HomeMy Public PortalAbout2001.082 (08-21-01)CITY OF LYNWOOD LOS ANGELES COUNTY, CALIFORNIA RESOLUTION NO 2001.082 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD MODIFYING THE REPORT OF THE ADVISORY BOARD FOR FISCAL YEAR 2001-2002 IN CONNECTION WITH THE LYNWOOD PARKING AND BUSINESS IMPROVEMENT DISTRICT WHEREAS, the City of Lynwood ("City") is a general law city organized and existing under the laws of the State of California; and WHEREAS, pursuant to the Parking and Business Improvement Area Law of 1979, former Part 6 (commencing with Section 36500) of Division 18 of the California Streets and Highways Code, the City Council adopted Ordinance No. 1262 establishing a parking and business improvement area; and WHEREAS, the Parking and Business Improvement Area Law of 1979 was repealed and replaced with the Parking and Business Improvement Area Law of 1989 (California Streets and Highways Code Sections 36500, et seg.) (the "Law"), which provides that every improvement area established prior to January 1, 1990, in accordance with the Parking and Business Improvement Area Law of 1979 is valid and effective and is unaffected by the repeal of that law; and WHEREAS, the City's parking and business improvement area includes all of the territory within the exterior boundaries of the City, as the same existed on the date of adoption of Ordinance No. 1262; and WHEREAS, the Law requires that the City Council appoint an advisory board for the City's parking and business improvement area and annually undertake proceedings to levy a charge (assessment) against every business enterprise located therein; and WHEREAS, by a previous resolution, the City Council established an Advisory Board for the City's parking and business improvement area and directed the Advisory Board to prepare a report for fiscal year 1999-2000. WHEREAS, on June 13, 2001 the Parking and Business Improvement District Advisory Board met to discuss and made recommendations pertaining to the Parking and Business Improvement District 2001-2002 Fiscal Year as follows: Lynwood Chamber of Commerce City ofLynwood Total $ 52,500.00 $ 52,500.00 $105,000.00 WHEREAS, at their regularly scheduled meeting of July 3, 2001 the City Council authorized the conduction of a Public Hearing on August 7, 2001 to receive community input on said recommendations. WHEREAS, the Public Hearing was advertised as required, and WHEREAS, at their regularly scheduled meeting of August 7, 2001 the Crty Council of the City of Lynwood determined to carry over conduction of the Public Hearing until their regularly scheduled City Council Meeting of August 21, 2001, i :, ~' WHEREAS, the Public Hearing to receive public input was held at the regularly scheduled meeting of the City Council on August 21, 2001, and WHEREAS, upon the completion of the Public Hearng the City Council determined to direct all Parking and Business Improvement Funds to the City of Lynwood for purposes including, but not limited to paying a portion of the existing agreement with the Lynwood Chamber of Commerce as well as providing financial support to the City's effort to promote business acquisition and improvement m the Crty of Lynwood. WHEREAS, this report was presented to the City Council on August 21, 2001. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL AS FOLLOWS: Section 1. In accordance with the directives of the City Council, the Advisory Board prepared a report for fiscal year 2001-2002 in connection with the City's parking .and business improvement area, and that report was filed with the City` Clerk and presented to the City Council for consideration at its regular meeting held on July 3, 2001. Section 2. Approve the following allocation for the P.B.I.D. funds upon completion of a Public Hearing on August 7, 2001. City of Lynwood Lynwood Chamber of Commerce $ 52,500.00 $ 52,500.00 $105,000.00 These allocations are to be expended solely for the purposes authorized by State law, all of which are identified m the report: The report does not propose any changes m the boundaries of the parking and business improvement area, the basis and method of (..._.' levying the assessments, or the classification of businesses. There are no surplus or deficit revenues to be carned over from the previous fiscal year, and no contributions are to .be made from sources other than the assessments. Section 3.
