HomeMy Public PortalAbout1983-004Member avvvu- ��� introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 0 .5- 4 SULLIVAN SUBDIVISION WHEREAS, Phillip Sullivan has requested approval of his subdivision application for, property at 2382 Highway 55 in the City of Medina; and WHEREAS, the subdivision would create two lots of 10.74 acres and 3.27 acres, respectively; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina that the Phillip Sullivan Subdivision application to divide the following described property: That part of the West 918.12 feet of the Northwest 1/4 of the Southwest 1/4 of Section 3, Township 118, Range 23, lying Northerly of State Trunk Highway No. 55, Hennepin County, Minnesota is hereby approved subject to the following conditions: (1) That the owners of the property described above will grant to the City a 30 foot easement along the northerly property line for road and utility purposes on Chippewa Road. (2) The owners will furnish the City a survey indicating the location of the existing septic system site on the 3.27 acre lot. (3) The driveway to be constructed on the 10.74 acre lot will be located at a site 200 feet to the east of the property line dividing the two lots, in conformity with plans submitted to the City. (4) The subdivider shall conform in all respects to the Medina Zoning Code and Subdivision Regulations. EASEMENT THIS EASEMENT is made this day of , 1983, between Philip E. Sullivan and Jennie Sullivan, husband and wife, of the County of Hennepin, State of Minnesota, parties of the first part, and the City of Medina, a municipal corporation under the laws of the State of Minnesota, party of the second part; WITNESSETH, that the said parties of the first part, in consideration of the sum of One Dollar and other good and valuable consideration, to them in hand paid by the said party of the second part, the receipt of which is hereby acknowledged, do hereby convey unto the said party of the second part, its succes- sors and assigns, an easement upon that tract of land in the County of Hennepin and State of Minnesota, described as follows, to -wit: A permanent easement for street and utilities purposes over, across, and under that part of the West 918.12 feet of the Northwest 1/4 of the Southwest 1/4 of Section 3, Township 118, Range 23, lying Northerly of State Trunk Highway No. 55, Hennepin County, Minnesota, legally described as follows: The North 30 feet of that part of the West 918.12 feet of the Northwest 1/4 of the Southwest 1/4 of Section 3, Township 118, Range 23, lying Northerly of State Trunk Highway No. 55, Hennepin County, Minnesota IN TESTIMONY WHEREOF, the said parties of the first part have hereunto set their hands the day and year first above written. 1,4 t , k' . - I.
