HomeMy Public PortalAbout1977-06-28 Meeting283 June 28, 1977 The Council of Bal Harbour Village met Tuesday, June 28, 1977, at 9:30 A.M. in the Village Hall. Present were: Messrs. Beatty, Davis, Krez and Printup Absent: Mr. Taplin Also present were Fred W. Maley, Village Manager; Betty Carver, Deputy Village Clerk; and Mr. Byron Peterson, Attorney, sitting in for Mr. Alan Gold, Village Attorney. After the correction to the minutes of April 26, 1977, was read, it was moved by Mr, Beatty, seconded by Mr. Krez, and voted that the minutes of the meetings of April 26, as amended, May 31, and June 14, 1977, be approved. In accordance with State law, public hearing dates on Ordinance 193, amending Bal Harbour Village Comprehensive Zoning Ordinance as it pertains to the Oceanfront District, were set for 5:15 P.M. on Thursday, July 7, 1977, and 5:15 P.M., Thursday, July 21, 1977. The Deputy Clerk was instructed to advertise the meetings. Mr. Maley stated that Mr. von Oesen had met with the low bidder on the beach access improvements, PNM Corporation. Mr. von Oesen's cost estimate for the job was $119,704, with the low bid being $143,900. Mr. von Oesen is of the opinion that this price can be brought more in line with the cost estimate by the issuance of change orders, which would reflect a reduction in costs to the contractor, and would be passed on to us. The other alternative would be to "throw out" the bids received and re -bid the job. It is recommended by Mr. Maley and Mr. von Oesen that a contract be signed with PNM Corporation. It was moved by Mr. Davis, ,seconded by Mr. Krez, and voted, that the contract with PNM Corporation be signed. '_ It was moved by Mr. Davis, seconded by Mr. Beatty and voted, that Mrs. Joanne McAdam be appointed as the Bal Harbour Village representative to the "Four on the Bay" Commission on the Status of Women. Messrs. John Small and Richard Schlacter of Florida Power & Light Company were present to advise the Council on the progress of the upgrading of the power service in the Residential District. Mr. Small stated that they had received all of the easements necessary for the work, that the work will take approximately two more months, and that FP&L is spending approximately $1/4 'million on the work. In answer to a question from Mr. Krez, Mr Small explained that they will, leave the existing vaults and install new, pad mounted vaults along side of the old vaults. The new vaults will contain only the splicing and the switches, plus "fault current indicators" which will indicate which phase goes out. He stressed that they were not replacing all of the cable, as that would require outages of 24 hours or more at a time. He further stated that as the old equipment fails, they will replace it. Mr. Maley explained that in the overall master plan for beautification of Collins Avenue there is a park to be built on the north of the bank, between Collins Avenue and Harding Avenue. Last year the Council authorized plans be drawn up for the park, which are approximately 90•% complete. Mr. Maley stated that the granite used for the sidewalks, and proposed for the fountain area of the park, is no longer available, but that a Miami firm has a supply on hand. He further stated that the cost estimate for the completion of the park is approximately $150,000. Mr. Davis stated that he did not feel that the completion of the park would add that much to the area, and moved that the matter be tabled for at least one year. The motion was seconded by Mr. Beatty and unanimously voted. Z 34 Mr. Maley stated that he had received the new Dade County Financial Disclosure Ordinance containing three separate forms for use. The County ordinance requires that financial disclosure be filed by July 15th, and that the new State form is not ready, as it is being modified. Mr. Davis asked which the Council must comply with - the County Ordinance or the State, and which forms must be filed. Mr. Peterson stated that he would write an opinion on the matter before the deadline of July 15. There being no further business, on motion of Mr. Davis, seconded by Mr. Krez, the meeting was adjourned at 10:30 A.M. ATTEST: Village clerk June 28, 1977 PUBLIC HEARING July 7, 1977 Mayor A Public Hearing was held at 5:.5 P.M., Thursday, July 7, 1977, in the Council chambers of the Bal Harbour Village Hall for the purpose of discussion of Ordinance No. 193, amending the zoning code of Bal Harbour Village as it pertains to the Ocean- front District. Present were: Messrs. Beatty, Davis and Printup Absent were: Messrs. Krez and Taplin Also present were Fred Maley, Village Manager, and Betty Carver, Deputy Village Clerk. Mayor Printup convened the Public Hearing. The Village Manager explained the pertinent features of the proposed zoning changes, and comments were requested from those present. A question was presented from the floor asking if, under the new proposed zoning, a property owner would be permitted to construct a separate garage building on the property. Mr. Maley advised that parking may be constructed in the Oceanfront District only as an accessory use to the principal building.
