RESOLUTION AUTHORIZING SETTLEMENT OF WORKERS'
COMPENSATION ACTION
WHEREAS, the matter of Brain Mickley v. The Borough of Carteret, C.P. No.:
98-003675 (3/31/98/) is presently pending in the New Jersey Worker's
Compensation Court; and
WHEREAS, the attorney representing the Borough in said action as well as the
Borough' s Workers' Compensation Administrator, Allied Risk Services, has
recommended settlement of this case under Section 20 of the Workers'
Compensation Act; and
WHEREAS, the Governing Body has reviewed the recommendation of its Attorney
and Worker's Compensation Administrator and has determined that settlement of the
above matter is in the best interest of the Borough.
NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the Borough
of Carteret that Section 20 settlement of aforementioned Workers' Compensation
action in accordance with the terms as set forth in the correspondence of the
Borough's Attorney, Biancamano & DiStefano, dated September 4, 2001 is hereby
approved.
BE IT FURTHER RESOLVED that a copy of this Resolution shall be forwarded
to Glenn A. Savarese, Esq. of Biancamano & DiStefano and to David Russo of
Allied Risk Services.
BE IT FURTHER RESOLVED that the appropriate Borough Officials are hereby
authorized to effectuate the terms of the settlement.
Adopted this 4th day of October, 2001 and
certified as a true copy of the original on
October 5th, 2001.
