HomeMy Public PortalAbout1982-027" " Member cia liarn ��"3"- introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. ��- 7 RESOLUTION APPROVING AN AMENDMENT TO THE LONG LAKE-ORONO-MEDINA SANITARY SEWER CONSTRUCTION AND SERVICE AGREEMENT WHEREAS, the Long Lake -Orono -Medina Sanitary Sewer Construction and Service Agreement dated August 10, 1981, contains a formula for the payment of Approved Easement Costs for Pipe D and a formula for the payment of Maintenance and Operation Costs; and WHEREAS, pursuant to the said agreement, the City of Medina, as the lead agency, acquired from Burlington Northern, a permit for the installation and operation of a raw sewage pipe line and metering station, permit No. 238,112, dated September 1, 1981; and WHEREAS, the Burlington Northern has established an annual fee of $750.00 for the permit; and WHEREAS, the Long Lake -Orono -Medina Sanitary Sewer Construction and Service Agreement is unclear on the formula for the division of this annual fee among the three cites; and WHEREAS, the Mayors of the three cities met pursuant to Section 17, Subd. 1 of the said agreement and reached a settlement on the question of the division of the said fee as follows: 1. During the three year period commencing September 1, 1981, and ending on August 31, 1984, the Burlington Northern annual fee shall be paid, 63.6% thereof by the City of Orono and 36.4� thereof by the City of Medina. 2. Thereafter, each city shall pay a proportion of the annual permit fee equal to its Usage Factor multiplied, times the total annual permit fee. 3. For purposes of this settlement the term Usage Factor is defined as follows: , a. For the City of Medina, the Usage Factor is the ratio which Medina's "total flow of sewage" as defined in Section 13, paragraph 1 of the Agreement bears to the aggregate "total flow of sewage" as de- fined for each city in Section 13, para- graphs 1, 2 and 3, expressed in per centum calculated to the nearest 100th of 1 per centum. b. For the City of Orono, the Usage Factor is the ratio which Orono's "total flow of sewage" as defined in Section 13, paragraph 2 of the Agreement bears to the aggregate "total flow of sewage" as de- fined for each city in Section 13, para- graphs 1, 2 and 3, expressed in per centum calculated to the nearest 100th of 1 per centum. c. For the City of Long Lake, the Usage Factor is the ratio which Long Lake's "total flow of sewage", as defined in Section 13, paragraph 3 of the Agreement bears to the aggregate "total flow of sewage" as de- fined for each city in Section 13, para- graphs 1, 2 and 3, expressed in per centum calculated to the nearest 100th of 1 per centum. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, that the foregoing settlement is hereby approved pursuant to Section 17, Subdivision 1 of the Long Lake -Orono - Medina Sanitary Sewer Construction and Service Agreement.
