HomeMy Public PortalAboutResolution 09-46291 1 1 RESOLUTION NO. 09-4629 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY UPHOLDING THE PLANNING COMMISSION'S ACTION AND APPROVING CONDITIONAL USE PERMIT 09 -1738, WITH AN AMENDED CONDITION OF APPROVAL, TO ALLOW THE ESTABLISHMENT OF A FAST FOOD RESTAURANT AT 9616 -9618 LAS TUNAS DRIVE. THE SITE IS DESIGNATED AS CITY CENTER (CC) COMMERCIAL ON THE CITY'S DOWNTOWN SPECIFIC PLAN LAND USE MAP. (KANG KANG FOOD COURT) (CUP 09 -1738) THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE: SECTION 1. Based upon information contained in the staff report to the City Council and information contained in the Planning Commission staff report as well as the Planning Commission minutes of July 28, 2009, and based upon a review of the plans and based upon testimony received at a noticed public hearing before the Planning Commission on July 28, 2009 and based upon a noticed public hearing before the City Council on August 18, 2009, the City Council hereby upholds the action of the Planning Commission and approves the Conditional Use Permit based upon the findings set forth in Planning Commission Resolution No. 09 -2280 PC. SECTION 2. Accordingly, Conditional Use Permit 09 -1738 is hereby approved, subject to the conditions set forth in Resolution No. 09 -2280 PC, and with the following condition added by the City Council: The rear entrance to the business shall be closed to public ingress and egress after 11:00 p.m. daily, except for required emergency access, to the extent allowed by all applicable building and fire codes. PASSED, APPROVED AND ADOPTED THIS 18th DAY OF AUGUST 2009.
