CITY OF MEDINA
RESOLUTION NO.
RESOLUTION GRANTING CONDITIONAL USE PERMIT TO
WILLIAM NUNN - CAREY RADTKE TO OPERATE A HORSE STABLE
ON WILLOW DRIVE.
WHEREAS, William Nunn and Carey Radtke, husband and wife,
have applied for a conditional use permit to operate a horse
stable at 2825 Willow Drive in the City of Medina; and
WHEREAS, a conditional use permit is required by the
Medina Zoning Ordinance for the operation of a horse stable;
and
WHEREAS, the use of the land will not impede the normal
and orderly development of the property in the area and is
consistent with the purposes of the Zoning Code and the Rural
Residential Zoning District;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of Medina, that a conditional use permit be granted to
William Nunn and Carey Radtke to operate a horse stable at 2825
Willow Drive, the legal description of said property attached
hereto as Exhibit A, upon the following terms and conditions:
1. The maximum number of horses permitted at the stable,
including the paddock and stable areas, shall not
exceed 28 horses.
2. Indoor bathroom facilitiesoshall be provided to
accommodate the customers and employees of the
stable. The City may require additional, temporary
bathroom facilities for any special event at the
stable.
3. The City of Medina will be notified at least two
weeks prior to any special event at the stable. For
the purposes of this permit, "special even" means
any activity which is expected to generate more
traffic or noise than the u ua business practice of

4. Driveway and parking areas will be constructed to
accommodate all trailers and vehicles brought onto
the property. Plans of said driveway and parking
areas must be submitted to and approved by the City
Engineer prior to construction.
5. The operators of the stable shall enter into an
agreement with the Minnesota Pollution Control
Agency to govern the terms of disposal and collection
of horse manure. Manure accumulated through operation
of the stable shall be stored in areas designated or
approved by the Minnesota Pollution Control Agency.
Manure shall be removed from the stable at a minimum
of once every six months. The operators shall also
enter into and provide the City with a written
agreement governing the off -site disposal of manure.
6. A bond, in the amount of $13,200, shall be furnished
to the City to guarantee removal of the manure
accumulation on the site.
7. The hours of operation of the horse stable shall be
9:00 a.m. to 9:00 p.m., Tuesday through Sunday.
8. The operators of the stable shall post, in a location
accessible to all persons using the stable, the
Medina Horse Owners' Association Rules.
9. The operators of the stable are responsible for
informing and controlling the customers using the
stable to prevent trespassing without permission on
adjoining property.
10. The operators of the stable shall comply with all
provisions of the Medina Zoning Code.
The violation of any of the conditions of this conditional use
permit shall constitute a misdemeanor, and upon conviction
thereof, the violator shall be subject to a fine of not more
than five hundred dollars ($500.00) or imprisonment for a term
not to exceed ninety (90) days or both. The violation of any
of the conditions of this conditional use permit shall also
constitute grounds for the City Council of the City of Medina
to immediately revoke said permit.

That part of the South 660 feet of the East 991 feet of the
Southeast Quarter of the Northeast Quarter of Section 16,
Township 118 North, Range 23 West of the Fifth Principal
Meridian, lying West of the following described line:
Beginning at a point on the East line of said Southeast
Quarter of the Northeast Quarter distant 895 feet North from
the Southeast Corner of said Southeast Quarter of the Northeast
Quarter; thence South along said East line a distance of 100
feet; thence along a tangential curve to the right having a
radius of 575 feet and central angle of 38 degrees 20 minutes
a distance 384.70 feet; thence Southwesterly tangent to said
curve to the South line of said Southeast Quarter of the
Northeast Quarter and there ending.
