Dear Custodian of Records,
I recently requested records related to Mr. Skip Randolph's comment at the Dec. 24, 2015 Code
enforcement hearing regarding complaints the Town has recently received about the roof on my
home. Specifically I asked:
What complaints have been received by the Town in regard to the roof currently under
construction at 2520 Avenue An Soleil? May I have this record to present to the Special
Magistrate at hearing progress?
You responded:
Please be advised that there are no such records. All complaints were verbal.
I wish to expand my request of records related to this matter. Please provide the following
records for my inspection:
Any record that relates to the verbal complaints received by the Town and further
communicated to the Town Attorney. Records to include but not be limited to notes, phone
logs, memos, emails itemized phone bills or any record created to memorialize the
communication of each complaint and/or communicate that complaint to the Town
Attorney.

For some time now you have been responding to my requests to inspect public records with a "boiler plate" standardized
response. Regardless of the time, the circumstances, the simplicity of the request or any other variable condition that is unique
to the request or unique to the time you receive the request, you many times respond as follows:
The Town of Gulf Stream is currently working on a large number of Incoming public records requests. The Town will
use its very best efforts to respond to you in a reasonable amount of time with the appropriate response or an
estimated cost to respond.
Given the unique circumstances surrounding each request, the actual number of requests that you consider to be a "large
number" must vary from request to request. Since the length of time you consider to be "a reasonable amount of time"may be a
function of the specific number of requests you are working on at the time each new request is received, your statement that
you will respond in a reasonable amount of time is not very informative as to when you will actually respond.
I consider it a mandatory regulation of Florida Statute 119.07(1 xa) that you shall permit the record to be inspected and copied
by any person desiring to do so, at any reasonable time, under reasonable conditions. Your "boiler plate" standardized response
Is not a reasonable condition.
Your "boiler plate" standardized response is not responsive to my request and, if not deliberately misleading, at best it is
fuliginous, unclear, and ambiguous.
Please consider this email to be yet another attempt by me to inspect this record as per Article 1. Section 24 of the Florida
Constitution and Chapter 119 of the Florida Statutes.
Your timely response will be most appreciated.
