LAWTON introduced the following resolution WHEREAS, John L. Lawton has requested approval of a re- quest for a variance to the provisions of Medina Zoning Ordi- nance S605.5; and WHEREAS, a variance to Medina Zoning Ordinance S605.5 is necessary if the property described below is to be developed; and WHEREAS, the City finds that there are at least four acres of soil classified as ErC2 and such soil is suitable for an innovative septic system pursuant to the Medina Individual Sew- age Treatment and Disposal Systems Code; and WHEREAS, the Medina City Council impliedly recognized the existence of such property in Development Agreements executed January 18, 1977, and March 1, 1978; and WHEREAS, innovative soils as defined by the Medina Indivi- dual Sewage Treatment and Disposal Systems Code are not contin- guous on the property involved; and WHEREAS, the literal. interpretation of the provisions of Medina Zoning Ordinance would deprive the owner of the prop- erty of the right to develop said property; and WHEREAS, the requested variance involves a deviation from the provisions of the Medina Zoning Ordinance by a maximum of one acre of suitable soil, and as such is found to be the mini- mum variance which would alleviate the hardship. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Medina hereby grants to John L. Lawton a variance to the provisions of Medina Zoning Ordinance S605.5 affecting land legally described as follows: The South 990.00 feet of the North 1980.00 feet of the East 442.75 feet of the West 885.5 feet of the Northwest Quarter of Sec- tion 7, Township 118, Range 23, Hennepin County, Minnesota upon the following terms and conditions: (1) The applicant shall conform in all respects to the Medina Subdivision Regulations and Individual Sew- age Treatment and Disposal Systems Code. " (2) The applicant shall enter into a Private Road Agree- ment as approved by the City Attorney. (3) The applicant shall construct a septic system in accordance with plans dated January 5, 1980 and on file with the City of Medina. Dated: , * 4) /S , 1983.
