At The Brewster Town Office Building, 2198 Main Street, Brewster, MA MEETING MINUTES of May 10, 2017 Present : Chair Paul Ruchinskas, William Klein , Peter Johnson , Jeanne Boehm , Faythe Ellis, Elizabeth Taylor, Roland Bassett and Barbara Burgo . The Chair called the meeting to order at 4 : 30 pm . Recording or Taping Notification : "As required by the Open Meeting Law we are informing you that the Town will be videotaping and/or audio taping this public meeting. In addition, if anyone else intends to either video or audio tape this meeting they are required to inform the chair. " We request that all cell phones be turned off or to vibrate. 1 . Review of results of Town Meeting CPC articles . There was a review of the Town Meeting CPC articles . At the town meeting questions were raised regarding the Historic Preservation Professional Services contract for historic preservation with Eric Dray . Upon reviewing the contract with Eric Dray, it does go through November 30, 2017 that goes into a new fiscal year . If this contract is renewed by request from the Historical Commission , the contract should go through June 30th so as to keep them in one fiscal year . A regular project that runs for two or three years will not be affected except if it deals with wages . Concern was expressed about the Brewster Woods project by a former abutter to the property. Brewster Woods has been working closely with the neighboring property owners in this project . 2 . Treasurer' s report . Elizabeth Taylor distributed the CPC FY ' 17 budget dated April 18, 2017 that was put together by the Finance Director . The available balances listed in the budget were reviewed for Open Space, Housing, Historical , and the 30% . It is expected that the overall estimates of the CPA state match will be pretty close to the twenty percent assumptions that were made . Concern was expressed about the amount CPC Minutes 0510 2017 Page 1 of 4 of state match for next year that may be received . Brewster' s legislative delegation has signed letters of support for the CPA . 3 . Status of buy- down award and possible vote to change the award from a grant to a 0 % loan . Abigail Field ' s closing was delayed due to problems with the septic system . During the wait, it was determined that this buy- down would need to be considered taxable income . The Finance Director and town ' s legal services researched this issue . To address this, it was suggested that this buy- down be considered a loan at 0 % to the buyer that would be forgiven upon sale of the property as long as the property remains affordable and the buyer follows the primary residency requirements outlined in the mortgage that the town will hold . There was some concern that this wouldn 't work, but following consultation with town counsel it is felt it is an acceptable way to go . There was discussion about what may occur during a foreclosure or a refinance of the first mortgage . This 0% mortgage will remain on the books until the property is sold and should not be affected during a refinance . Concern was also expressed about what would happen during a divorce and this was briefly discussed . Since 2008 , this program has been loosely structured and it is recommended to put a hold on this program until a structure and rules are put in place that should be developed by the new housing coordinator . Motion made Roland Bassett to amend the award to Abigail Field from a grant to a 0% loan and to structure the 30K as a forgivable 0% note and mortgage . The lien would be forgiven upon sale or transfer as long as the owner has complied with the principal residency requirement and sells the property in accordance with the requirements in the deed restriction . Elizabeth Taylor seconded . VOTE : 8-0-0 i 4 . Review of membership list and expiring terms . Paul Ruchinskas reviewed the membership list and asked for any changes to be given to Donna . There is one vacancy for a citizen ' s representative . There are no reappointments that need to be done this year . 5 . Updates on open projects . Attorney Sarah Turano - Flores is still working on the historic preservation restriction on the Cobb House and she will be contacting Steve Jones about the historic preservation restriction on the Cobb House and Brewster Baptist Church . It is hoped to resolve these two open items soon . CPC Minutes 0510 2017 Page 2 of 4 There was a review of the use of CPA funds in the HECH program and the DOR has stated that CPA funds cannot be used for home rehabilitation programs and considers this an ineligible use of CPA funds unless CPA funds were used to purchase the property . Another source of funding for this program will be investigated . There was discussion on why it is felt that " Rehabilitation " was not an appropriate use of these funds . With the buy- down program , an affordable housing restriction is generated but this is not the case with the Rehabilitation program . Changes to the scoring of the applications made Brewster ineligible for the rehabilitation state funds . The Habitat program is moving along . Cape Cod Village has raised $ 950, 000 of CPA funds from the seven lower Cape towns for this development and a more complete report on this project will be made at the next meeting . Cape Rep is getting close to completing an exterior detail that needs involvement from Eric Dray . Janine will notify Eric when they are ready . The CPC is holding back $ 25 , 000 and Cape Rep should be requesting these funds in June . Photos were shown to the Committee of the staircase and basement of the building . Roland Bassett will check on the ball fields to make sure that they are complete and any unused funds will be returned to CPC through a budget transfer with an article at the fall Town Meeting . The Housing Coordinator position is currently being advertised and is also on the website . The Bikeways Committee award letter has been sent out, but as yet has not been returned . The Brewster Woods award letter and contract will be followed up on . 6 . Approval of minutes of April 12, 2017 CPC meeting . Motion made by Roland Bassett and seconded by Elizabeth Taylor to approve the meeting minutes of April 12, 2017 as presented . VOTE : 5 - 0- 3 7 . Items that the chair could not reasonably anticipate . The Historical Commission will be requesting CPA funds through a Professional Services Request to continue Eric Dray' s services . Since the entire amount currently approved may not be spent before June 30, 2017 , he may continue to work until the funds are expended and they will then request money for subsequent work . There was discussion on the best way to handle this since Eric Dray' s contract runs through November 30, 2017 though CPC Minutes 0510 2017 Page 3 of 4 anything billed after June 30, 2017 comes out of FY' 18 funds . This will be investigated further and a decision will be returned to the Committee at a future meeting . 8 . Next meeting : Wednesday, June 14, 2017 @ 4 : 30 p . m . @ town hall . The next meeting will be scheduled for June 14, 2017 at 4 : 30 pm . July 1, 2017 is the new deadline for fall CPA funding requests . Motion made by Elizabeth Taylor to adjourn the meeting at 4 : 14 pm . Roland Bassett seconded . VOTE : 8-0-0 Respectively submitted , Donna J .
