RIVERSIDE COUNTY TRANSPORTATION COMIVIISSION
DATE: September 8, 1993
TO: Riverside County Transportation Commission
FROM: Jack Reagan, Executive Director
SUBJECT: Acceptance of Quit Claim Deed for San Jacinto Branch Line @ Lyon Street
to Accommodate Hemet Flood Control Project
During its June meeting, RCTC approved a license agreement with the City of Hemet for
construction of a drainage structure (5' x 4' Box) within the San Jacinto Branch line right-
of-way. Since that meeting, it has come to staff's attention that Lyon Avenue crosses the
San Jacinto Branch line in an area that was not obtained in fee from Santa Fe. An
easement for certain section of the branch line was granted to RCTC by Santa Fe. The
property at Lyon Avenue was taken as an easement rather than fee title until such time
as the completion of a phase 2 environmental study on the easement sections. Based
upon RCTC's action, Hemet advertised and awarded a construction contract. Santa Fe,
as still the owner in fee of Lyon Avenue, has indicated that in order for Santa Fe to grant
a License to the City of Hemet they would need to go through the normal review
procedure to approve the license agreement. This process usually takes months and
would result in significant delays to the City of Hemet.
Santa Fe is willing to provide a Quit Claim Deed for the property required for the flood
control license agreement from Hemet. This would mean some minimal risk since the
phase 2 environmental assessment has not been completed, but would resolve the
problems with Hemet.
Staff Recommendation:
To accept Santa Fe's Quit Claim Deed.
