all covenants, agree- ments and construction criteria. Prior to final acceptance of the work by the City, the City Engineer shall perform the final inspection. 18. Traffic controls and street signs shall be approved by the City Engineer and installed at the expense of the Developer.
